15.610.010 - Delegation of Streets and Highways Code Section 942.5 powers to county road commissioner.

Pursuant to Streets and Highways Code Section 942.5, the powers set forth in Streets and Highways Code Section 942.5 to temporarily restrict the use or temporarily close county highways are delegated to the county road commissioner.

15.610.015 - Traffic defined.

"Traffic," as used in this chapter, includes pedestrians, ridden animals, vehicles, street cars and other conveyances, either singly or together.

15.610.020 - Notice to public of temporary restriction of use of or temporary closing of highway.

To notify the public that a county highway is temporarily closed or its use temporarily restricted pursuant to Streets and Highways Code Section 942.5 and 942.6, the county road commissioner shall do one or more of the following:

(1) Erect suitable barriers or obstructions upon such highway;

(2) Post warnings and notices of the condition of any such highway;

(3) Post sign for the direction of traffic upon it, or upon any other highway or detour open to public travel;

(4) Place warning devices on such highway;

(5) Assign a flagman to warn, detour, or direct traffic;

(6) Through the county sheriff, have a deputy sheriff assigned to warn, detour or direct traffic on such highway.

15.610.030 - Failure to observe sign, etc., an infraction.

Any person who wilfully fails to observe any barrier, obstruction, warning, notice, sign, device, detour, or direction, placed or given under Section 15.610.020, is guilty of an infraction as defined in California Penal Code Section 19(c), and subject to the penalty set forth in Chapter 1.04 of this code.

15.610.040 - Removal of use restriction or reopening of county highway.

After the need for the temporary restriction of the use of, or the temporary closing of, such highway, pursuant to this chapter, ceases to exist in the judgment of the county road commissioner, he shall remove such restriction, or reopen such county highway, as the case may be.

15.610.050 - Appeal.

Any person aggrieved by the action of the county road commissioner in temporarily restricting the use of or temporarily closing a county highway pursuant to this chapter, shall have the right of appeal to the board of supervisors. Such appeal shall be taken by filing with the clerk of the board, within fourteen days after such temporary county use restriction or closing, a written statement setting forth fully the grounds for the appeal. The clerk of the board shall set a time and place for a hearing on such appeal, and the notice of such hearing shall be given to the appellant at least five days prior to such hearing. The decision and order of the board on such appeal shall be final and conclusive.
