SEC. 84.600. PURPOSE AND INTENT.

The Board of Supervisors finds that sex offenders remain a constant threat to the safety of our children and our communities. The existing, but informal, San Diego Sex Offender Management Council ("SOMC") represents a united San Diego region working collaboratively under a memorandum of agreement to educate community partners and stakeholders on sex offender issues, develop, support and participate in programs targeting the prevention, intervention and elimination of sexual violence, and serve as a crucial resource to the Board of Supervisors and other local municipalities on sex offender issues in the region. One of the main objectives of the SOMC is continuing education and outreach into our schools and communities regarding sex offender prevention, warning signs, issues, and policies. Formalization of the SOMC by ordinance will facilitate seeking grants to enable further outreach and partnering with key community and treatment partners, and continue the County's relentless advocacy for public safety and prevention against sex offenders in the County.

SEC. 84.601. SAN DIEGO SEX OFFENDER MANAGEMENT COUNCIL ESTABLISHED.

There is established by the Board of Supervisors of the County of San Diego the San Diego Sex Offender Management Council ("Council").

SEC. 84.602. MEMBERSHIP.

(a) The Council shall consist of 16 voting members and a non-voting Executive Director.

(1) Members Appointed by the Board of Supervisors. The Board of Supervisors shall appoint an Executive Director who shall be responsible for the coordination and administration of the Council. The Executive Director shall be a person who meets all the membership requirements and not currently serving as a Council member as a representative of any of the organizations otherwise represented on the Council. The Executive Director shall not be a voting member of the Council. The Board of Supervisors shall also appoint four voting members as follows:

(A) One forensic polygraph assessment representative;

(B) One professional victim advocate representative; and

(C) Two licensed treatment providers currently providing treatment.

(2) Members Appointed By Organizations. Each of the following organizations shall appoint one voting member:

(A) San Diego Public Defender

(B) San Diego District Attorney

(C) San Diego City Attorney

(D) San Diego County Probation/Adult

(E) San Diego County Probation/ Juvenile

(F) San Diego Sheriff

(G) San Diego Police Department

(H) San Diego SAFE Task Force

(I) California Department of Corrections and Rehabilitation/Adult Supervision

(J) San Diego County Conditional Release Program [CONREP]

(K) California Department of Mental Health Conditional Release Program

(L) United States Probation Office, Southern District of California

(b) Membership Qualifications. All persons appointed to the Council shall (1) be a resident of the County of San Diego, (2) demonstrate an interest in and knowledge of issues relating to sexual offending, and (3) possess professional experience in the investigation, prosecution, supervision, treatment and/or management of sexual offenders within the criminal justice and/or mental health system.

(c) Term of Membership. Each member shall serve a term of two years beginning January 1 of the appointment year. The member's term shall expire on December 31 of the expiration year. Any member appointed by an organization other than the Board of Supervisors whose term has expired shall continue to discharge his or her duties as a member until his or her successor has been appointed. The Executive Director shall serve a term of three years beginning January 1 of the appointment year.

(d) Compensation. Members of the Council shall serve without compensation and shall not be reimbursed for expenses. The Executive Director shall serve without compensation except as provided through grant or private funding, if approved by the Board of Supervisors.

SEC. 84.603. DUTIES.

The Council shall have the following duties and responsibilities:

(a) To serve as a resource to the Board of Supervisors and County or local municipalities on sexual offending issues in the region.

(b) To coordinate efforts and hear presentations from community partners and stakeholders regarding programs aimed at ending sexual offending.

(c) To maintain the Containment Model approach to the supervision and management of known sexual offenders within their own agencies and between Council members.

(d) To diminish sexual offending through community education, in coordination with local law enforcement efforts.

(e) To develop, support and/or participate in programs targeting the prevention, intervention and elimination of sexual violence in the region.

(f) To identify and research grants from all levels of government and private sources for carrying out the functions of the Council.

(g) To serve as liaison to the California Sex Offender Management Board.

(h) To network with other jurisdictions on sexual offending related issues.

(i) To hold a minimum of 10 meetings per year.

(j) To conduct other duties and functions as assigned by the Board of Supervisors.
