5-6-1: DEFINITIONS:¶
Whenever the following words or terms are used in this Chapter, they shall have the meanings herein ascribed to them:
AMUSEMENT MACHINE: The term "amusement machine" shall mean any sport pastime played or operated with cards, dice, balls, pins, checkers, counters, quoits, benas, spindles, tables, wheels, or any other device, contrivance, or apparatus or any combination thereof, which machines are operated by inserting therein a coin or by payment of a valuable consideration.
PHONOGRAPH MACHINE: The term "phonograph machine" shall mean any machine or device playing phonograph records reproducing voice, music, or sound, which machine or device is operated by inserting therein a coin or by payment of a valuable consideration.
5-6-2: LICENSE REQUIRED:¶
It shall be unlawful for any person to conduct, operate or carry on the business of any amusement machine or phonograph machine without first having obtained a license therefor from the Clerk.
5-6-3: APPLICATION FOR LICENSE; INVESTIGATION:¶
Every person desiring to conduct, operate or carry on the business of one or more amusement machines or phonograph machines shall make written application to the Clerk for a license so to do on forms to be provided by the Clerk. The Clerk shall not issue any license for any amusement machine until he has made an investigation concerning the legality of the amusement machine and finds the machine to be legal. 5-6-4: LICENSE FEE:¶
Every person who engages in the business of owning, leasing, renting and or operating coin-operated amusement vending machines at a fixed place of business within the City shall pay a license fee as set forth in Section 5-1-34. (Ord. 891, 3-2-87, eff. 7-1-87)
5-6-5: OPERATING WITHOUT LICENSE; SEIZURE; REDEMPTION:¶
Any amusement machine or phonograph machine which is operated in the City without a license shall be seized and held by any authorized officer of the City and may be redeemed only by the owner paying the reasonable value of the storage and safekeeping of the machine together with a license fee for the period during which the machine was operated without a license, and the redemption must be made within sixty (60) days after the seizure of the machine.
5-6-6: UNREDEEMED MACHINES; SALE OR DESTRUCTION:¶
In the event that any amusement machine or phonograph machine seized for nonpayment of license fee shall not be redeemed as herein provided, the machine shall be sold or destroyed by the Clerk, and if sold, the money received from the sale thereof shall be deposited in the Treasury.
5-6-7: OPERATION WITH OTHER BUSINESS NO EXEMPTION:¶
The license fees provided for herein shall be paid whether the amusement machine or phonograph machine is operated in connection with any other business or not. (Ord. 389, 3-1-48)
