§ 18.04.010. Short title.

The ordinance codified in this title may be referred to for all purposes as the San Dimas zoning ordinance.

§ 18.04.020. Preamble.

It is declared that in the creation of this title of the respective zones set forth in this title, the city council has given due and special consideration to the peculiar suitability of each and every such zone created for the particular uses enumerated therefor, the area requirements, density of land occupancy and the necessary, proper and comprehensive groupings and arrangements of the various industries, businesses and population of the city and in relation with established plans in the adjoining areas of the city in accordance with a well-considered plan of land use for the development of the entire city.

§ 18.04.030. Provisions to be construed as minimal requirements.

In interpreting and applying the provisions of this title, they shall be held to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare.

§ 18.04.040. Effect on other ordinances.

The provisions of this title shall not be deemed or construed to repeal, amend, modify, alter or change any other ordinance or any part thereof not specifically repealed, amended, modified, altered or changed in the ordinance codified in this title, except in such particulars or matters as this ordinance is more restrictive than such other ordinances or part thereof; and that in all particulars

wherein this title is not more restrictive, each such other ordinance shall continue and shall be in full force and effect.

§ 18.04.050. Exercise of powers granted by title.

Whenever a power is granted to, or a duty imposed upon, a public officer by this title, the power may be exercised or the duty may be performed by the commission, a deputy of the chairperson, or a person authorized pursuant to law or ordinance by the commission, unless this title expressly provides otherwise.

§ 18.04.060. Delegation of powers.

Whenever by ordinance an administrative power is granted to, or an administrative duty imposed upon the commission, the commission may instruct the chairperson to exercise such administrative power or perform such administrative duty. The chairperson shall exercise all such powers, and perform all such duties as he is instructed to do by the commission. (Ord. 37 § 106, 1961)

§ 18.04.070. Reference includes amendments and additions.

Whenever reference is made to any portion of this title or of any other law or ordinance, the reference applies to all amendments and additions now or hereafter made. (Ord. 37 § 107, 1961)

§ 18.04.080. Grammatical interpretation.

  • A. The present tense includes the past and future tenses, and the future the present.

  • B. The masculine gender includes the feminine and neuter.

  • C. The singular number includes the plural, and the plural the singular.

  • D. "May" is permissive.

  • E. "Shall" is mandatory. (Ord. 37 §§ 108, 109, 110, 1961)

§ 18.04.090. Severability.

If any provisions of this title, or the application thereof to any person or circumstance is held invalid, the remainder of the title, and the application of such provision to other persons or circumstances, shall not be affected thereby.

§ 18.04.100. Violation—Penalty.

Every person violating any provision of this title or of any permit, license or exception granted under this title, is guilty of a misdemeanor or infraction and is punishable as provided in Chapter 1.12 .
