15.11.00: DEFINITIONS:¶
For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
BICYCLE: Has the same meaning as in California Vehicle Code Section 231, as it may be amended from time to time.
ELECTRIC BICYCLE: Has the same meaning as in California Vehicle Code Section 312.5, as it may be amended from time to time.
ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICE: Has the same meaning as in California Vehicle Code Section 313, as it may be amended from time to time.
ELECTRICALLY MOTORIZED BOARDS: Has the same meaning as in California Vehicle Code Section 313.5, as it may be amended from time to time.
LOW SPEED VEHICLE: Has the same meaning as in California Vehicle Code Section 385.5, as it may be amended from time to time.
MOTORIZED SCOOTER: Has the same meaning as in California Vehicle Code Section 407.5, as it may be amended from time to time.
REGULATED MOBILITY DEVICE: means a Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, Shared mobility device, and any other similar vehicle.
SHARED MOBILITY DEVICE: Has the same meaning as in California Civil Code Section 2505, as it may be amended from time to time. Shared mobility device does not include any power-driven device designed primarily for use by an individual with a mobility disability for the main purpose of indoor, or of both indoor or outdoor movement.
VEHICLE: Has the same meaning as in California Vehicle Code Section 670, as it may be amended from time to time. (Ord. O-26-1424, 1-30-2026)
15.11.01: RIGHTS AND DUTIES OF BICYCLE RIDERS:¶
Except as hereinafter provided in this Article, every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the State Vehicle Code or by the City Code, except as to special regulations in this Article and those provisions of law and ordinance which, by their nature, can have no application. 15.11.02: PROHIBITED USES 2 :¶
A. Riding on Sidewalks: Unless otherwise expressly allowed by another provision of this title or other applicable law, no person shall use, operate, park or leave any Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, Shared mobility device, or Vehicle upon any sidewalk in a business district or adjacent to any place of public assembly.
B. Riding in Crosswalks: No person shall ride or operate a Regulated mobility device in or into any marked pedestrian crosswalk unless such person dismounts from the Regulated mobility device and proceeds on foot wheeling the bicycle, except for the purpose of riding across said crosswalk.
C. No person shall use, operate, park or leave any Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, Shared mobility device in a manner that endangers or is likely to endanger the safety of any person or property.
D. Notwithstanding any other provision of this Code, nothing is intended to apply or otherwise restrict a Regulated mobility device operated by any officer employed by the City while on duty, or as utilized in a safe manner by physically disabled persons as defined under the Americans with Disabilities Act (42 U.S.C. Section 12101 et seq.) (Ord. 977, 6-13-90; amd. Ord. O-26-1424, 1-30-2026)
15.11.03: REQUIREMENT TO OBEY TRAFFIC-CONTROL DEVICES:¶
Any person operating a Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, and Shared mobility device shall obey the instructions of official traffic-control signals, signs and other control devices applicable to vehicles unless otherwise directed by a police officer.
Whenever authorized signs are erected indicating that no right or left turn or U-turn is permitted, no person operating a Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, or Shared mobility device shall disobey the direction of any such sign, except where such person dismounts from the bicycle to make such turn, in which event, such person shall then obey the regulations applicable to pedestrians. 15.11.04: RIDING WITHIN COMMERCIAL ZONE RESTRICTED:¶
No person shall ride or operate a Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, or Shared mobility device on or across any street located within the C-1 Commercial Zones of this City, delineated on the official Zoning Map 1 , when such streets or parts thereof have been posted or marked by street paintings indicating the prohibition against bicycle riding. 15.11.05: PARKING RESTRICTION:¶
No person shall park or leave any Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, or Shared mobility device upon any street or alley, nor upon any sidewalk in any business district or adjacent to any place of public assembly in such manner as to obstruct or hinder the free passage of pedestrians or other vehicles or devices permitted to use the same. Any Bicycle, Electric bicycle, Electrically motorized boards, Low speed vehicle, Motorized scooter, or Shared mobility device found in violation of this Section may be impounded by the Police Department and returned to the owner under such reasonable conditions as may be established by the Police Chief. 15.11.06: EXCEPTIONS FROM REGULATIONS:¶
Devices designed, intended and used solely for the transportation of infants, invalids or incapacitated persons or devices designed, intended and used for the transportation of merchandise to or from the place of purchase and other wheeled devices when being used for either of said purposes shall be exempted from the regulations imposed by this Article.
The regulations specified in this Article shall not apply to a place of public assembly when it is not open or in use, nor shall they apply if the person in charge of such place of public assembly expressly waives the same. (Ord. 977, 6-13-90)
15.11.07: ENFORCEMENT:¶
A. A violation of this Article shall be punishable as a misdemeanor, infraction pursuant to SMMC section 01.04.02 or by issuance of an administrative citation pursuant to SMMC section 01.06.05.
B. In lieu of a fine or administrative citation as authorized by this code, and in lieu of filing charges in any court having jurisdiction over a violation, the Police Chief or designee may allow a violator of this chapter to complete a police department provided safety course for regulated mobility devices.
