7.04.010 - Short title.¶
The ordinance codified in this title shall be known as the "City Park Ordinance."

7.04.020 - Definitions.¶
For the purpose of this title, unless it is plainly evident from the context that a different meaning is intended, certain terms used herein are defined as follows:
A. "City" means the city of Scotts Valley.
B. "Recreation Division Manager" means the public works director or his/her designee.
C. "Park" means and includes all grounds, buildings, improvements, and areas dedicated to use by the public for park, recreation or open space purposes, and any part, portion or area thereof, whether developed or undeveloped, or property over which the city has acquired right of use for such purposes.
D. "Person" means any person, firm, partnership, association, business trust, corporation, company or organization of any kind.
E. "Vehicle" means and includes any wheeled device of conveyance whether propelled by motor, animal or human power. The term shall include any trailer in tow of any kind, size or description. Exception is made for vehicles in the service of the city and for baby carriages, strollers and wheelchairs.

7.04.040 - Statement of principles.¶
All parks within the city are held in trust for the use of the public. Included within such use are public assembly, communication of thoughts between citizens and discussion of public questions. These uses of the city's parks are recognized as privileges, immunities, rights and liberties belonging to all citizens, regardless of sex, race, religion, color, national origin, or political or philosophical persuasion. It is also recognized that the right to use the parks is not absolute, but relative, and must be exercised in subordination to the general comfort and convenience and in consonance with peace and good order.

7.04.060 - Rules and regulations—Administration—Scope.¶
A. The public works department shall administer and protect the city parks for use and enjoyment by the public. The recreation division manager shall promulgate reasonable rules and regulations to be observed by the public in the use of city parks or portions thereof, and shall maintain in the recreation division manager's office and in the office of the city clerk a file of all such rules and regulations which shall be open to public inspection during normal business hours.
B. Said rules and regulations shall promote the preservation of public property and its maintenance in a clean and safe condition, the protection of health and safety of the public in general, and the enjoyment of parks by the public as places of recreation and repose. Said rules and regulations shall be adopted only after a public hearing at which time the recreation division manager shall afford any interested person the opportunity to present statements in writing, with or without opportunity to present the same orally. The recreation division manager shall consider all relevant matters presented to him/her before adopting or amending any regulation. Notice of said hearing shall be given at least ten calendar days prior to such hearing by publication in a newspaper of general circulation.
C. It is unlawful to violate any rule or regulation promulgated and adopted as provided in subsection A above. Any person who violates a park and recreation rule or regulation shall be guilty of an infraction and shall be subject to penalties provided in Chapter 1.08 of this code.
