9.02.030 - Definitions.

As used in this chapter:

"Alcoholic beverage" means and includes alcohol, spirits, liquor, wine, beer and every liquid or solid containing alcohol, spirits, wine or beer, and which contains one-half of one percent or more of alcohol by volume, and which is fit for beverage purposes, either alone or when diluted, mixed or combined with other substances.

"Open container" means a bottle, can or other receptacle which has been opened, or a seal broken or contents partially removed.

9.02.040 - Offenses.

It is prohibited any person to consume or have in his or her possession, an open container of any alcoholic beverage on:

A. Any public highway, alley, crosswalk, trail, greenbelt, street or sidewalk or other place open for pedestrian travel;

B. Any public property, including parks, unless a permit has been issued;

C. Any privately owned business parking lots or residential parking lots serving two or more units.

9.02.050 - Exceptions.

The prohibitions identified pursuant to Section 9.020.040 shall not apply to the following instances:

A. Participating in events in a city park for which a permit has been issued pursuant to Chapter 12.04 as long as the person is in compliance with the terms of the permit; or

B. Participating in events for which a special event permit has been issued by the city containing the following conditions:

  1. Alcoholic beverages consumed or possessed at such events shall not be in glass or metal containers;

  2. The organizer of the special event shall comply with all state and local laws relating to the sale of alcoholic beverages;

  3. The organizer of the special event shall comply with all other conditions as required by local law enforcement; the parks and recreation department, and the city's risk management department.

C. Nothing in this section shall be construed to make unlawful any act or acts which are permitted by any law of the State.
