§ 116.01 - DEFINITIONS.¶
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
Figure Model. Any person, male or female, who poses to be observed, viewed, sketched, painted, drawn, sculptured, photographed or otherwise similarly depicted.
Model Studio. Any premises on which there is conducted the business of furnishing figure models who pose for the purpose of being observed or viewed by any person or of being sketched, painted, drawn, sculptured, photographed, or otherwise similarly depicted for persons who pay a fee, or other consideration or compensation, or a gratuity, for the right of opportunity so to depict the figure model, or for admission to, or for permission to remain upon, or as a condition of remaining upon the premises; and any premises where there is conducted the business of furnishing or providing or procuring for a fee or other consideration or compensation or gratuity, figure models to be observed or viewed by any person or to be sketched, painted, drawn, sculptured, photographed or otherwise similarly depicted. The words Model Studio do not include any studio which is operated by any state college, or public junior college or school wherein the persons, firm, association, partnership or corporation operating it has met the requirements established in Cal. Educ. Code §§ 66000 et seq., for the issuance or conferring of, and is in fact authorized thereunder to issue and confer a diploma or honorary diploma; and any premises where there is conducted the business of furnishing, providing or procuring figure models solely for any studio described in this definition.

§ 116.02 - LICENSE REQUIRED.¶
A person shall not operate a model studio without first having obtained a written license from the City Manager.

§ 116.03 - APPLICATION.¶
(A) An applicant for a model studio license shall file a verified application therefor with the Director of Police Services. Such application shall be filed at least 30 days prior to the proposed commencement of the model studio business.
(B) The application shall set forth the following:
(1) The name and address of the applicant.
(2) The name and address of the owner of the premises where such model studio business is to be conducted.
(3) If the proposed permittee is a corporation, the names and addresses of the principal corporate officers and the state of incorporation.
(4) A description of the type or nature of the business or commercial enterprise conducted at or upon the premises.
(5) The days and hours during which such business is to be conducted.
(6) A statement as to whether minors will be permitted upon the premises.
(7) Such other data as the City Manager may reasonably require in the interest of public health, safety or welfare.
(8) A statement certifying, on penalty of perjury, the correctness of the information given on the application and agreeing on behalf of the proposed permittee that there shall be full compliance of the permittee with all state and city laws in the conduct of the activities for which a permit may be granted.

§ 116.04 - AGE REQUIREMENTS OF LICENSEE.¶
A model studio license shall not be issued to any person under 21 years of age or to a corporation any of whose officers are under 21 years of age.

§ 116.05 - REFERRAL NOTICES.¶
The Director of Police Services shall transmit a copy of every license fee referral memo for any license under this chapter to the Chief of Police and to other affected city departments for a report.

§ 116.06 - LICENSE FEE.¶
The application for the model studio license and the fee for the annual model studio license shall be an amount as set by City Council resolution.

§ 116.07 - STANDARDS FOR ISSUANCE OR DENIAL.¶
In granting or denying a license under this chapter, the City Manager shall consider, in determining whether any conditions are to be imposed, modified or waived in respect to the granting of such license, and in determining whether such license should be issued or denied, those factors set forth in the applicable sections of this code.

§ 116.08 - SIGNS.¶
A person operating a model studio shall not erect or maintain or permit the erection or maintenance on the outside of the model studio any sign which, in whole or in part, depicts the human form or any portion or portions thereof, whether clothed or unclothed.

§ 116.09 - HOURS OF OPERATION.¶
A person shall not conduct or operate a model studio between the hours of 10:00 p.m. and 10:00 a.m. of the following day.

§ 116.10 - SUPERVISION.¶
A person operating a model studio, or a manager previously fingerprinted and approved by the Police Department shall be present on the premises at all times when the establishment is in operation.

§ 116.11 - VISIBILITY.¶
A person operating a model studio shall not permit conditions to exist wherein the interior of the model studio shall be visible from the outside of the premises, nor shall such person or any of his employees conduct any part of such business in the doorway or on the sidewalk of such premises.

§ 116.12 - INSPECTION.¶
A person operating a model studio shall be responsible for and shall provide that any room or area used for the purpose of figure modeling shall be readily accessible at all times and shall be opened to view in its entirety for inspection by any law enforcement officer.

§ 116.13 - RECORDS.¶
A person operating a model studio shall maintain a current file of all figure models employed by him or using the premises. This file shall contain true name and aliases used by the figure model, age, birth date, height, weight, color of hair and eyes, home address, phone number, Social Security number and the date of employment and termination. Inactive file cards shall be maintained on the premises for the period of one year following termination. Such person shall make all records available immediately upon demand of any peace officer.

§ 116.14 - COMMUNICATION DEVICES.¶
A person operating a model studio shall not permit communication devices to be installed or used in any manner on the premises so as to interfere with or hinder inspections by peace officers.

§ 116.15 - POSTING REGULATIONS.¶
A person operating a model studio shall post and continuously keep posted a copy of this chapter in a conspicuous place inside the premises.

§ 116.16 - SUSPENSION OR REVOCATION OF LICENSE.¶
Any license issued under the terms of this chapter may be revoked or suspended pursuant to the applicable provisions of this code. As utilized in said provisions, for purposes of this chapter, the words Amusement or Entertainment shall be deemed to mean "model studio business."

§ 116.17 - APPEALS.¶
The applicable provisions of this code shall also govern appeals under this chapter. For purposes of this chapter, the word Entertainment, as used in this code, shall be deemed to mean "model studio business."
