7.08.010 - Use or discharge restrictions.

It is unlawful to discharge, to use, sell, have, keep, store, shoot off, or explode, within the county, any firecrackers, sky rockets, torpedoes, Roman candles, fire balloons and any and all fireworks or substances designed or intended for pyrotechnic display, and all pistols, canes, cannons and other appliance using blank cartridges; save and except such of the above as may be sold under the provisions of the laws of the state and such other fireworks as are hereinafter provided. Public pyrotechnic displays and the use of fireworks for such purposes may be permitted at such times and places as the board of supervisors may direct or permit under the supervision of the county fire warden.

7.08.020 - Atascadero Fire District, county airports and Laguna Lake area restricted.

It is unlawful for any person to wilfully fire or discharge any gun, rifle, shotgun or pistol or other such firearm within the confines of the following areas without having first obtained permission in writing from the board of supervisors or its designated agent or from the sheriff:

(1) Atascadero fire district;

(2) County airports within the County of San Luis Obispo;

(3) Laguna Lake area, which area is more particularly described as follows:

Lots 51, 52, 53 and 54 of the Rancho La Laguna as shown on the map of the subdivisions of the Ranchos Canada de los Osos and La Laguna, on file in the office of the county recorder of said county, in Book A of Maps at page 83; said parcel being bounded on the southeast by the City of San Luis Obispo, on the southwest by Los Osos Valley Road, County Road No. 13028 (Old Road No. 29), on the northwest by Foothill Boulevard, County Road No. 13031 (Old Road No. 29), and on the northeast by the northeasterly boundary line of the aforementioned Lot 51.

7.08.030 - County property, flood control and water conservation district restricted.

It is unlawful, at anytime, to enter upon the lands owned by the county or the county flood control and water conservation district surrounding and including Lopez Reservoir and Terminal Reservoir, known as the same respectively, where signs forbidding hunting or trespassing are displayed at intervals of not less than three to the mile along all exterior boundaries and all roads entering such lands, for the purpose of shooting, hunting, taking, killing or destroying any animal or bird upon said lands or from said reservoir.

7.08.040 - Exception to Section 7.08.030.

Section 7.08.030 does not apply to any peace officer in the performance of his duty nor to any person when it is necessary for such person to protect life or property, or to destroy or kill any dangerous animal.

7.08.050 - Cambria fire protection district, Baywood Park and Los Osos restricted.

(a) Cambria Fire Protection District. Except as otherwise provided in this chapter, it is unlawful for any person, firm, or corporation wilfully to fire, discharge, or shoot, or cause or permit to be wilfully fired, discharged or shot within the confines of the area known as the Cambria fire protection district, County of San Luis Obispo, State of California, any gun, rifle, shotgun, revolver, pellet gun or firearm of any kind, including any arrow or similar missile, without having first received permission in writing from the board of supervisors or its designated agent, or from the sheriff.

(b) Baywood Park—Los Osos. Except as otherwise provided in this code, it is unlawful for any person wilfully to fire, discharge, or shoot any gun, rifle, shotgun, revolver, pellet gun, or firearm of any kind, or any bow and arrow or similar missile, within the confines of the South Bay Fire District as presently constituted or as altered by future annexation or in any of the area bounded by the westerly boundary of South Bay Fire District, the high tide mark of the southerly portion of Morro Bay, the southerly boundary of Morro Bay State Park, the high tide mark of the Pacific Ocean, and the northerly boundary of Montana de Oro State Park, without having first received permission in writing from the board of supervisors or its designated agent or from the county sheriff.

7.08.060 - Exception to Section 7.08.050.

Section 7.02.050 does not apply to any peace officer acting in his official line of duty nor to any person when it is necessary for such person to protect life or property, or to destroy or kill any predatory or dangerous animal.

7.08.070 - Target range exception.

Section 7.08.050 shall not prohibit the establishment or maintenance of any target range, nor prohibit the discharge at any target thereon of any of the weapons, missiles and objects referred to in Section 7.08.050, in the event that such range is so installed, constructed, safeguarded, equipped, and used as to adequately prevent any arrow, bullet, shot or missile from being projected beyond the confines of such range.
