§ 10-08.010. Public excretion.

(A) It is unlawful for any person over the age of 10 years to wilfully urinate or defecate in a public place or in a place exposed to public view.

(B) It is unlawful for any person over the age of 10 years to wilfully expose his person or private parts for the purpose of urination or defecation in a public place or in a place exposed to public view in such a manner that the genitals, vulva, pubis, pubic symphysis, pubic hair, buttocks, natal cleft, perineum, anus, anal region or pubic hair region is exposed to public view.

(A) Prohibition of Nudity by Waitpersons and Entertainers. No person acting as a host, bartender, waitperson or entertainer, whether or not such person is paid compensation for such activity, shall expose the vulva, genitals, pubic hair, cleft of the buttocks, perineum, anus or anal region, or the nipples or areola of the breasts of a female while working in an establishment which serves food, beverages, or food and beverages, including but not limited to alcohol, for consumption on the premises.

(B) Prohibition of Nudity in Public Places. No person shall expose the vulva, genitals, pubic hair, cleft of the buttocks, perineum, anus or anal region, or the nipples or areola of the breasts of a female while participating in any live act, demonstration, performance, or exhibition for which such person receives or may receive compensation, which occurs in a public place, place open to the public, or a place open to public view, whether the total number of participants is one or more than one.

(C) Permitting or Procuring Violation. No person shall permit, procure, or assist any person to violate this section.

(D) Exemption. The provisions of this section shall not apply to a theater, concert hall, or similar establishment which is primarily devoted to theatrical performances.
