Sec. B14-11.2. - Definitions.

In addition to the provisions of Chapter 1 of Division A1 of this Code concerning definitions, applicability, and rules of construction, the following definitions apply to this Division unless otherwise specified:

(a) Alcoholic Beverage: Any alcohol, spirits, liquor, wine, beer and every liquid containing alcohol used as a beverage.

(b) Amplified Sound, Music, or Noise: Any sound equipment used to increase or control the power from a signal of any music or sound device (including, but not limited to, a computer, portable music player or turntables); any public-address system for making announcements; any electronic or type of device that increases volume or broadcasts volume; or anything that requires amplifiers or sound mixers.

(c) Commercial Photography: Any form of photography (digital, chemical or by other means or technology) that is performed for profit or other commercial purposes or that may be sold or used for commercial purposes at a later date.

(d) Commercial Filmmaking: Capturing or recording motion pictures using video, film, digital or other technology which is performed for profit or other commercial purposes or that may be sold or used for commercial purposes at a later date.

(e) Concession: A person or agency that provides specialized services or facilities to the Department for a fee or other exchange for the service.

(f) Department: The Parks and Recreation Department of the County of Santa Clara.

(g) Deposit: A charge (all or a portion of which may be refundable) collected at the time of reservation assuring that costs may be recovered by the Department for cleaning, repair, or damages, or any other extra service incurred during use of park facilities.

(h) Director: The Director of the Parks and Recreation Department or designated representative.

(i) Disabled Person: A driver whose vehicle displays the "disabled" license plate or placard issued by the California Department of Motor Vehicles.

(j) Drone: As defined by applicable law, an unmanned aircraft system, an unmanned aircraft, an unmanned aerial vehicle, an unpiloted aerial vehicle or remotely piloted aircraft that is operated without a human pilot or operator on board or without direct human intervention from within or on the aircraft or vehicle. A Drone may be controlled autonomously or by onboard computers or by the remote control of a person on the ground or in another facility, vehicle, aircraft or Vessel.

(k) Electric Bicycle: A bicycle equipped with fully operable pedals and an electric motor of less than 750 watts and that falls into one of these two categories:

(1) A "Class 1 Electric Bicycle" or "Low-Speed Pedal-Assisted Electric Bicycle" is a bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour; or,

(2) A "Class 2 Electric Bicycle," or "Low-Speed Throttle-Assisted Electric Bicycle," is a bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour.

(l) Minor or Youth: Persons under 18 years of age.

(m) Model Craft: A small or miniature sized replica of an aircraft, watercraft, boat or other craft not designed to be operated by a person or persons sitting, standing, or kneeling on or in the craft.

(n) Motor Vehicle: Any multi-wheeled, treaded or sledge type vehicle that is propelled by a motor or engine, including vehicles known as "recreation vehicles."

(o) Motorized Device: Any motor-driven cycle or Motorized Bicycle as defined in California Vehicle Code §§ 405 and 406; or, any motorized skateboard or scooter.

(p) Park, Park Property, or Park Area: Any real property (or portions thereof) owned, leased or licensed by the County or under County use or control through easement or other right and which is operated, maintained, or managed by or for the Department.

(q) Park Waters: Any lake, reservoir, pond, river, stream, or other body of water within a Park or under the management, protection, or control of the Department.

(r) Personal Watercraft: A watercraft less than 13 feet in length, designed to be operated by a person or persons sitting, standing, or kneeling on the craft rather than within the confines of a hull.

(s) Pet: A domestic animal, kept for companionship or pleasure that has been issued a valid pet license by the jurisdiction where the pet owner resides and has received a current rabies vaccination acceptable by state of California standards.

(t) Soundscape: All the different sounds or noises that can be heard in an area at any given time.

(u) Valid Permit: A permit issued by the Director, subject to revocation, suspension, or modification, that gives the organization or person(s) named on the permit permission to engage in some activity, use, or event. Valid Permits have a date range during which the permittee may engage in the listed activity, unless the permit is revoked, suspended, or modified by the Director. The expiration of such date range renders the permit void.

(v) Vessel: Any watercraft, Personal Watercraft, boat, powerboat, motorboat, houseboat, submarine, submerged vessel, or nonpowered vessel used, or capable of being used, as a means of transportation or recreation on, in or under water.

(w) Waiver: Where authorized by applicable law, a waiver of all or part of a fee or fees issued by the Director or as otherwise approved by the Board of Supervisors.

(x) Youth Organization: Any organization with a valid state or federal nonprofit status, for the benefit of Minors and with the majority of the membership comprised of Minors.
