§ 12.04.010. Property owner—Duty.

When any sidewalk, driveway entrance or curb constructed on any highway is out of repair or in need of reconstruction, or in a condition to endanger persons passing thereon or to interfere with public convenience in the use thereof, the owner or other person in charge of or in control of the property abutting upon such sidewalk, driveway entrance or curb shall repair or reconstruct the same.

§ 12.04.020. Notice to repair—When given.

When any sidewalk, driveway entrance or curb constructed on any highway is out of repair or in need of reconstruction, or in a condition to endanger persons passing thereon, and when the director of public works shall have actual knowledge of such fact, he shall cause notice to be given to the owner or other person in charge of or in control of the property abutting upon such sidewalk, driveway entrance or curb to repair or reconstruct such sidewalk, driveway entrance or curb.

§ 12.04.030. Notice to repair—Contents.

The notice required by this chapter shall specify the manner of the repair or reconstruction and the materials to be used in such work, and shall state that if such owner or other person fails to repair or reconstruct such sidewalk, driveway entrance or curb as required, within five days thereafter, such work will be done by the city at the expense of such owner or other person, and that such owner or other person will be prosecuted by such failure as provided for by this code.

§ 12.04.040. Notice to repair—Service.

Notice to repair given pursuant to this chapter shall be served in the manner provided by law for the service of summons in a civil action, if such owner or other person can be found in the city. If such owner or other person cannot be so found, then such notice shall be served by delivering the same to the person in possession of such property if such property is occupied, or if unoccupied, by posting the same upon the property.

§ 12.04.050. Notice to repair—Performance of work by city.

If such owner or other person receiving a notice given pursuant to this chapter fails to repair or reconstruct such sidewalk, driveway entrance or curb, within five days after the giving of such notice, the director of public works shall repair or reconstruct such sidewalk, driveway entrance or curb out of any funds which may be available for such purpose, and the expenses thereof shall be a charge against such owner or other person to be recovered by action in the name of the city.

§ 12.04.060. Property owner—Liability.

Every owner or other person in charge or in control of any property abutting upon any sidewalk, driveway entrance or curb constructed upon any highway, who fails to repair or reconstruct the sidewalk or driveway entrance or curb when the same is out of repair or in need of reconstruction or in a condition to endanger persons passing thereon, is guilty of a violation of this code.
