Sec. B17-92. - Short title.

This chapter may be cited as the "Residential Permit Parking Areas Ordinance."

Sec. B17-93. - Definitions.

The terms "vehicle," "park" and "stand" as used in this chapter mean the same as defined in the California Vehicle Code.

Sec. B17-94. - Generally.

Streets or highways, or portions thereof, designated in this chapter to be residential permit parking areas, shall be subject to the following prohibitions, restrictions, regulations and conditions.

Sec. B17-95. - Prohibitions.

Except as otherwise provided herein, no person shall stand or park a vehicle upon any street or highway, or portion thereof, designated a residential permit parking area. This prohibition shall not apply to any ambulance, police, fire, or other emergency vehicle under the control of an individual providing service to property located on a street in a residential permit parking area.

Sec. B17-96. - Exception—Service vehicles.

Any service vehicle, including but not limited to a delivery vehicle which is under the control of an individual providing service to property located on a street in a residential permit parking area, shall be permitted to stand or be parked temporarily for the purpose of and while actually engaged in providing services to or making pickups or deliveries of goods, wares or merchandise from or to any building or structure located on the restricted streets or highways or for the purpose of delivering materials to be used in the actual bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted streets or highways. Identification of any such service vehicle shall be the responsibility of the driver of such vehicle and demonstrated in a manner determined by the County Road Commissioner.

Sec. B17-97. - Same—Disabled persons.

The provisions of this chapter shall not apply to any disabled person or disabled veteran whose vehicle displays the identifying disabled person's or veteran's license plate or the disabled person's placard issued by the Department of Motor Vehicles.

Sec. B17-98. - Violation; penalty.

Violation of this chapter shall constitute an infraction, and penalty for violation shall be as provided for infractions in the California Vehicle Code.

Sec. B17-99. - Designation of areas.

Such streets or highways, or portions thereof, as are designated by the Board of Supervisors by resolution are residential permit parking areas subject to the provisions of this chapter.

Sec. B17-100. - Permits for residents.

Notwithstanding the parking or standing prohibitions and restrictions in this chapter, persons who reside on streets or highways designated residential permit parking areas may be issued permits exempting them from the prohibitions and restrictions hereof pertaining to their location of residence. Any vehicle on which is displayed a valid parking permit as provided for herein shall be permitted to stand or be parked on a street in the respective residential permit parking area. Said vehicle shall not be exempt from parking restrictions or prohibitions established pursuant to authority other than this chapter. A parking permit hereunder shall not guarantee or reserve to the holder thereof an on-street parking space on a street in the residential permit parking area.

Sec. B17-101. - Issuance of permits.

Vehicle parking permits shall be issued by the Road Commissioner. A separate and individual application and permit is required for each and every vehicle parked upon the restricted street.

Sec. B17-102. - Manner of obtaining, renewing permit.

Permits may be obtained and renewed upon application and in the manner required by the Road Commissioner.

Sec. B17-103. - Required information for permit application.

Each application for a parking permit shall contain information sufficient to identify the applicant, his or her residence address on a street within the residential permit area, the license number of the vehicle for which application is made, and such other information as may be deemed relevant by the Road Commissioner.

Sec. B17-104. - Issuance of permits.

Permits may be issued only upon application of a legal resident of property adjacent to a street within the residential parking permit area who has a vehicle registered in his or her name or who has a vehicle for his or her exclusive use and under his or her control.

Sec. B17-105. - Expiration of permit.

Every parking permit issued under this chapter shall expire at midnight December 31 of each odd-numbered year, including the year in which it is issued, if applicable.

Sec. B17-108. - Proof of residency.

Proof of residency shall be demonstrated in a manner determined by the Road Commissioner.

Sec. B17-109. - Transfer of permit prohibited.

No permit issued hereunder shall be transferred or sold by the permittee. The exemptions granted to permittees under this chapter shall be void with respect to any such transferee.

Sec. B17-110. - Display of permits.

Permits shall be displayed in a manner determined by the Road Commissioner.

Sec. B17-111. - Replacement permits.

Replacement permits will be issued upon an affidavit of loss of the original.

Sec. B17-112. - Authority of Road Commissioner to amend rules, regulations.

The Road Commissioner is authorized to issue and from time to time amend rules and regulations not inconsistent with this chapter, governing the manner in which persons shall qualify for parking permits.

Sec. B17-113. - Signs, markings required.

The provisions of this chapter or resolution pursuant thereto shall not apply with respect to any residential permit parking area designated until signs or markings giving adequate notice thereof have been placed.
