3.08.010 Authority for chapter provisions. ¶
The provisions of this Chapter 3.08, Unclassified Civil Service, are adopted pursuant to the provisions of subsection 1101(a) of the Charter of the City of San José.

3.08.020 Applicability. ¶
The provisions of this Chapter 3.08, Unclassified Civil Service, shall apply to all officers and positions of employment in the civil service of the city excepting those within the classified service as such classified service is defined in subsection (b) of Section 1101 of the Charter of the city, and excepting those mentioned in paragraphs (1), (2), (3) and (7) of subsection (a) of Section 1101 of such Charter.

3.08.030 Definitions. ¶
For the purpose of this chapter:
A. "Limited appointment" means the appointment of an individual to an unclassified position under the provisions of paragraphs (4) and (5) of subsection 1101(a) of the Charter of the city. The duration of each such appointment shall not exceed six months unless an extension is approved by the civil service commission.
B. "Provisional appointment" means the appointment of an individual as an employee to fill a position temporarily in the classified service when no eligible list of applicants for such position exists, until

- such time as an appropriate eligible list is established and a person can be hired therefrom to fill such position. Provisional appointments are made under the provisions of paragraph (6), subsection 1101(a) of the Charter of the city. To be provisionally appointed to a position, an employee must meet the minimum qualifications for the class to which the position is allocated.
