§ 5.84.010. Permit—Identification card.

No person shall engage in the activity of soliciting unless such person has a valid permit to do so, issued by the city in accordance with the terms and provisions of Chapters 5.28, 5.32, 5.36 and 5.68, and such person has upon his or her person or with him or her an identification card showing the existence of such a valid permit. No person engaged in the activity of solicitation within the city shall fail or refuse to display or show such identification card upon demand for the display of the same by any police officer or by any person being solicited by such solicitor.

§ 5.84.020. Charitable solicitations—Permit—Application.

A. For the purposes of this section, "charitable solicitation" means the request, directly or indirectly, of money, credit property, financial assistance or other things of value on the plea or representation that such money, credit, property, financial assistance or other thing of value will be used for a charitable purpose. "Charitable" means and includes the words patriotic, philanthropic, social service, welfare, benevolent, educational, civic and fraternal, either actual or purported.

B. No license or license fee under this title shall be required for charitable solicitations. Each person making charitable solicitations within the city shall have a permit to do so, which shall be issued by the city clerk free of charge or fee, in his or her discretion, if he or she determines that the solicitations are for charitable purposes. Before any charitable association or organization or person commences any charitable solicitation within the city, such association or organization or person shall file an application with the city clerk stating the name and address of the organization, the name and address of the solicitors, if known, or otherwise how the solicitors are to be ascertained or acquired, the purpose of the charitable solicitation, and the days and places where the solicitation will be.

C. Where the application is made by an individual charitable solicitor for another organization, the individual shall present a letter of authority from such charitable organization authorizing such charitable solicitation and such other evidence as required by the city clerk.

D. Upon completion of such solicitation, such solicitor or organization shall file a complete sworn or certified statement, made under penalty of perjury, setting forth the amount of money collected and the final disbursement of such funds.

E. The provisions of this section shall not apply to any established person or organization organized and operated exclusively for charitable purposes and not operated for the pecuniary profit of any person, if the solicitation by such established person or organization is conducted among the members thereof by other members or officers thereof, voluntarily and without remuneration from making such solicitation, or if the solicitations are in the form of collections or contributions at regular assemblies or services of such established person or organization.

§ 5.84.030. Insurance agents and brokers.

Notwithstanding any other provision of this title to the contrary, an insurance agent or broker licensed by the state shall be entitled to the issuance of a solicitor's permit by the city clerk without further hearing or payment of fee, upon the showing of a duly existing state insurance agent or broker's license.

No person shall solicit in any manner for any purpose in any city or county buildings.
