§ 5.58.010. Disorderly or intoxicated persons.

No owner, manager, proprietor or other person in charge of any commercial uses with machines and games of skill shall allow or permit any intoxicated, quarreling or disorderly persons to be or remain in such place.

§ 5.58.020. Gambling prohibited.

A person shall not bet on the outcome of a game with money, checks, credits or things of value.

§ 5.58.030. Location within building.

The machines should be grouped in a singular location within the building in an area where there is unobstructed visual access by the management and the patrons of the establishment. Due to noise considerations they should be placed where disturbance caused by the operation would be at a minimum. To insure the arcade machines do not become the primary reason for entering the business, they should be located away from the main building entrance to the interior of the floor plan for integration within the use. Access to the game area shall not be through a separate outside entrance other than the main entrance of the primary use.

§ 5.58.040. Spatial requirements for machine placement.

Adequate interior clear space shall be provided for safe and convenient patron circulation and shall meet the following minimum standards:

A. Arcade machines shall be located no closer than twelve feet from any wall;

B. Provide a minimum of sixty inches between arcade machines and any entrance or exit;

C. Where arcade machines are located along one side of an aisle, provide a minimum unobstructed aisle width of sixty-six inches. Where arcade machines are located along both sides of any aisle, provide a minimum unobstructed aisle width of ninety inches;

D. Additional interior clear space may be required by the building official, fire department or sheriff's department in order to maintain public safety.

§ 5.58.050. Floor space ratio.

Where there are seven or more arcade games, they shall be limited to a maximum of twenty-five square feet of floor area per machine except that the spatial requirements prevail if a conflict occurs in determining the maximum number of permitted machines.

§ 5.58.060. Signage.

A. There shall be no signs advertising the accessory game arcade on either the exterior of the building or in the window area(s).

B. Signs shall be posted on the inside of the building with letters at least two inches high stating that there shall be no consumption of alcoholic beverages, or drugs, no gambling and no smoking by persons under the age of eighteen. The signs shall be posted in a prominent location.
