15.34.010 - Short title.¶
This chapter may be cited as the "Shafter Residential Swimming Pool and Spa Code."

15.34.020 - International Swimming Pool and Spa Code—Adopted.¶
That portion of the International Swimming Pool and Spa Code, 2021 Edition, including Appendix AX of the 2022 California Residential Code (California Swimming Pool Safety Act), as modified and amended by this chapter, is adopted by this reference into the Shafter Residential Swimming Pool and Spa Code.

15.34.025 - International Swimming Pool and Spa Code—Provisions not adopted.¶
The following provisions of the International Swimming Pool and Spa Code are not adopted as part of this chapter and shall not apply thereto:
A. Section 105.3 Time limitation of application
B. Section 112 Board of Appeal
C. Chapter 4 through 6 of the International Swimming Pool and Spa Code.
D. Appendix A Board of Appeals

15.34.030 - International Swimming Pool and Spa Code—Amendments.¶
The following sections of the 2021 International Swimming Pool and Spa Code, are amended to read as follows:
Section 101.1 amended—Title.
Section 101.1 is amended to read as follows:
Section 101.1 Title. These regulations shall be known as the Shafter Residential Swimming Pool and Spa Code, hereinafter referred to as "this code."
Section 101.2 amended—Scope
Section 101.2 us amended to read as follows:
Section 101.2 Scope.
The provisions of this Code shall apply to the construction, alteration, movement, renovation, replacement, repair, and maintenance of residential Aquatic recreation facilities, pools, and spas. The pools and spas covered by this code are either permanent or temporary, and shall be only those that are designed and manufactured to be connected to a circulation system and that are intended for swimming, bathing, or wading.
Section 102.7.1 amended—Application of the International Codes
Section 102.7.1 is amended to read as follows
Section 102.7.1 Application of the California Codes.
All references in this chapter to provisions and sections of the International Building Code, the International Residential Code, the International Fire Code, the International Pluming Code, the International Mechanical Code, the NFPA 70 or the International Energy conservation Code shall be replaced with the corresponding provisions and sections of the Shafter Building Code, the Shafter Residential Code, Shafter Fire Code, the Shafter Plumbing Code, Shafter Mechanical Code, the Shafter Electrical Code, and the Shafter Energy Code, respectively. All references to the International Fuel Gas Code shall be replaced with the corresponding references to the Shafter Plumbing Code.
Section 103.1 amended—Creation of agency.
Section 103.1 is amended to read as follows:
Section 103.1 Creation of agency. The Shafter Building Director shall enforce this code and the Building Official shall be the code official.
Section 113.4 amended—Violation penalties.
Section 113.4 is amended to read as follows:
Section 113.4 Violation penalties.
Any persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, or repair a pool or spa in violation of the approved construction documents or directive of the building official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties prescribed by law.
All of Section 304 is amended to read as follows:
Section 304—Flood Hazard Areas
Section 304 General.
The design and construction of pools and spas installed in flood hazard areas shall comply with Chapter 15.44 of the Ordinance Code and other applicable sections of this code.

15.34.060 - Section 202 amended—Definitions.¶
Section 202 of the International Swimming Pool and Spa Code is amended by changing or adding certain definitions as follows:
A. Definitions added.
"Board" and "Board of Appeals" are added and shall mean the Shafter Board of Building Appeals, established by Section 15.04.160 of the Shafter Municipal Code.
"Building Official" shall mean the Building Permit and Services Department and the Director of.
B. Definitions amended.
"Code Official" shall mean the Shafter Building Code, as adopted by the Code of Building Regulations.
"Housing Code" shall mean the "Building Official."

15.34.070 - Section 301.1.2 added—Conflicts.¶
Section 301.1.2 is added to read as follows:
Section 301.1.2 Conflicts.
In the event of a conflict between the provisions of the California Swimming Pool Safety Act, the International Swimming Pool and Spa Code, 2021 Edition, the 2022 California Building Code, or the 2022 California Residential Code, the Building Official shall implement the most restrictive measures citied.
Section 303.1.2.1 added—Operating time.
Section 303.1.2.1 is added to read as follows:
Section 303.1.2.1 Operating time.
A time switch or other control mechanism shall be installed as part of a pool water circulation control system that will allow all pumps to be set or programmed to run only during off-peak electric demand period, and for the minimum time necessary to maintain the water in the conditions required by applicable public health standards.
