PLANNING COMMISSION

§ 32.01 - ESTABLISHED.

There shall be established a Planning Commission for the city.

§ 32.02 - COMPOSITION; APPOINTMENT; TERMS; VACANCIES.

The Planning Commission shall consist of five members who shall be qualified electors of the city. Each member of the City Council shall appoint one person to the Planning Commission.

§ 32.03 - ORGANIZATION.

(A) The Planning Commission shall elect its chairman from among its appointed members for a term of one year and, subject to other provisions of law, may create and fill such other offices as it may determine.

(B) The Planning Commission shall elect a vice-chairman from among its appointed members. The Planning Commission shall also appoint a secretary who need not be a member of the Commission.

§ 32.04 - MEETINGS; RULES; RECORD OF BUSINESS.

(A) The Planning Commission shall hold at least one regular meeting in each month. It shall adopt rules for transaction of business and shall keep a record of the resolutions, transactions, findings and determinations of the Commission, which record shall be a public record.

(B) A regular meeting as provided for by law or by rule of the Planning Commission, or any regularly advertised public hearing, shall be deemed a regular meeting.

§ 32.06 - POWERS AND DUTIES.

The Planning Commission shall perform the duties and shall have all rights, powers and privileges specified and provided for by municipal ordinance or resolution or by state law.

§ 32.07 - EXPENSES AND COMPENSATION.

The Planning Commission and the respective members thereof shall be entitled to compensation or reimbursement for all necessary and proper expenses incurred by the Commission or by such members in connection with the meetings of the Commission and in connection with the business of the city transacted by or in connection with the activities, duties and responsibilities of the Commission. In addition, the members thereof shall be entitled to compensation at a rate set by City Council resolution for each meeting of the Commission attended, for not to exceed two meetings per calendar month. For purposes of determining compensation, all meetings held on a single calendar date shall be deemed to be one meeting.

COMMUNITY DEVELOPMENT COMMISSION

§ 32.15 - DECLARATIONS.

(A) The City Council declares that there is need for a Community Development Commission to function in the city.

(B) The City Council further declares a need that the Commission function with respect to a redevelopment agency and a housing authority.

(C) The City Council declares itself to be the Community Development Commission.

§ 32.16 - FINDINGS.

The City Council finds that the City Housing Authority does not have tenants. When and if the Housing Authority does have tenants, the City Council shall appoint to the Community Development Commission two tenants of the Housing Authority, one of whom shall be over 62 years of age if the Housing Authority has tenants of such age, within one year after the Housing Authority first does have tenants. The tenant Commissioners shall have all the powers, duties, privileges, and immunities of any other Commissioner.

§ 32.17 - COMPENSATION OF COMMISSIONERS AND NON-COMMISSIONERS.

(A) The monthly compensation of the Commissioners shall be equivalent to the amounts of compensation paid to members of the City Council, plus $200.

(B) The compensation to be paid to officers of the Community Development Commission other than the Commissioners shall be those amounts which those persons presently are paid in their official capacities for the Redevelopment Agency of the city and the City Housing Authority.

§ 32.18 - REDEVELOPMENT AGENCY MEMBERS TO BE MEMBERS OF COMMISSION.

All officers and employees of the Redevelopment Agency of the city are hereby selected and appointed to the same corresponding positions within the Community Development Commission. All agreements and contractual arrangements heretofore entered into by both the redevelopment agency and the City Housing Authority are hereby adopted and ratified on behalf of the Community Development Agency.

§ 32.19 - BY-LAWS, RULES AND PROCEDURES.

All by-laws, rules and procedures heretofore adopted by the Redevelopment Agency of the city are hereby adopted as the by-laws, rules and procedures of the Community Development Commission.

§ 32.20 - ACQUISITION OF PROPERTY BY EMINENT DOMAIN.

Pursuant to Cal. Health and Safety Code § 33342.7, a description of the Community Development Commission's program to acquire real property by eminent domain is set forth in Exhibit A, attached to Ordinance No. 982, and incorporated as though fully set forth herein. Such program may be amended only by amending the applicable redevelopment plan(s) pursuant to the procedures set forth in Article 12 (commencing with Cal. Health and Safety Code § 33450) of the California Community Redevelopment Law.

RULES GOVERNING ALL COMMISSIONS AND COMMITTEES

§ 32.30 - CREATION.

The City Council may establish city commissions and committees in accordance with applicable law and by ordinance or resolution. The powers and duties of commissions and committees are limited to those granted by the City Council.

§ 32.31 - ELIGIBILITY.

Except as otherwise provided in this code, in order to serve on a commission or committee, an individual must be a resident or have an established business interest in the city. In order to serve on a youth-based commission or committee, an individual must be a resident or attend school in the city. These are minimum eligibility requirements, and certain commissions and committees may have additional eligibility requirements.

§ 32.32 - APPLICATIONS.

Application forms for appointment to a commission or committee shall be made available in the City Clerk's Office. A completed application form submitted to the City Clerk is a minimum requirement to be considered for appointment. Applications shall be valid for six months.

§ 32.33 - APPOINTMENTS.

Beginning in 2021, appointments to commissions and committees shall be made in January.

§ 32.34 - TERM.

The term of service for any individual appointed to a commission or committee shall be two years beginning in January. Any individual appointed to fill an unexpired term shall serve for the unexpired portion of that term. All commission and committee members shall continue in office until their successors are appointed.

§ 32.35 - LIMIT.

The same individual may serve on no more than three commissions or committees, or any combination thereof, at any given time.

§ 32.36 - ABSENCES.

If an individual appointed to a commission or committee that meets on a monthly basis is absent from four meetings within a calendar year, or absent from four consecutive meetings, that individual shall be deemed to have resigned from the commission or committee. If an individual appointed to a commission or committee that meets on a quarterly basis is absent from two meetings within a year, that individual shall be deemed to have resigned from the commission or committee. An individual who has been deemed to have resigned from a commission or committee due to such absences will be eligible to re-apply to serve on that commission or committee no earlier than six months after such resignation.

§ 32.37 - TARDINESS.

Any individual appointed to a commission or a committee who is more than fifteen minutes late to a meeting will be treated as absent from that meeting.

§ 32.38 - REMOVAL.

Every individual appointed to a commission or a committee serves at the pleasure of the City Council and may be removed at any time by the City Council member who appointed that individual or by a 4/5 vote of the City Council. Where a City Council member leaves office before the expiration of his or her term, his or her successor to serve the remainder of the term may remove his or her appointed commissioners and committee members and may appoint other commissioners and committee members.

§ 32.39 - ADDITIONAL RULES AND REGULATIONS.

(A) All commissions and committees of the City shall be subject to the Rules of Decorum established in Section 30.21.

(B) The City Council may establish additional rules and regulations governing city commissions and committees that are consistent with the provisions of this code.
