12.20.010 - Findings and determination.

The city council finds and determines that the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in the area on, along and/or adjacent to a certain portion of Scotts Valley Drive, which area is established as Underground Utility District No. 3. Said Underground Utility District No. 3 is more particularly described in Exhibit A titled "Underground Utility District No. 3 Scotts Valley Drive, City of Scotts Valley," and further clarified in Exhibit B titled "Underground Utility District No. 3A." Exhibits A and B are attached to the ordinance codified in this chapter, and by this reference incorporated herein. This ordinance and the attached Exhibit A are kept on file in the office of the city clerk.

A. Such undergrounding will avoid or eliminate an unusually heavy concentration of overhead distribution facilities;

B. The streets, roads or rights-of-way in the district are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic.

12.20.020 - Undergrounding required.

All poles, overhead wires and other associated overhead structures shall be removed and underground installation made in said Underground Utility District No. 3 within the following times:

A. Underground installations and reconnections by utility companies and property owners shall be made not later than October 15, 1996.

B. Removal of poles, overhead wires and other associated overhead structures by utility companies shall be made not later than October 15, 1997.
