§ 6-5-200. PROHIBITIONS.

(a) It shall be unlawful for any person residing within this City to propel in any public street or place therein a bicycle which has not been registered as herein provided, or whose registration stamp has become illegible for any reason.

(b) It shall be unlawful for any person to buy or sell within this City, any second-hand bicycle which has not been registered as herein provided or whose registration stamp has become illegible for any reason.

(c) It shall be unlawful for any person engaged in the business of buying or selling second-hand bicycles within this City to have in his or her possession any second-hand bicycle which has not been registered as herein provided, or whose registration stamp has become illegible for any reason.

(d) It shall be unlawful for the parent of any child or the guardian of any ward knowingly to permit such child or ward to violate any of the provisions of this Article.

(e) It shall be unlawful for any person wilfully to obliterate or alter the registration stamp on any bicycle.

§ 6-5-205. IMPOUNDING.

The Police Chief is hereby authorized to impound and retain any bicycle held or operated in violation of any provisions of this Article until its owner properly registers it.

§ 6-5-210. RECORDS—DEALERS.

Every person engaged in the business of buying and selling new or used bicycles or bicycle parts in this City shall prepare at the time of purchase and keep a record of all such bicycles or bicycle parts purchased by him. Such record shall include a description of the bicycle or bicycle part purchased, the date of purchase, and the name and address of the person, firm, or corporation from whom purchased. Such record shall be open to the inspection of any police officer of this City.

§ 6-5-215. BICYCLE RIDING RESTRICTIONS.

(a) It shall be unlawful to ride a bicycle upon any sidewalk, except for juveniles 12 years of age, or under, exercising due care and giving all pedestrians the right-of-way. Juveniles of the above mentioned age may ride and operate their bicycles upon the sidewalks, in residential areas, except such sidewalks as are in front of schools, stores, or buildings used for business purposes. The rider of a bicycle upon a roadway shall ride as nearly as practicable within five feet (5') from the right hand curb or edge of the roadway, except when passing a standing or other vehicle, or making a left turn at an intersection.

(b) It shall be unlawful for pedestrians or bicyclists to use that portion of Washington Avenue roadway beneath the Western Pacific Railroad tracks.

(c) Nothing in this section prohibits the operation or a bicycle on any street, sidewalk, path or other public property by a San Leandro police officer while engaged in the performance of his/her duties.

§ 6-5-220. BICYCLE LANES.

The City Council may by resolution establish bicycle lanes separated from any vehicular lanes upon certain streets or portions thereof, regulate the operation and use of bicycles and vehicles with respect to such bicycle lanes and direct the placement of signs or pavement markings or both designating such bicycle lanes and regulations. When such signs or pavement markings are in place, no person shall operate or use a bicycle or vehicle contrary to the provisions thereof.
