16.04.01: PERMIT REQUIRED:

It shall be unlawful for any person to lay, construct, reconstruct or to repair in any street, alley, court or other public place in the City any curb, sidewalk or gutter without first obtaining a permit, in writing, from the Director of Public Works to do so. (1954 Code §19.31; 1994 Code)

16.04.02: APPLICATION FOR PERMIT:

Any person desiring a permit required by Section 16.04.01 of this Article to perform any work regulated hereby shall file a written application with the Director of Public Works showing the location, the amount of work to be performed and such other information as the Director of Public Works may require. 16.04.03: PERMIT FEES:

Before a permit required by Section 16.04.01 of this Article is issued, fees shall be deposited with the Director of Public Works for the work specified in such permit at the rate set by resolution of the City Council. (1954 Code §19.33; 1994 Code)

16.04.04: PERFORMING UNSPECIFIED WORK PROHIBITED:

It shall be unlawful to perform any or all of the work regulated by this Article in a greater amount or quantity than that specified by the permit required by Section 16.04.01 of this Article. (1954 Code §19.34)

16.04.05: LINES AND GRADES FOR SIDEWALKS, CURBS AND GUTTERS:

It shall be unlawful for any person to lay, construct, reconstruct or repair any curb, sidewalk or gutter in any public street, alley, court or other public place without first obtaining the lines and grades therefor from the City Engineer if so ordered by the Director of Public Works. 16.04.06: NOTICE OF COMMENCEMENT OF WORK:

It shall be unlawful for any person to commence to do any work regulated by this Article for which a permit has been issued unless such person has made application, in writing, to the Director of Public Works at least twenty four (24) hours before commencing such work for the inspection thereof. Such application shall specify the day and hour when the work shall be commenced. (1954 Code §19.37; 1994 Code)

16.04.07: SPECIFICATIONS FOR WORK; SUPERVISION AND INSPECTION; WAIVER OF INSPECTION:

All work regulated by this Article shall be done in accordance with specifications for such work adopted by the City Council and shall be done to the satisfaction of the Director of Public Works and under the supervision of the Director of Public Works or of an inspector appointed by him/her; provided, that the Director of Public Works may waive inspection during actual construction of less than thirty (30) lineal feet of curb or of less than one hundred (100) square feet of sidewalk or of less than thirty (30) lineal feet of gutter. 16.04.08: NOTICE OF COMPLETION OF WORK; CERTIFICATE:

Whenever any person has completed any work regulated by this Article, he/she shall so notify the Director of Public Works, in writing. If, after the Director of Public Works or his/her authorized representative has, by survey or inspection or both, found that the work has been completed in accordance with the provisions of this Article, he/she shall issue or cause to be issued a certificate of acceptance. 16.04.09: REMOVAL OF DEBRIS:

It shall be unlawful for any person performing or causing to be performed any work under the provisions of this Article to fail, refuse or neglect to remove or cause to be removed all materials and debris within three (3) days after the completion of such work; provided, that where new work is covered with earth, the terms of the specifications of the City regulating such work shall be followed 1 . 16.04.10: EXEMPTIONS FROM PROVISIONS:

The provisions of this Article shall not be construed to apply to the doing of any of the classes of work regulated by this Article under duly authorized contracts made by the property owners or under contracts made by the Director of Public Works in accordance with the provisions of the laws of the State providing for the improvement of streets and other public places in municipalities.
