4-9-1: ADOPTION OF THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE:¶
Pursuant to the provisions of section 50022.2 of the Government Code of the state of California, the city council of the city of Selma does hereby adopt by specific reference thereto and incorporation herein by said reference, the provisions, rules and regulations specified and set forth in the 1997 edition of the uniform swimming pool, spa and hot tub code as prepared and adopted at the 67th Annual Conference, September 1996, and published by the International Association of Plumbing and Mechanical Officials, 20001 Walnut Drive South, Walnut, CA 91789-2825 in November 1996, three (3) copies of which are on file in the community development department, for public record and inspection. These are hereby adopted by said council by reference as the swimming pool, spa and hot tub code of the city of Selma, and made a part of this chapter as though set forth in full, subject however, to the amendments, additions, deletions, and fee exceptions as set forth in this chapter. This code shall be designated as title IV, chapter 9, the swimming pool, spa and hot tub code of the city of Selma. (Ord. 2002-15, 10-7-2002)
4-9-2: AMENDMENTS, ADDITIONS, DELETIONS, AND FEE EXCEPTIONS:¶
(A) DELETE: Section 110, Fees; Table 1-1, Schedule of Fees.
ADD: PERMIT FEES: The provision for swimming pool, spa and hot tub permit fees and all matters relating to permits shall be as set forth in the latest Resolution approved by the City Council establishing a schedule of fees and charges.
(B) DELETE: Section 106, Violation and Penalties.
ADD: VIOLATION; PENALTY: It shall be unlawful for any person, firm or corporation, to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy or maintain any building or structure in the City, or cause or permit the same to be done, contrary to or in violation of any of the provisions of the Uniform Swimming Pool, Spa and Hot Tub Code. The Building Official or his/her authorized representative shall issue a citation for an infraction, unless a determination has been made by the City Attorney that a misdemeanor charge is more appropriate. The citation shall be issued to the person, firm or corporation where the violation exists, certified mail or by personal delivery. If the property has an occupant other than the owner, a copy of the citation shall also be posted at the property or delivered to the occupant. The Citation shall contain the following:
The location of the subject property by street number and/or Assessor Parcel Number.
A description of the violation and the applicable Uniform Swimming Pool, Spa and Hot Tub Code section.
A notice to appear before the Court or Superior Court of the County of Fresno, if applicable by determination of the City Attorney, at a specified date and time.
