Sec. 10-31. - Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Dog means any animal member of the canine family.

Dog license means the license required to be issued for each individual dog.

Licensed dog means any dog for which a current license has been issued and to which the tag indicating such license is attached.

Owner means any person in the city who owns, keeps or harbors a dog for 15 or more consecutive days. This shall not include any person who keeps or harbors a dog in the course of business as a veterinarian, kennel operator or shop owner.

The city council may establish minimum fines for the violation of section 10-3, 10-5, 10-41 or 10-42 by resolution.

Sec. 10-33. - Control generally.

Dogs shall, at all times, be kept under the immediate control and direction of a responsible person.

Sec. 10-34. - Number of dogs limited; applicability of section.

(a) No person shall own, keep or harbor three or more dogs over the age of four months; provided, however, that to the extent this section conflicts with the provisions of the city's zoning code, the zoning code shall be controlling.

(b) This section shall not apply to any person who owns, keeps or harbors such dogs in the course of business as a veterinarian, kennel operator or pet shop operator.

Sec. 10-35. - Disturbing the peace and quiet prohibited; evidence of violation.

(a) No person shall own or harbor a dog within the city in such a manner that the peace and quiet of the public is disturbed.

(b) The written affirmation by three persons having a separate residence indicating that the howling, barking or other noise issued by a dog disturbs the peace of such persons shall be prima facie evidence of a disturbance of the peace and quiet of the public. The destruction by a dog of property other than that which belongs to the owners of such dog shall be prima facie evidence of a disturbance of the peace and quiet of the public.

(a) No person shall keep or harbor a lost or strayed dog.

(b) Any person discovering or temporarily detaining a lost or strayed dog shall, within eight hours of such discovery or detention, notify the animal control authority or the police department. Upon demand by the animal control authority or a police officer, such person shall relinquish custody of such dog.

Sec. 10-37. - Harboring diseased dogs.

No person shall keep or harbor a dog afflicted with any contagious disease unless such dog is under the care and treatment of a veterinarian.

Sec. 10-38. - Dogs at large.

Any owner, custodian or keeper of a dog shall be in violation of this section if such dog is found at large or stray in the city. A dog is at large or stray whenever it is elsewhere than on the premises of the owner, custodian or keeper of such dog and is not restrained by a substantial leash, or the dog is on the premises of the owner, custodian or keeper but is unattended and is not restrained by an adequate fence.

Sec. 10-39. - Bites to be reported.

The owner or any person keeping or harboring a dog which bites a human being shall immediately notify the animal control authority or police department, giving the name and address of the person bitten and the location, date and time of occurrence.

Sec. 10-40. - Possession or ownership of a vicious dog declared unlawful.

(a) A dog is deemed to be vicious when the animal control authority or the police department receives, within a two-year period, two or more written affirmations by victims or witnesses of unprovoked attacks by such dog resulting in physical injury to a person or animal engaged in lawful behavior.

(b) Dogs held in violation of this section shall be deemed a public nuisance and the owner, custodian or keeper of a vicious dog shall, in the interest of public safety, be required to remove such dog from the city or, upon notice, relinquish the dog to the animal control authority for humane disposal after three working days to allow for legal restraining action by the owner. The animal control authority shall promptly investigate the report of a vicious dog attack and shall give notice to the owner, custodian or keeper of such dog as to the reported attack.

Sec. 10-41. - Committing nuisance.

(a) No person shall allow a dog in his custody to defecate or to urinate on public property or any improved private property other than that of the owner or person having control of the animal. It shall be the duty of all persons having control of a dog to curb such dog in order to carry out the intent of this section.

(b) Unsighted persons, while relying on a guide dog, shall be exempt from this section. If a violation of subsection (a) of this section occurs, such persons shall immediately remove any feces to a proper receptacle.

Sec. 10-42. - Female dogs in season.

Dog owners shall securely confine their female dogs while in season in such a manner that will prevent the attraction of male dogs to the immediate vicinity.
