5-1401 - PURPOSE AND ESTABLISHMENT.¶
The San Joaquin County Children and Families Commission is hereby established under the California Children and Families Act of 1998, as an agency of the County with independent authority over the County Strategic Plan and the San Joaquin County Children and Families Trust Fund. Except for such independent authority, the Commission shall act as a County department under the supervision of the Board of Supervisors.

5-1402 - DEFINITIONS.¶
(a) "Act" means the California Children and Families Act of 1998.
(b) "County Commission" means the County Children and Families Commission.
(c) "County Strategic Plan" means the plan adopted by the County Children and Families Commission and submitted to the California Children and Families Commission pursuant to Section 131040 of the Health and Safety Code.
(d) "Guidelines" means Guidelines adopted by the State Commission in accordance with the Act.
(e) "State Commission" means the California Children and Families Commission established in accordance with Section 130110 of the Health and Safety Code.

5-1403 - COMMISSION MEMBERSHIP.¶
The Board of Supervisors shall appoint the Commission of nine (9) members as follows:
(a) One (1) member of the Board of Supervisors;
(b) The County Public Health Director;
(c) The County Director of the Human Services Agency; and
(d) Six (6) members of which each Board member shall nominate one (1) Commission member and the Chair shall nominate the sixth Commission member. These six (6) Commission members shall be appointed from among the following:
(1) Recipients of project services included in the County Strategic Plan,
(2) Educators specializing in early childhood development,
(3) Representatives of a local child care resource or referral agency or a local child care coordinating group,
(4) Representatives of a local organization for prevention or early intervention for families at risk,
(5) Representatives of community-based organizations that have the goal of promoting, nurturing, and early childhood development,
(6) Representative of local school districts,
(7) Representatives of local medical, pediatric or obstetric associations or societies, and
(8) The County Health Officer and persons responsible for management of the following County functions: children's services, public health services, behavioral health services, social services, and tobacco and other substance abuse prevention and treatment services.

5-1404 - COMMISSION TERMS AND EXPENSES.¶
The members of the County Commission shall serve at the pleasure of the Board of Supervisors. Members, except for the member of the Board of Supervisors, the County Public Health Director, and the County Director of the Human Services Agency, shall be appointed to four (4) year terms. The terms of the original members, except the member of the Board of Supervisors, the County Public Health Director, and the Director of the Human Services Agency, shall be staggered by lot. Three (3) members shall serve two (2) year terms. Three (3) members shall serve four (4) year terms. Members of the County Commission shall not be compensated for their services, except that they shall be reimbursed for reasonable expenses for attending meetings and discharging other official responsibilities as authorized by the County Commission provided the expenses meet the County's travel policy including, but not limited to, travel policy approval requirements.

5-1405 - MEETINGS AND BYLAWS.¶
The Commission shall meet and elect officers as set forth in its bylaws. The Commission shall prepare bylaws which shall not become effective or amended until approved by the Board of Supervisors.

5-1406 - STRATEGIC PLAN.¶
The County Commission shall adopt an adequate and complete County Strategic Plan for the support and improvement of early childhood development within the County.
(a) The County Strategic Plan shall be consistent with, and in furtherance of the purposes of this Act and any guidelines adopted by the State Commission pursuant to subdivision (b) of Section 130125 of the Health and Safety Code that are in effect at the time the Plan is adopted.
(b) The County Strategic Plan shall, at a minimum, include the following: a description of the goals and objectives proposed to be attained; a description of the programs, services, and projects proposed to be provided, sponsored, or facilitated; and a description of how measurable outcomes of such programs, services, and projects will be determined by the County Commission using appropriate reliable indicators. The County Strategic Plan shall not be deemed adequate or complete until and unless the Plan describes how programs, services, and projects relating to early childhood development within the County will be integrated into a consumer-oriented and easily accessible system.
(c) The County Commission shall, on at least an annual basis, periodically review its County Strategic Plan and revise the Plan as may be necessary or appropriate.
(d) The County Commission shall conduct at least one (1) public hearing on its proposed County Strategic Plan before the Plan is adopted.
(e) The County Commission shall conduct at least one (1) public hearing on its periodic review of the County Strategic Plan before any revisions to the Plan are adopted.
(f) The County Commission shall submit the County Strategic Plan to the Board of Supervisors for information prior to submitting the Plan to the State Commission.
(g) The County Commission shall submit its adopted County Strategic Plan, and any subsequent revisions thereto, to the State Commission.
(h) The County Commission shall prepare and adopt an annual audit and report pursuant to Section 130150 of the Health and Safety Code. The County Commission shall conduct at least one (1) public hearing prior to adopting any annual audit and report.
(i) The County Commission shall conduct at least one (1) public hearing on each annual report by the State Commission prepared pursuant to subdivision (b) of Section 130150 of the Health and Safety Code.

5-1407 - ADVISORY COMMITTEE.¶
The County Commission shall establish one (1) or more advisory committees to provide technical and professional expertise and support for any purposes that will be beneficial in accomplishing the purposes of this Act. Each advisory committee shall meet and shall make recommendations and reports as deemed necessary or appropriate.

5-1408 - COUNTY STAFF.¶
The County Administrator or the County Administrator's designee shall act as staff to the County Commission. The County shall be reimbursed from the San Joaquin County Children and Families Trust Fund for the County's actual expenses in an amount not to exceed the amount set forth in the County Strategic Plan adopted by the County Commission.

5-1409 - SAN JOAQUIN COUNTY CHILDREN AND FAMILIES TRUST FUND.¶
The San Joaquin County Children and Families Commission Trust Fund is hereby created and established in the San Joaquin County Treasury. Moneys deposited in this Trust Fund and accrued interest shall be expended for the purposes in the Act, this chapter establishing the County Commission, and in accordance with the Guidelines and the County Strategic Plan. The independent authority of the County Commission over the Trust Fund shall extend to the allocation of the Trust Fund moneys to programs within the Strategic Plan but shall not extend to other powers over the fund, including but not limited to the power to invest the Trust Fund moneys and the power to enter into contracts to allocate the Trust Fund moneys.
