9.12.010 - Established: Composition: Appointment of Members: Alternates.¶
There is hereby established the "San Marcos Parks and Recreation Youth Commission" (hereinafter called "Commission") consisting of an odd number of members, not less than five but not to exceed nine, as the City Council may from time to time establish by Resolution, and two alternate members. The members and alternate members shall be appointed by the Mayor with the approval of the City Council.

9.12.020 - Qualifications of Members.¶
Any legal resident of, and residing in, San Marcos who has completed the sixth grade, but has not yet attained the age of 21 years at the time of his appointment, shall be qualified for membership on the Commission. The Commission shall include at least one member who has not yet started high school at the time of their appointment. Persons who live outside the City's jurisdictional boundaries are eligible for appointment only if they reside within the jurisdictional boundaries of the San Marcos Unified School District, provided that they reside only in the unincorporated area and not within the jurisdictional boundaries of another municipality.

9.12.030 - Terms of Office of Members; Removal or Vacancy.¶
(a)
The term of each regular member of the Commission shall be for three years. Alternate members shall serve a term of one year, and shall be given priority to fill any open regular seats on the Commission as they become available. Each annual term shall commence on July 1 and shall end on June 30 of the following year. A member shall serve until the member's successor is appointed and qualifies. If a new office is created by Council resolution, the term of the member first appointed to the newly created office shall expire on June 30 of the year following appointment. The terms shall be staggered so that the terms of not more than four members will expire in any year.
(b)
Any member may be removed by a majority vote of the City Council.
(c)
A vacancy shall be filled in the same manner as an original appointment. A person named to fill a vacancy shall serve for the remainder of the unexpired term of said vacancy. If a member is absent for three consecutive regular meetings of the Commission, the office becomes vacant automatically. An absence if with cause shall not subject his office to vacancy if said absence is due to illness or is unavoidable. The Commission shall immediately notify the City Council of any vacancy due to non-attendance.

9.12.035 - Alternate Members.¶
The alternate members of the Commission shall be considered as a member of the Commission and may participate in all meetings of the Commission, but shall not be entitled to vote on any matter coming before the Commission except when a regular member of the Commission is absent for any reason from the meeting or the agenda item during which the vote is taken. The alternate members shall not be qualified to serve as an Officer of the Commission.

9.12.040 - Compensation of Members.¶
Each member of the Commission, including the Chairman, shall receive compensation as established by Resolution adopted by the City Council.

9.12.050 - Purpose of Commission.¶
The purpose of the Commission is to advise, coordinate, consult and collaborate with the San Marcos Parks and Recreation Department to:
(a)
Represent and promote the general welfare of the children and youth in the community;
(b)
Review existing community programs, events, projects, facilities, and policies that benefit the children and youth in the community (collectively, "programs"), propose plans to support or improve the existing programs, implement new programs, and elicit to interest and support of City departments/divisions, private agencies, and volunteer groups for the programs;
(c)
Study the needs of the children and youth in the community, identify areas of concern and make recommendations to the Parks and Recreation Department and/or the Parks and Recreation Commission for advancement to the City Council;
(d)
Coordinate with City departments/divisions to effectively and efficiently utilize City resources that benefit the children and youth in the community;
(e)
Research and advise on sources of governmental and private funding available for youth programs; and
(f)
Respond to requests for comment and recommendation on matters referred to the Commission by City officers, officials, departments/divisions, agencies, boards, commissions, and advisory committees.

9.12.060 - Bylaws.¶
To assist in the orderly conduct of business, the City Council shall approve bylaws governing the Commission. Any amendments to or repeal of the Commission bylaws must be recommended to the City Council by a two-thirds vote of the Commission, and must thereafter be approved at a regular meeting of the City Council by a majority vote of the Council.

Exhibit B San Marcos Parks and Recreation Youth Commission Bylaws
I.
Establishment. The San Marcos Parks and Recreation Youth Commission ("Commission") was established on April 23, 1974 pursuant to City Ordinance Number 74-290.
II.
Purpose. The purpose and function of the Commission is to advise, coordinate, consult and collaborate with the San Marcos Parks and Recreation Department to:
a.
Represent and promote the general welfare of the children and youth in the community;
b.
Review existing community programs, events, projects, facilities, and policies that benefit the children and youth in the community (collectively, "programs"), propose plans to support or improve the existing programs, implement new programs, and elicit the interest and support of City departments/divisions, private agencies, and volunteer groups for the programs;
c.
Study the needs of the children and youth in the community, identify areas of concern, and make recommendations to the Parks and Recreation Department and/or the Parks and Recreation Commission for advancement to the City Council;
d.

III.
Membership, Appointment. Requirements regarding membership and appointment of the Commission members shall be subject to the provisions of San Marcos Municipal Code Chapter 9.12.
IV.
Meetings.
a.
The Commission shall hold regular meetings on the first Monday of each month at 4:00 p.m. Any additional meeting(s) that may be necessary shall be held on the third Monday of the month at 4:00 p.m.
b.
The location of all Commission meetings shall be the San Marcos Civic Center Plaza, located at 1 Civic Center Drive, San Marcos, California 92069. The room location for each meeting shall be determined based on the business to be conducted for that meeting, as identified in the meeting's agenda.
V.
Election of Officers, Duties.
a.
Each year, the Commission shall elect a Chairman and Vice-Chairman at the first Commission meeting in July. The positions of Chairman and Vice-Chairman shall each serve a one-year term until the successor takes office.
b.
The Chairman shall preside over all meetings of the Commission, perform the duties necessary and incidental to his office, and appoint all committees subject to the approval of the Commission.
c.
The Vice-Chairman shall serve as Chairman of the Commission in the absence of or inability of the Chairman to act.
VI.
Rules and Regulations, Quorum, Required Vote to take Action.
a.
The Commission shall adopt rules and regulations for the conduct of its business.
b.
Three (3) members of the Commission shall constitute a quorum for the purpose of transacting business.
c.
The affirmative or negative vote of a majority of the entire membership of the Commission is required for the Commission to take any action.
VII.
City Staff to Assist Commission. The City Manager shall designate and appoint City staff to assist the Commission.
VIII.
Acceptance of Gifts and Grants. Subject to the prior approval of the City Council, the Commission may accept gifts and grants from any source to assist it in the performance of its functions.
IX.
Annual Report. The Commission shall prepare and present to the City Council an annual written report of its activities, goals and accomplishments by July 1 of each calendar year.
X.
Amendment of Bylaws. Any proposed amendments to or repeal of these Bylaws must be recommended to the City Council by a two- thirds (2/3) vote of the Commission, and must be approved at a regular meeting of the City Council by a majority vote of the Council.
