8.40.030 - Definitions.

As used in this chapter:

A. "Cesspool" means an excavation into the earth which is used for the reception of sewage or drainage from plumbing fixtures or effluent from septic tanks, together with the water used in carriage of the sewage or drainage, but which excavation does not have watertight walls or bottoms.

B. "Other private means of sewage disposal" means and includes any system, other than cesspools, subsurface drainage systems or public sewer system, used and/or designed for the disposal of sewage or drainage.

C. "Subsurface drainage system" means a system open-jointed or perforated piping installed beneath the surface of the ground designed to receive the effluent from a septic tank and to allow it to seep into the ground.

8.40.040 - Nuisance declared.

The further maintenance and/or use of cesspools, subsurface drainage systems or other private means of sewage disposal from buildings inhabited or used by human beings and located within one hundred feet of a public sewerage system is declared to be a public nuisance.

8.40.050 - Connection to sewer required.

A. Any building inhabited or used by human beings shall be connected to the public sewerage system within ninety days from the date (10-11-48) of the adoption of this article, if the building to be served thereby is located within one hundred feet of the sewerage system.

B. Any building inhabited or used by human beings, the construction of which is completed subsequent to the date of the adoption of this article (10-11-48) shall be connected to the public sewerage system within ninety (90) days from date of completion, if the building to be served thereby is located within one hundred feet of the public sewerage system.
