§ 4-3.01. Written consent: Required.

It shall be unlawful for any person to operate any cycle, motor-driven cycle, minibike, trail bike, motor scooter, jeep, dune buggy, or other motor vehicle on any real property owned or occupied by another person without the written consent of all the owners and occupants of such property, unless the owners of the property have posted the property permitting such use.

§ 4-3.02. Written consent: Required: Exceptions.

The provisions of Section 4-3.01 of this chapter shall not apply to the following:

(a) Public officers and employees acting within the course and scope of their employment;

(b) The operation of vehicles and cycles having valid vehicle registration issued by the State upon public streets and highways by persons possessing valid operators’ licenses issued by the State; and

(c) The operation of such vehicles on driveways, parking lots, race courses, or other places where the public is invited to operate such vehicles so long as such vehicles are operated in the reasonable and ordinary manner customary for such use.

§ 4-3.03. Disturbing the peace.

It shall be unlawful for any person to operate any cycle, motor-driven cycle, minibike, trail bike, motor scooter, jeep, dune buggy, or other motor vehicle in such a manner as is reasonably likely to disturb the peace or quiet of any neighborhood or person by reason of noise, dust, smoke, or fumes.

§ 4-3.04. Mission Village Shopping Center.

The Council hereby finds and determines that there are certain private roads and parking areas within the City which are open to the public and frequently and regularly used to serve commercial establishments and that the public health, safety, and welfare require such private roads and parking areas to be subject to reasonable public regulation and controls.

Pursuant to Section 21107.8 of the Vehicle Code of the State, the off-street private parking areas and privately-owned streets located within the Mission Village Shopping Center, as depicted in Exhibit A, attached to Ordinance No. 263, adopted May 13, 1974, a copy of which is on file in the office of the City Clerk, are hereby found to be open to the public and are hereby declared to be subject to traffic regulation by the County Sheriff, or such other law enforcement agency as may be designated by the Council, and to subsections (a) and (b) of Section 21107.8 and Sections 22350, 25103, and 23109 of the Vehicle Code of the State.
