§ 16-12.010. Enterprise created.¶
A Surface Water, Storm Water, Storm Drainage and Flood Control Management Enterprise is hereby created as a City Enterprise and utility to operate, maintain, and fund the City's surface water, storm water, storm drainage and flood control management. This Enterprise may provide for, among other related matters, the funding, permitting, maintaining, planning, designing, retrofitting, reconstructing, constructing, acquiring, environmentally restoring, regulating, surveying, water quality testing, and inspecting of surface water, storm water, storm drainage and flood control facilities, and the management thereof.

§ 16-12.020. Boundaries; benefits.¶
The boundaries of the Enterprise shall be co-extensive with the boundaries of the City. The Council hereby finds and determines, based upon appropriate evidence and inquiry, that all properties within the boundaries of the City will be specially benefited by the enterprise and the improving, maintenance, operation and management thereof and are properly included within the Enterprise.

§ 16-12.030. Management of system.¶
The Council may adopt surface water, storm water, storm drainage and flood control management programs or regulations to facilitate operation of the Enterprise. The Director of Public Works shall act as Director of the Enterprise and shall be responsible for administering and supervising the operations of the surface water, storm water, storm drainage and flood control management systems in accordance with the provisions of the management programs adopted by the Council, and revised from time to time, pursuant to Council resolution.

§ 16-12.040. Separate agency.¶
The Enterprise shall be maintained and operated as a separate department and agency of the City, distinct from the City itself; revenues received and obligations incurred by the Enterprise shall be separate revenues and obligations distinct from those of the City.
