C4-114. - Failure to disclose—Penalty.

C4-111. - Initial sale of single-family dwelling—Requirements.

Every subdivision approval for five or more single-family residential units shall propose the following condition of approval: The initial transferor of any of the single-family residences authorized herein shall furnish the potential or actual transferee, in addition to any other information required to be disclosed by law, a copy of the current City of San Ramon's Public School Facilities Report. C4-112. - Transfer of single-family dwelling—Requirements.

A. Every transferor of any single-family residence shall furnish the prospective or actual transferee, in addition to any other information required to be disclosed by law, a document containing the following statement or a similar statement approved by the planning services manager: NOTE It is possible that students residing on these premises will not be attending the nearest elementary, middle or high school. To determine the location of the school the resident student will be attending, contact the Administrative Offices of the San Ramon Valley Unified School District at 699 Old Orchard Drive, Danville. B. A copy of the statement referred to in subsection A of this section shall be included in the closing documents presented to the transferee for the sale of the residence. C4-113. - Public school facilities report.

A. The city's public school facilities report shall be prepared annually by the planning services manager as of March 31st of each year and be made available at cost for distribution by applicants for the land use permit. B. In addition to any other information deemed necessary by the planning services manager, the public school facilities report shall contain the following information pertaining to any elementary, middle and secondary public school to which the children residing in the subdivision are likely to attend: 1. Average distance to existing elementary, middle and secondary public schools from the center of the subdivision and the condition of the physical plant and grounds of such schools; 2. For schools not in existence but planned, the location and date scheduled for occupation; 3. If appropriate, a statement that the children residing in the subdivision may be required to go to elementary, middle or secondary schools other than those nearest in distance to their residence. C. Copies of the public school facilities report shall be made available for distribution to the public at the city offices. (Ord. 186 § 2, 1990: Ord. 151 § 2 (part), 1988: prior code § C13-321)

C4-114. - Failure to disclose—Penalty.

Failure of the transferor to furnish the transferee a copy of the current public school facilities report or the statement required by Section C4-112 of this chapter, prior to the close of escrow, shall constitute an infraction and be punishable as prescribed in this code. (Ord. 186 § 3, 1990: prior code § C13-322)
