1.04.010 - Title.

This code shall be known as the "San Rafael Municipal Code."

1.04.015 - Fees.

It is the policy of the San Rafael city council that all fees listed within this code shall be established by resolution of the city council.

1.04.020 - Authority.

This code consists of regulatory, penal and administrative ordinances of the city codified pursuant to the authority of the Charter of the city and the provisions of the Government Code of the state.

1.04.030 - Adoption of code.

That certain document, three copies of which are on file in the office of the city clerk, being marked and designated as the "Municipal Code, City of San Rafael" is hereby adopted by reference. Each and all of the provisions, terms and penalties of said code on file in the office of the city clerk are hereby referred to, adopted, incorporated herein and hereby made a part hereof as if fully set forth herein.

1.04.040 - Effect of code on past actions and obligations.

Neither the adoption of this code nor the repeal thereby of any ordinance of the city shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date of this code, nor be construed as a waiver of any license or penalty at the effective date due and unpaid under said ordinances, nor be construed as affecting any of the provisions of said ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof required to be posted, filed or deposited pursuant to any ordinance, and all rights and obligations thereunder appertaining shall continue in full force and effect.

1.04.050 - References to specific ordinances.

The provisions of this code shall not in any manner affect deposits or other matters of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise and which are included within this code, but such references shall be construed to apply to the corresponding provisions contained within this code.

1.04.060 - Severability.

If any title, chapter, section, subsection, sentence, clause or phrase of this code is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code, and the council of the city would have adopted this code and each title, chapter, section, subsection, sentence, clause and phrase hereof irrespective of the fact that any one or more titles, chapters, sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

1.04.070 - Effective date.

This code shall be in full force and effect from and after January 4, 1961.

1.04.080 - Repeal.

All ordinances or parts of ordinances in conflict with the provisions of this code and all general regulatory and administrative ordinances relating to such matters covered by this code are repealed.

All ordinances in effect upon the effective date of this code not in conflict with the provisions of this code, which are not included in this codification shall not be deemed to have been repealed, but shall be continued in full force and effect unimpaired by this code.
