16.20.010 Requirements for independent contractors. ¶
A. Each and every independent contractor who performs work in a key employee position, a gambling enterprise employee position, or a non-gambling enterprise employee position who is subject to work registration, shall be subject to all the provisions of this title that apply to employees of a cardroom permittee.
B. Each and every independent contractor who performs work for a funding source at a cardroom premises shall be subject to all the provisions of this title that apply to funded players and funding source employees.

16.20.020 Outsourcing restrictions. ¶
A. A Cardroom Permittee shall only use persons who are employees to perform work related to its Gaming Operation or to supervise Employees performing functions in its cashiers' cage, compliance, finance, information technology, security, surveillance, and table operations departments including dealers, floor persons, game attendants and chip runners. These services shall not be performed by consultants, independent contractors or other third-persons.
B. Notwithstanding Subsection A, upon receipt of a written request of a Cardroom Permittee, supported by a job compendium with pro-
- posed compensation or fees and other documentation requested by the Administrator, the Administrator shall allow a natural person who is otherwise qualified who wishes to work for a Cardroom Permittee as an Independent Contractor in a position identified in Subsection A to apply for and hold such a position as an Independent Contractor rather than as an Employee upon a finding by the Administrator that granting such an exception is consistent with the efficient administration of the Division, the public interest, and the policies and requirements of this Title.
C. Notwithstanding Subsection A, the Administrator, in the exercise of his or her discretion, may allow other exceptions to the restrictions in Subsection A upon a finding that granting such an exception is consistent with the efficient administration of the Division, the policies and requirements of this Title, and the public interest.
D. Any exception granted by the Administrator pursuant to Subsections B and C shall be expressly conditioned upon the Independent Contractor holding a valid City issued Key Employee License, work permit or work registration as appropriate.
