SEC. 360. [ARTICLE TO CONTAIN FEES AND CHARGES.]

It is desirable to have fees and charges collected in one location. This Article shall contain such fees and charges.

SEC. 360.1. FEE WAIVERS

The Board of Supervisors may by resolution waive any fee adopted by ordinance and contained in the San Diego County Code of Administrative Ordinances or the San Diego County Code of Regulatory Ordinances.

SEC. 362. LAND DEVELOPMENT FEES AND DEPOSITS.

(a) FEES AND DEPOSITS

The fees, deposits and hourly rate charges that pertain to land development permits and approvals from the Departments of Planning & Development Services, Public Works, Parks and Recreation and San Diego County Fire Authority are located in the following Administrative Code sections:

General Services - Section 362.4

San Diego County Fire Authority - Section 362.5

(b) PROVISIONS

This section contains provisions for the fees, deposits and labor charges that are common to the Departments of Planning & Development Services, Public Works, and Parks and Recreation; and that pertain to land development.

  1. STANDARD HOURLY RATES. All fees, deposits and labor charges shall be calculated and will be charged using the standard hourly rates set forth in Sections 362.1, 362.2, and 362.3 or as are otherwise approved by the Board of Supervisors. County personnel may bill at a Board of Supervisors approved rate to any fee or deposit account established for a project, whether or not the personnel work for the department managing the account.

  2. FEES AND DEPOSITS. All fees and deposits shall be paid in the amounts set forth in subsection (a) of Sections 362.1, 362.2, and 362.3.

  3. PRE-APPLICATION DEPOSITS. Upon request, pre-application review of projects may be requested by an applicant to identify any significant issues or concerns that the applicant may want to consider before filing a formal application. The deposit collected is intended to cover County costs for the review and pre-application meeting with the applicant. Pre-application consultation shall be mandatory for all privately initiated projects under the jurisdiction of the Planning Commission or Board of Supervisors, unless waived by the processing department.

  4. INTAKE DEPOSIT. An initial intake deposit shall be paid at the time of application submittal. The intake deposit shall be collected to recover actual costs related to project intake, preliminary case review, site/field visit, and all costs related to initial project analysis.

  5. ESTIMATED DEPOSIT. Upon completion of initial project analysis, the applicant and project manager will discuss the scope of the project and calculate an estimated deposit(s). The estimated deposit(s) shall be calculated based on factors identified during the initial project analysis, established processing time standards, standard hourly rates and key milestones.

Estimated deposits shall be paid in advance of services performed. Estimated deposits are collected to recover actual project processing costs by key milestones and shall be paid prior to the completion of said milestones. The County may discontinue processing the requested permit and/or recommend denial of the project based on the applicant's refusal to pay the estimated deposit and all actual processing costs that may not have been included in the estimate.

  1. SUBSEQUENT DEPOSITS. Unanticipated factors arising during project processing, such as, but not limited to, complexity, controversy or environmental issues which require additional project review will be conveyed to the applicant as soon as they are known. If it is determined that the deposit is insufficient to recover actual costs, the project manager will scope the work remaining on the project and calculate an additional subsequent deposit. The County may discontinue processing the requested permit and/or recommend denial of the project based on the applicant's refusal to pay the estimated deposit and all actual processing costs that may not have been included in the estimate.

  2. REFUNDS. The County shall not authorize the refund of any fee paid except upon receipt of a written request by the original applicant, received not later than one year after the date of fee payment. Where a refund of a fee is requested, the amount shall be based upon work completed on standard project tasks and milestones by case type. Fee refunds of $25,000 or more must be approved by the Board of Supervisors prior to payment. Fees which are erroneously collected may be refunded without Board of Supervisors approval, regardless of amount and without the requirement that an application be submitted for the refund. Except for fees that are erroneously collected, no part of any issuance fee collected pursuant to Division 1 of Title 7 of the County Code shall be refunded.

At the completion of all tasks associated with an application for which a deposit is required and after all final documents and review are completed, the difference between the deposited amount and the actual cost shall be refunded to the applicant within 180 days.

An applicant who has paid the applicable application fee(s) and deposit(s) may withdraw the application by submitting a written request to the County. The County shall discontinue work on such application within one working day from the receipt of said request, except that the County may continue to process an application involving the violation of a County ordinance. Any unused fee(s) and deposit(s) remaining upon the withdrawal of the application shall be refunded in accordance with this section.

Final permits, documents and approvals shall not be issued until all fees and deposits are paid in full.

Notwithstanding any other provision of this section, when the applicant is owed a refund but is in deficit on a separate deposit account(s) at any County department within the Land Use and Environment Group Community Service Agency Fund, the refund may be applied by the County to the deposit account(s) in deficit as an offset, unless a different disposition of the refund is required by state law.

  1. VIOLATIONS. When a violation of any County ordinance includes or results from the failure to obtain a required permit, the following requirements shall apply:

Administrative Permits: The standard fee or deposit for obtaining the permit required to correct the violation shall be collected. A violation fee in the amount of $500 shall also be collected.

All other deposit cases subject to a violation fee (as indicated by a V): The standard deposit for obtaining the permit required to correct the violation shall be collected. A violation fee shall also be collected in the amount of the standard deposit, not to exceed $1,000.

All other fee cases subject to a violation fee (as indicated by a V): The standard fee for obtaining the permit required to correct the violation shall be collected. A violation fee shall also be collected in the amount of the same standard fee amount, not to exceed $1,000.

In all cases the additional violation fee amount shall be treated as a non-refundable fee, even if the initial amount is a deposit.

  1. CHARGES FOR TECHNICAL REPORTS: Information, circulars, reports of technical work, and other reports prepared by the County, when supplied to other government agencies, individuals or groups requesting copies of same, may be charged for by the County in a sum not to exceed the cost of publication and distribution of such documents.

  2. FEE WAIVER FOR STRUCTURES DAMAGED OR DESTROYED BY NATURAL DISASTER. Notwithstanding the fees and deposits otherwise specified, the fees or deposits may be waived for an applicant who is rebuilding legally built structures which have been damaged or destroyed by a wildfire or other natural disaster and which are located within the boundaries of a geographic area which has been declared by resolution of the Board of Supervisors to be eligible for this fee or deposit waiver. The fee or deposit waiver shall not apply to any portion of a new structure which exceeds the square footage of the structure which is being replaced.

(c) PAYMENT OF FISH AND GAME FEES

These provisions shall apply to all projects processed by the County of San Diego for which California Department of Fish and Game fees are payable under the requirements of California Fish and Game Code Section 711.4.

Upon the receipt of a completed application and payment of all required application fees, the County of San Diego shall process said projects to the point of review where an Environmental Impact Report or a Negative Declaration has been prepared which has been advertised for public review under the requirements of the California Environmental Quality Act and is ready for a project decision and/or hearing. At that time, the County shall delay its processing of the project application and provide written notice to the project applicant of the Department of Fish and Game fees, and any County handling fees, which are due and payable under California Fish and Game Code Section 711.4. Said fees shall be paid in full by the applicant in the manner set forth below. Said notice shall indicate that the Environmental Impact Report or the Negative Declaration will not be certified or adopted and the project will not go forward for a hearing and/or decision until said fees are paid.

The project applicant shall pay the specified fees in full and provide a copy of the cashier receipt to the department processing the application. Payment shall be by certified check payable to "County of San Diego Recorder" and submitted to the Assessor Recorder's County Clerk. County initiated projects are not required to pay by certified check and can use transfer of funds or other means as payment. When the payment of said Fish and Game fees and any County handling fees is made, and a copy of the cashier receipt is provided by the applicant to the department processing the application, the Environmental Impact Report or the Negative Declaration may proceed to hearing and/or decision.

If the payment of said Fish and Game fees and any County handling fees is not made, and a copy of the cashier receipt is not provided by the applicant to the department processing the application, the Environmental Impact Report or the Negative Declaration shall not proceed to hearing and/or decision and the County of San Diego may, at the discretion of the department processing the application, bring the project to the decision maker with a recommendation for denial if the County is unable to approve the project within the time periods set forth in the Permit Streamlining Act (Government Code Sec. 65920 et seq.).

(d) SANTA FE VALLEY SPECIFIC PLAN FEES

This subsection establishes a Specific Plan fee for each subarea within the Santa Fe Valley Specific Plan pursuant to Government Code Section 65456. The Specific Plan fee for each subarea, as set forth in the table below, shall be paid in full to the Department of Planning & Development Services prior to the approval of any final map or parcel map in the applicable subarea.

The Director of Planning & Development Services shall use any fees collected under this subsection to reimburse Santa Fe Valley Venture (or its successor or assigns) for its costs in funding the preparation, adoption, and administration of the Specific Plan beyond the relative benefit it derived from the Specific Plan adoption. Notwithstanding any other provision in this subsection, Santa Fe Valley Venture (or its successor or assigns) shall not be required to pay the Specific Plan fee specified in the table below for any of the subareas in Area II, as said property owner has already contributed funding which exceeds its relative benefit derived from the Specific Plan adoption.

Notes

1 If any project is found to have a potentially significant impact the appropriate CEQA deposit will be required. For concurrent submittals with multiple permits, only one CEQA deposit is required per Department.

3 PDS fees and deposits for processing a site plan application for community design review of a single dwelling on an existing legal lot, or for buildings or structures accessory to such a dwelling within the I-15 corridor shall be waived. Cross Reference: 362(h) CC.

4 The cost of the appeal will be taken in as a deposit if the applicant files the appeal. For non-applicant filed appeals, the amount is taken in as a fee.

5 If the project deposit account is still open and has, at a minimum, the amount of funds listed in the INTAKE DEPOSIT/FEE column, an additional deposit is not required.

6 INITIAL REVIEW FEE. An Initial Review Fee in the amount listed in Section 362.1 shall be paid when an application or plan is submitted for one or more of the following: general plan amendment, major use permit, major use permit modification, site plan, site plan modification, specific plan, specific plan amendment, tentative map (major subdivision) revised tentative map, tentative parcel map (minor subdivision), revised tentative parcel map, grading plan, reclamation plan, reclamation plan modification, and landscape plan.

7 SUBSEQUENT REVIEW FEE. During the initial review, the Department of Planning & Development Services may determine that additional (subsequent) review is necessary for issues related to parks and/or issues related to trails. If the Department determines that additional review is necessary, a Subsequent Review Fee Parks and/or a Subsequent Review Fee Trails in the amount(s) specified in Section 362.1 shall be applied for the applications listed above if the applicant wants to proceed with the project.

  1. PLAN REVIEW FEES. When a plan or other data is required or requested pursuant to the code, a plan review fee shall be paid at the time of submitting plans and specifications for review. Said plan review fee shall be 65% of the building permit fee.

  2. DISABLED ACCESSIBILITY REVIEW FEES. The fee for conducting a review of plans for compliance with the disabled accessibility standards found in Title 24 of the California Code of Regulations, to be assessed at the time of application for plan review, shall be an additional 10% of the plan review fee specified in subsection (c). The fee for conducting an inspection for compliance with said disabled accessibility standards, to be assessed at the time of issuance of a building permit, shall be an additional 10% of the building permit fee which is assessed under subsection (c).

(d) OTHER FEES, DEPOSITS, AND PROVISIONS

  1. PLAN REVIEW FEES FOR RESIDENTIAL TRACTS. When a plan is registered with the Building Official as a Master Plan, all subsequent plan reviews for that Master Plan will be charged the fee listed in Item 1 of subsection (b), Schedule of Building Construction Permit Fees. The minimum fee will be charged for each unique floor plan in the phase regardless of the total number of dwelling units in the phase. If more than two hours is required to intake and review each unique floor plan, the time in excess of two hours will be charged at the Time and Material Rate described in subsection (e). Minor, nonstructural changes to Master Plans are acceptable, however, all additional staff time spent processing any plan changes will be added to the plan review fee.

  2. EXTENSION OF AN EXPIRED PLAN REVIEW. When plans are submitted subsequent to plan review expiration, as permitted by Section 91.1.109.2.1, the plan review extension fee shall be 25 percent of the plan review fee prescribed above for newly submitted plans.

  3. PLAN CHANGES, ADDITIONS, REVISIONS OR INCOMPLETE PLANS. Additional plan review required by plan changes, additions, or revisions to approved plans or because the plans are incomplete shall be charged at the time and material labor rate. The minimum charge shall be one-half hour.

  4. FEE REDUCTION FOR BUILDINGS USING SUSTAINABLE BUILDING PRACTICES. For building permit applicants who voluntarily participate in the County of San Diego Green Building Program, as established by Board of Supervisors Policy F-50, the plan check and permit fees shall be reduced by 7.5%. To qualify for this fee reduction, the project shall use one of the following sustainable building practices:

Energy Conservation The project shall exceed California Energy Commission Standards by 15% or more for residential and 25% or more for commercial and industrial developments.

Natural Resource Conservation The project shall incorporate straw bale construction for all exterior walls or use recycled content in the building system. To be eligible for the fee reduction by using recycled content, the applicant must demonstrate, to the satisfaction of the Building Official, that 20% or more of the primary materials being used in the building system contain 20% or more post-consumer recycled content. Any reused materials will be found to satisfy the 20% post-consumer recycled content requirement. A fee reduction may also be approved when the applicant demonstrates, to the satisfaction of the Building Official, that at least one primary building material (e.g. roofing material) is 50% or more post-consumer recycled content.

Water Conservation The project shall include the installation of a graywater system. A permit is required from the Department of Environmental Health for the graywater system in addition to the building permit issued by the Department of Planning & Development Services.

  1. EXPEDITED PLAN REVIEW. When requested by the applicant and approved by the Building Official, staff may use overtime to expedite a plan review. An additional fee shall be charged for this service. The fee amount shall be determined using the time and material labor rate multiplied by the amount of time staff spends on expedited plan review.

  2. INSPECTIONS OUTSIDE OF NORMAL BUSINESS HOURS. When the Building Official approves inspections outside of normal business hours, the fee shall be charged hourly at the rate of one and one-half times the standard time and material labor rate described in subsection (e) of this section. The minimum time charged shall be two hours.

  3. REFUNDS. An applicant who has paid the applicable plan review or permit fees in subsection (a) or subsection (b) of this section may withdraw the application by submitting a written request to the Director of Planning & Development Services. The Department shall discontinue work on such application within one working day from the receipt of said request, except that the Department may continue to process an application involving the violation of a County ordinance.

The Director of Planning & Development Services shall not authorize the refund of any building fee paid except upon written application filed by the original applicant, received not later than one year after the date of fee payment.

Fee refunds of $25,000 or more must receive Board of Supervisor approval prior to payment.

Final permits and/or documents shall not be issued until all required fees/deposits are paid in full.

The Director of Planning & Development Services may authorize the full refund of any fee paid hereunder which is erroneously collected by the County.

Refund of fees described in subsection (b) of this section shall be made in accordance with San Diego County Code Section 91.1.109.6.

  1. VIOLATIONS. When a violation of any County code includes or results from the failure to obtain a required permit, a violation fee may be assessed as prescribed in San Diego County Code Section 91.1.109.4.1. In all cases the additional violation fee or deposit amount shall be treated as a non-refundable flat fee, even if the initial amount is a deposit.

  2. CHARGES FOR TECHNICAL REPORTS. Information, circulars, reports of technical work, and other reports prepared by the Department of Planning & Development Services, when supplied to other government agencies, individuals or groups requesting copies of same, may be charged for by the Department in a sum not to exceed the cost of publication and distribution of such documents.

  3. HOMEOWNER AND BUSINESS OWNERS RELIEF - WAIVER OF PLAN REVIEW AND PERMIT FEES. Notwithstanding the fees otherwise specified in subsections (a) and (b) of this section, and San Diego County Code Section 91.1.109, the plan check review fee and the permit fee shall not be charged for the following improvements provided the improvement has not been previously identified as a violation by the County:

Cargo containers of 320 square feet or less, when used for storage.

Exterior siding or plastering.

Non-masonry fencing and free-standing walls.

Replacement of roofing material (no alteration to the existing roof structure).

Skylights that are ICBO approved.

Window replacements with the same net openable area. (Per State of California Energy Efficiency Standards, replacement windows must still meet the requirements for the applicable climate zone).

Door replacements that are not required to be fire-rated.

Replacement or repair of interior drywall when on a wall or ceiling which is not required to be fire rated.

Electric heat pump and air conditioner replacements provided there is no alteration to the electrical system which supplies power to the heat pump or air conditioning unit.

Residential photovoltaic electrical systems.

Residential Small Wind Turbine Systems.

Replacement hot water heater installation when there is no modification or alteration of the electrical or gas system which supplies the water heater.

Emergency repair of gas lines.

Lawn sprinkler systems.

Decommissioning of septic systems and connection to public sewer.

  1. HOMEOWNER RELIEF WAIVER OF PLAN REVIEW FEES. Notwithstanding the fees otherwise specified in subsections (a) and (b), no fee shall be charged for the plan check review of the following improvements if the improvement is accessory to a single-family dwelling, a duplex, or a mobile home built pursuant to county standard plans and the improvement has not been previously identified as a violation by the County:

Carports over 300 square feet.

Patio covers over 300 square feet.

Fireplaces.

Retaining walls built to County standards.

  1. HOMEOWNER RELIEF EXEMPTION FOR SEISMIC RETROFITS. Notwithstanding the fees otherwise specified in subsections (a) and (b) of this section, and San Diego County Code Sections 91.1.109.2 and 91.1.109.5.17, the plan check review fee and the application fee shall not be charged for a seismic retrofit to a single- family dwelling, a duplex or a mobile home built pursuant to County standard plans.

  2. STANDARD HOURLY RATES. The fee for items not listed in the above fee subsections or those designated "Time and Materials" shall be determined by the actual costs incurred by the Department of Planning & Development Services. The cost will be determined by using the labor rates specified in subsection (e) Schedule of Standard Hourly Rates.

  3. SURFACE MINING INSPECTION DEPOSIT. The deposit for conducting annual inspections of surface mining operations to review compliance with the Major Use Permit, Reclamation Plan and Interim Management Plan shall be $2,000. The deposit shall be due within 60 days after the adoption of this ordinance and on July 1 of each year thereafter. The $2,000 amount shall apply to all existing surface mining operations for the first year and for the first year of each new surface mining operation. Thereafter, the Director shall determine the appropriate amount of the deposit for each surface mining operation. Approval and inspections of an Interim Management Plan shall be an expense of the inspection deposit.

  4. SIGNS - REFUNDABLE DEPOSIT. The refundable deposit required prior to the approval of any administrative sign permit or minor use permit, as prescribed in the County Zoning Ordinance Section 6207 b. 1. xiv., shall be $1,000.

  5. MISSED APPOINTMENT FEE. The Building Official may charge this fee when an applicant does not show up for a scheduled plan submittal appointment or cancels the appointment less than 24 hours in advance.

  6. FEE WAIVER FOR STRUCTURES DAMAGED OR DESTROYED BY NATURAL DISASTER. Notwithstanding the fees otherwise specified in subsections (a) and (b) of this section, the plan check review fee and the permit fee may be waived for an applicant who is rebuilding legally built structures which have been damaged or destroyed by a wildfire or other natural disaster and which are located within the boundaries of a geographic area which has been declared by resolution of the Board of Supervisors to be eligible for this fee waiver. The fee waiver shall not apply to any portion of a new structure which exceeds the square footage of the structure which is being replaced.

  7. FEE WAIVER FOR DISABLED VETERANS. Notwithstanding the fees otherwise specified in subsections (a), (b) and (c) of this section, and San Diego County Code sections 91.1.109.2 and 91.1.109.5.17, the plan check and building permit fees shall be waived for modifications made to the homes of disabled veterans.

  8. SCHEDULE OF FEES FOR CANNABIS FACILITY OPERATING LICENSES ISSUED BY PLANNING & DEVELOPMENT SERVICES. The fees for the licenses, permits and Operating Certificates issued by the Department of Planning & Development Services and services provided by Department of Planning & Development Services pursuant to Section 21.103.6 of the Regulatory Ordinances and this code shall be as follows:

  1. OPERATING CERTIFICATE RENEWAL FEE. An Annual Renewal Fee in the amount listed in Section 362.1 shall be paid when an application for an annual renewal for a cannabis Operating Certificate is filed. This fee recovers the costs associated with renewing the Operating Certificate and ensuring ongoing compliance with regulations within Sections 21.2503-21.2507 of the Regulatory Ordinances.

  2. BUSINESS PRACTICE MODIFICATION FEE. A Business Practice Modification Fee is the amount listed in Section 362.1 and shall be paid when there is an application to modify the business practices of the cannabis facility listed on an existing Operating Certificate is filed. Modification includes the updating of business practices, which include the following activities: retail, cultivation on an area less than 10,000 square feet, manufacturing, or distribution. This fee recovers the costs associated with modifying the Operating Certificate and ensuring ongoing compliance with regulations within Sections 21.2503-21.2507 of the Regulatory Ordinances.

  3. BUSINESS OWNERSHIP MODIFICATION FEE. A Business Ownership Modification Fee is the amount listed in Section 362.1 and shall be paid when there is an application to add or remove a responsible person to the Operating Certificate, update the corporate status, or transfer of the Operating Certificate is filed. This fee recovers the costs associated with modifying a cannabis facility's Business Ownership status and ensuring ongoing compliance with regulations within Sections 21.2503-21.2507 of the Regulatory Ordinances.

(f) DEPARTMENT OF PLANNING & DEVELOPMENT SERVICES BUILDING COMMITTED FUND BALANCE

  1. PURPOSE. The County of San Diego may charge fees to cover the costs of building; provided such fees do not exceed the estimated reasonable cost of the services for which the fees are charged. The Building Reserve Designation was established by the resolution of the Board of Supervisors on June 27, 1995. In 2009, Governmental Accounting Standards Board 54 resulted in a change in name from Reserve Designation to Committed Fund Balance. The purpose of the Building Committed Fund Balance ("Committed Fund Balance") is to stabilize the revenue base of the Building Program within the Department of Planning & Development Services.

  2. ESTABLISHMENT OF THE RESERVE DESIGNATION COMMITTED FUND BALANCE. There is hereby established the Department of Planning & Development Services Building Committed Fund Balance into which shall be deposited all fees in excess of the actual cost required to provide services by the Department of Planning & Development Services in the Building Program. Moneys shall be deposited in and appropriated from the Committed Fund Balance in accordance with the provisions of this section.

  3. DEPOSITS INTO THE COMMITTED FUND BALANCE. After the close of each fiscal year, the department shall determine the amount of fees collected and the actual full costs of providing services in the Building Program during the fiscal year and submit to the Office of Financial Planning for review. In the event the amount of fees collected exceeds the actual full costs, the Office of Financial Planning shall transfer such excess amount to the Committed Fund Balance.

  4. UTILIZATION. The Committed Fund Balance shall be used only to offset costs in the Department of Planning & Development Services' Building Program. Funds in the Committed Fund Balance shall be appropriated only when it is estimated reasonably that actual full costs will exceed fees to be charged for services in the Building Program. The Chief Administrative Officer shall report to the Board of Supervisors on the need to appropriate any funds from the Committed Fund Balance prior to any appropriation by the Board of Supervisors. Building fees will be reviewed annually to ensure compliance with Board Policy B-29, "Fees, Grants, Revenue Contracts, Department Responsibility for Cost Recovery."

  5. PUBLIC MEETINGS. All issues related to the Committed Fund Balance shall be considered by the Board of Supervisors in a regularly scheduled meeting. Notice of the time and place of the meeting shall be mailed at least fourteen (14) days prior to the meeting to any party who files a written request with the Clerk of the Board of Supervisors for such mailed notice.

(g) WAIVER OF SPECIFIED FEES AND DEPOSITS FOR FARM EMPLOYEE HOUSING AND FARM LABOR CAMPS

Notwithstanding any other provision of this article, the environmental action fees and deposits authorized by County Ordinance 4901 (N.S.), as specified in Section 362.1, shall be waived for:

(1) Any farm employee housing or farm labor camp project for which (i) a complete application for an Administrative Permit or a Minor Use Permit was filed between July 13, 1990, and January 13, 1991 pursuant to Ordinance No. 7768 (N.S.); or was filed between April 5, 1991 and October 5, 1991, pursuant to Ordinance No. 7875 (N.S.); or was filed between October 31, 1991 and June 30, 1993, pursuant to Ordinance No. 8086 (N.S.); or was filed between July 30, 1993, and June 30, 1994 pursuant to Ordinance No. 8271 (N.S.); or was filed between September 2, 1994 and June 30, 1995, pursuant to Ordinance No. 8436 (N.S.); or was filed between September 15, 1995 and June 30, 1998 pursuant to Ordinance No. 8574 (N.S.) or was filed between May 14, 1999 and June 30, 2004 pursuant to Ordinance No. 9021 (N.S.); or was filed between July 1, 2004 and June 30, 2009 pursuant to Ordinance No. 9647 (N.S.) and (ii) the application was approved; or

(2) Any farm employee housing or farm labor camp project for which (i) Section 17021.5 or Section 17021.6 of the California Health and Safety Code is applicable; (ii) the Agricultural Commissioner has issued a certificate of active agricultural enterprise; (iii) the housing is not the subject of an active code enforcement action; (iv) the applicant has entered into the contract required by Section 6156 u.11 or Section 6906 d. of The Zoning Ordinance; and (v) the application was filed between July 30, 1993, and June 30, 1994, pursuant to Ordinance No. 8271 (N.S.); or was filed between September 2, 1994 and June 30, 1995, pursuant to Ordinance No. 8436 (N.S.); or was filed between September 15, 1995 and June 30, 1998 pursuant to Ordinance No. 8574 (N.S.); or was filed between May 14, 1999 and June 30, 2004 pursuant to Ordinance No. 9021 (N.S.); or was filed between July 1, 2004 and June 30, 2009 pursuant to Ordinance No. 9647 (N.S.).

Said fee waiver for a Minor Use Permit for a farm labor camp shall be subject to the $5,000.00 maximum waiver for all costs expended by staff within the Department of Planning & Development Services as set forth in the San Diego County Zoning Ordinance Section 7602 d.7. Said fee waiver for a farm labor camp project for which a Minor Use Permit is prohibited under Section 17021.5 or Section 17021.6 of the California Health and Safety Code shall also be limited to a $5,000.00 maximum waiver for all costs expended by staff within the Department of Planning & Development Services.

(h) WAIVER OF SPECIFIED FEES AND DEPOSITS FOR CERTAIN COMMUNITY DESIGN REVIEW AREA SITE PLAN APPLICATIONS IN THE I-15 CORRIDOR

Notwithstanding any other provision of this article, the fee and deposit for processing a Community Design Review Area Site Plan application pursuant to Sections 7158 and 7602 of The Zoning Ordinance shall be waived for certain Site Plan applications within the I-15 Corridor (as defined in the County General Plan). Specifically, such Site Plan applications for community design review of a single dwelling on an existing legal lot, or for buildings or structures accessory to such a dwelling, shall have such fees and deposits waived.

(c) PROVISIONS

  1. FEE WAIVER FOR STRUCTURES DAMAGED OR DESTROYED BY NATURAL DISASTER. Notwithstanding the fees and deposits otherwise specified in Section 362.2, subsection (a), the grading permit fees or deposits may be waived for an applicant who is rebuilding legally built structures which have been damaged or destroyed by a wildfire or other natural disaster and which are located within the boundaries of a geographic area which has been declared by resolution of the Board of Supervisors to be eligible for this fee or deposit waiver. The fee or deposit waiver shall not apply to any portion of a new structure which exceeds the square footage of the structure which is being replaced.

SEC. 362.4. MISCELLANEOUS DEPOSITS FOR THE DEPARTMENT OF GENERAL SERVICES.

(a) DEPOSITS

  1. PRE-INTAKE DEPOSITS. An applicant may request review of a project to identify any significant issues or concerns that the applicant may want to consider before filing a formal application. The deposit collected is intended to cover County costs to conduct the initial project analysis and application processing. Application consultation shall be mandatory for all privately initiated projects unless waived by the Department of General Services. The Pre-Intake Deposit shall be the deposit amount set by the Board for the type of application. Upon the filing of an application, the applicant shall deposit the funds necessary to replenish the account to the amount set by the Board for the type of application filed.

  2. DEPOSITS DUE WITH APPLICATION. Deposits shall be calculated and paid to the Department of General Services in accordance with the following schedule:

  1. POST-APPLICATION DEPOSIT ADJUSTMENTS. Upon completion of initial project analysis, the applicant and project manager will discuss the scope of the project and calculate an estimated deposit(s). The estimated deposit(s) shall be calculated based on factors identified during the initial project analysis, established processing time standards, standard hourly rates and key milestones.

Estimated deposits shall be paid in advance of services performed. Estimated deposits are collected to recover actual project processing costs by key milestones and shall be paid prior to the completion of said milestones. The County may discontinue processing the requested project and/or recommend denial of the project based on the applicant's refusal to pay the estimated deposit and all actual processing costs that may not have been included in the estimate.

(b) MISCELLANEOUS PROVISIONS GENERALLY APPLICABLE TO DEPOSITS.

  1. STANDARD HOURLY RATES. Any County employee may bill against an account at the hourly rates specified in subsection (c), Schedule of Standard Hourly Rates.

  2. SUBSEQUENT DEPOSITS. Unanticipated factors arising during project processing, such as, but not limited to, complexity, controversy or environmental issues which require additional project review will be conveyed to the applicant as soon as they are known. If it is determined that the deposit is insufficient to recover actual costs, the project manager will scope the work remaining on the project and calculate an additional subsequent deposit. The County may discontinue processing the requested project and/or recommend denial of the project based on the applicant's refusal to pay the estimated deposit and all actual processing costs that may not have been included in the estimate. Final documents and approvals shall not be issued until all deposits are paid in full.

  3. REFUNDS. At the completion of all tasks associated with an application for which a deposit is required and after all final documents and review are completed, the difference between the deposited amount and the actual cost shall be refunded within 180 days. A refund shall not be authorized if the total refundable amount after deduction of County administrative cost is less than $10. An applicant who has paid the applicable deposit(s) may withdraw the application by submitting a written request to the County. The County shall discontinue work on such application within one working day from the receipt of said request. Any unused deposit(s) remaining upon the withdrawal of the application shall be refunded in accordance with this section.

  4. Notwithstanding any other provision of this section, when an applicant is owed a refund but is in deficit on a separate deposit account(s) at any County department, the refund may be applied by the County to the deposit account(s) in deficit as an offset, unless a different disposition of the refund is required by law.

(c) SCHEDULE OF STANDARD HOURLY RATES

  1. PLAN REVIEW AND INSPECTION FEES FOR RESIDENTIAL TRACTS. When a plan is registered with the Building Official as a Master Plan, fees will be assessed for each unique floor plan for the building and automatic fire sprinkler plan reviews. Each dwelling unit in the phase will be assessed inspection fees. If there are no new unique floor plans in subsequent phases of the residential tract, fees will be assessed for only the inspection of each dwelling unit in the phase.

  2. FEE WAIVER FOR STRUCTURES DAMAGED OR DESTROYED BY NATURAL DISASTER. The plan review fee and inspection fees may be waived for an applicant who is rebuilding legally built structures which have been damaged or destroyed by a wildfire or other natural disaster and which are located within the boundaries of a geographic area which has been declared by resolution of the Board of Supervisors to be eligible for this fee waiver. The fee waiver shall not apply to any portion of a new structure which exceeds the square footage of the structure which is being replaced.

  3. HOMEOWNER AND BUSINESS OWNER'S RELIEF - WAIVER OF PLAN REVIEW AND INSPECTION FEES. Notwithstanding the fees otherwise specified in subsections (a) and (b) of this section, and San Diego County Code Section 91.1.109, the plan check review and inspection fees shall not be charged for improvements identified in subsections (10), (11) and (12) of Section 362.1(d) of the San Diego County Administrative Code, provided the improvement has not been previously identified as a violation by the County.

  4. FEE WAIVER FOR DISABLED VETERANS. Notwithstanding the fees otherwise specified in subsections (a) and (b) of this section, the plan check and inspections fees shall be waived for accessibility modifications made to the homes of disabled veterans.

  5. AUTHORITY TO WAIVE FEES. The Fire Code Official shall have the authority to waive fees for a project when the scope of work is minor in nature, the plans can be reviewed over the counter without additional research and will not necessitate an inspection for fire code related issues.

  6. APPLICABILITY. This chapter shall be applicable in the unincorporated territory of the County of San Diego, where the County Fire Code Official provides the services, including within a fire protection district or municipal water district which provides fire protection service, if the district has entered into a Memorandum of Understanding or other agreement with the County to provide fire plan review and inspection.

SEC. 363. PROBATION DEPARTMENT.

The following fees and charges shall be paid to the San Diego County Probation Department or the County collection agent.

(a) An adult probationer who damages or discards his or her electronic monitoring device may be charged up to $600 for equipment replacement costs.

(b) Pursuant to Penal Code section 1210.1(a), in addition to any fine assessed under other provisions of law, the trial judge may require an adult convicted of a nonviolent drug possession offense who is reasonably able to do so to contribute to the cost of his or her own placement in a drug treatment program of up to $79 per month.

(c) A fee of up to $250 each year for administering the approval and annual renewal process of the Batterers Diversion Programs as required by Penal Code Section 1203.097(c)(5)(B).

SEC. 364. HEALTH AND HUMAN SERVICES AGENCY.

Unless otherwise provided by this section or by statute, the following fees and charges shall be paid to the County of San Diego, Health and Human Services Agency or the County Collection agent.

(a) Stepparent Adoptions. A fee of $270 to be charged to a stepparent adopting a child for the costs incurred by the County in making an investigation required by existing law, except as specified; pursuant to Section 9000 et. seq. of the Family Code. Pursuant to Family Code Section 9002, the Director may defer, waive or reduce the fee if its payment would cause economic hardship to the prospective adoptive parent detrimental to the welfare of the adopted child. For such purpose, the Director of the Health and Human Services Agency is authorized to establish a sliding payment scale for this fee. This sliding scale shall be based upon the income level of the family.

(b) Guardianship. A fee of $708 for non-relative guardianship investigations as required by existing law, except as specified; pursuant to Section 1500 et seq. of the Probate Code. Pursuant to Probate Code Section 1513.1, the Director may waive any or all of the fee based on hardship. For such purposes the Director of the Health and Human Services Agency is authorized to establish a sliding payment scale for this fee. This sliding scale shall be based upon the income level of the family.

SEC. 364.1. CHARGES FOR EMERGENCY RESPONSE.

(a) A person liable for the expenses of an emergency response pursuant to state law, including but not limited to Government Code Title 5, Division 2, Part 1, Chapter 1, Article 8, may be billed for costs incurred by a County agency in reasonably making an appropriate emergency response to an incident proximately caused by that person. Recovery of costs under this subdivision shall be subject to any applicable requirements set forth in state law.

(b) In addition to any liability under subdivision (a), a person is liable, and may be billed for, the costs incurred by a County agency in reasonably making an appropriate emergency response to an incident proximately caused by that person's violation of federal, state, or local law, unless recovery is limited by any other provision of law.

  1. BULK TRANSFER FEE: This fee will be assessed and become part of the total amount due stated in the demand for any tax liability that is owed to the Treasurer-Tax Collector pursuant to receipt of a Bulk Sale notice.

  2. CERTIFICATE OF LIEN PREPARATION FEE: This fee will be assessed and added to the amount necessary to satisfy the lien for each lien and/or release of lien recorded/filed. This fee will reimburse the Tax Collector for costs incurred in preparing the lien and/or release of lien and recording of documents with each agency/jurisdiction in which a lien is being recorded.

  3. DMV HOLD FEE: This fee will be assessed each time a hold is placed on a title renewal or transfer of a tax delinquent vessel. This fee will reimburse the Tax Collector for costs incurred in placing the hold as well as the cost of providing notice of the hold to the taxpayer.

  4. DMV RELEASE FEE: This fee will be assessed each time a hold is released on a title renewal or transfer of a tax delinquent vessel. This fee will reimburse the Tax Collector for costs incurred in releasing the hold.

  5. DUPLICATE RELEASE OF LIEN FEE: This fee will be assessed to unsecured accounts upon a request to issue a duplicate Release of Lien. This fee will reimburse the Tax Collector for the costs incurred in researching and verifying that the tax bill that is paid and generating a new Release of Lien. There may be an additional charge to recover the actual recording cost if the release is recorded by the Treasurer-Tax Collector.

  6. FAA LIEN FILING FEE: This fee will be assessed to unsecured accounts for aircraft each time a lien is filed with the Federal Aviation Agency. This fee will reimburse the Tax Collector for the actual costs incurred in filing the lien and/or release of lien. In addition to the charges for filing and/or releasing a lien with this agency, the CERTIFICATE OF LIEN PREPARATION FEE will apply.

  7. MANUFACTURED HOME TAX CLEARANCE CERTIFICATE FEE: This fee will be assessed if a previously issued tax clearance certificate or conditional tax clearance certificate expires prior to the date upon which title transfers.

  8. RELEASE OF LIEN FEE: This fee will be assessed and added to the amount necessary to satisfy the lien. This fee will reimburse the Tax Collector for costs incurred in preparing the release of lien. There may be an additional charge to recover the actual recording cost if the release is recorded by the Treasurer-Tax Collector.

  9. U.S. COAST GUARD FEE FEE: This fee will be assessed to unsecured accounts for vessels registered with the U.S. Coast Guard each time a lien is filed with the U.S. Coast Guard. This fee will reimburse the Tax Collector for the actual costs incurred to file the lien and/or release of lien. In addition to the charges for filing and/or releasing a lien with this agency, the CERTIFICATE OF LIEN PREPARATION FEE will apply.

  10. UNSECURED CIVIL PROCESS FEE: This fee will be assessed to accounts requiring Sheriff's services for civil processes to reimburse the County for statutory costs, fees, and actual expenses incurred for the service and performance of civil process collection actions.

UNSECURED DELINQUENT ASSIGNMENT FEE: This fee will be assessed to each bill found under delinquent unsecured accounts at the time of assignment to an Enforcement Officer to recover costs involved to contact, and demand payment for the tax delinquency; and to protect the County's lien interest against the Assessee.

  12. USECURED FINAL NOTICE FEE: This fee will be assessed to delinquent unsecured accounts that are not assigned to an Enforcement Officer for collection. This fee reimburses for costs incurred to prepare and provide Notice of Intent and Final Notice.

  13. UNSECURED SEIZURE FEE: This fee will be assessed to accounts to reimburse the Tax Collector for expenses incurred in serving notice of the seizure action to the party and the actual costs incurred for the performance of personal property seizures. This fee is charged once per seizure action, even if multiple entities are being served with the seizure notice for an account and accrues to the total due for all tax bills that are included in the account.

  14. ENFORCEMENT OFFICER UNSECURED FINAL NOTICE FEE: This fee will be assessed to a delinquent unsecured account that is assigned to an Enforcement Officer for costs incurred when an Enforcement Officer is required to prepare and provide additional final noticing for payment.

  4. TAX SALE PREPARATION FEE: This fee will be assessed to each parcel ninety (90) days prior to the intended tax sale to reimburse the County for costs incurred in preparing to conduct the tax sale. This fee will be collected from property owners who redeem property within ninety (90) days of the proposed tax sale or deducted from the proceeds of property sold at the County Tax Sale.

  5. TAX SALE PERSONAL CONTACT FEE: This fee will be assessed to owner occupied properties subject to the Tax Collector's Power of Sale. This fee will reimburse the County for costs incurred in providing the owner with personal notification of the proposed tax sale and apprising him or her of their redemption rights. The fee will be collected from property owners who redeem property prior to the day of the tax sale or deducted from the proceeds of property sold at the County Tax Sale.

  6. TAX SALE COUNTY AUCTION FEE: This fee will be deducted from the proceeds of each parcel sold at the County Tax Sale to reimburse the County for the cost of conducting the sale. This fee will not be assessed to property owners who redeem property prior to the day of the tax sale. This fee is subject to refund only upon cancellation of sale by the Treasurer-Tax Collector in accordance with R&T Code Section 3731 & 3731.1.

  8. EXCESS PROCEEDS NOTICE FEE: This fee will be deducted from the excess proceeds of sold parcels. SEC. 364.7. FEES FOR DEBT SERVICES.

TEFRA Fee:

This fee is assessed to a nonprofit public benefit organizations or for-profit corporations with a public benefit project wishing to issue revenue obligations. The organization and/or corporation, in accordance with Internal Revenue Code Section 147 (f), must receive approval from an applicable legislative body or the entity cannot proceed with the financing. This fee reimburses the County for costs associated with the applicable legislative body approval.

Conduit Administration/Annual Fee:

This fee is assessed annually to a conduit borrower for each bond financing to cover the costs associated with the oversight of the long-term obligations after the bonds have been issued.

Community Facilities District Issuance Fee:

This fee is assessed to each bond financing to reimburse the County for costs associated with the oversight of the financing structure and long-term bond sale on behalf of a specific community facilities district.

Community Facilities District Administration/Annual Fee:

This fee is assessed annually to a community facilities district for each bond financing to cover the costs for oversight of the long-term obligations after the bonds have been issued.

(2) Whether or not a fee for dog licensing or animal control services is applicable shall be determined by the Director of the Department of Animal Services (Director).

(3) Fees shall be paid when due except that the Director may authorize a payment arrangement or reduce or waive any fee in whole or in part as provided in Section 62.604 (b) of the Code of Regulatory Ordinances.

(b) FEE EXEMPTIONS

(1) FEE EXEMPT DOG LICENSES: Guide, signal, and service dogs as defined in Penal Code section 365.5(d), (e), and (f) or Civil Code section 54.1(b)(6)(C); dogs that have served with the armed forces of the United States of America; dogs that provide services to a law enforcement agency; and dogs kept on federal Indian trust or restricted land within the boundaries of the County are eligible for a fee exempt license.

To qualify for this exemption, the dog must be currently vaccinated against rabies in accordance with State and County laws relating to vaccination and licensing of dogs, and the owner must furnish an affidavit or declaration to this effect under penalty of perjury on a form furnished by the Director. A license fee exemption granted for one dog may not be transferred to another dog.

(2) ONE-TIME FEE EXEMPTION FOR ADOPTED DOGS: Any resident of the unincorporated area of San Diego County who adopts a dog from the Department shall be issued a one-time, one-year free dog license.

(c) LICENSE DURATION AND EXPIRATION: Dog licenses are valid for up to 12, 24, or 36 months from the date of issue, depending on the fees paid or exempted and the remaining anti-rabies immunity duration period. However, in no instance shall a license be issued for a period beyond the date on which anti-rabies revaccination is due.

(d) LATE FEE: The dog license late fee shall apply if the application for a dog license or renewal is not received or postmarked on or before the time period specified in San Diego Code of Regulatory Ordinances, section 62.620.

The owner or custodian of a dog is responsible for renewing his or her dog license before it expires. The failure to receive a Department courtesy notice does not relieve the owner or custodian from the obligation to renew the dog license on time or pay a late fee.

(e) TRANSFER OF JURISDICTION LICENSE FEE: Owners of dogs having a current license issued through an authorized licensing agency other than the County of San Diego may be issued a transfer license valid for up to 12 months upon payment of the applicable transfer of jurisdiction license fee. The rabies vaccination or application for vaccination exemption must meet all requirements for licensing purposes under the San Diego County Code. A late fee may be applied if the application is not made within 30 days after the owner of the dog first resides in a jurisdiction where animal control services are provided by the County of San Diego.

(f) LICENSE TAG REPLACEMENT FEE: A replacement license tag may be issued upon payment of the replacement tag fee. No changes may be made to the expiration date of the actual license. Replacement license tags are not subject to a late fee.

(g) CHANGE OF OWNERSHIP FEE: A dog license reflecting a change of ownership may be issued to the new owner of a dog that was currently licensed through the Department upon payment of the applicable fee. The new license shall be valid for the same period as the original license. A late fee shall apply if the application is not received or postmarked on or before 30 days after the date the dog was obtained.

(h) REFUND OF MONEY FOR LICENSE FEES PAID: Dog license fees may be refunded under the following circumstances:

(1) A license was not required when it was issued and is not required when a refund application is submitted; or

(2) An overpayment was made.

(i) IMPOUND FEES: Cumulative violations for impound fees refer to the owner regardless of the dog involved. The impound fee for a lactating mother includes all nursing offspring. The Director may determine fees to recover the Department's costs to impound a wild or exotic animal and/or for any private animal transportation services.

(j) RELINQUISHMENT FEES: Relinquishment fee for a lactating mother includes all nursing offspring. The Director may determine fees to recover the Department's costs to accept and board other relinquished animals not listed in subdivision (a)(1).

(k) BOARD FEES: Board fees apply per day, not including the day of impoundment for a small or medium sized animal. Large animal board fees for the first day of impoundment shall be one half of the daily fee. The Director may determine fees to recover the Department's costs for boarding a wild or exotic animal and/or for any off-site animal boarding services.

(l) MEDICAL FEES: The Director may determine fees to recover the Department's costs for any vaccinations, medications, and other medical supplies, and for any medical services provided by a private veterinary facility or laboratory. The fee for a rabies vaccination shall not exceed the current California Department of Health Services approved "Actual Cost" vaccination fee as published in the California Compendium of Rabies Control and Prevention.

(m) ADOPTION FEES: The Director may determine fees to recover the Department's costs for adoption of animals not listed in subdivision (a)(1). For purposes of adoption fees, a "senior" is a person who is at least 60 years old, and "disabled" means a recipient of either Supplemental Security Income or Social Security Disability payments, or an individual with a disability as defined in the Americans with Disabilities Act.

(n) EUTHANASIA FEES: The Director may determine fees to recover the Department's costs for owner-requested euthanasia of animals not listed in subdivision (a)(1).

(o) QUARANTINE FEES: The quarantine fee applies per visit by an animal control officer for a rabies quarantine effected at any location other than a County animal shelter. Animals quarantined at a County animal shelter shall be subject to the normal impound, medical, and board fees.

SEC. 369. COUNTY SERVICE AREA 17 AND SAN DIEGO COUNTY FIRE PROTECTION DISTRICT GROUND…

A fee of $3,930 and a mileage charge of $50 per mile shall be charged for each Emergency Medical Services (EMS) ambulance transport made to a medically approved destination, pursuant to County of San Diego EMS Policies when provided by the County Service Area 17 and the San Diego County Fire Protection District. Alternatively, an EMS ambulance transport may conclude at a rendezvous location, where the patient transport may transfer to another provider. A fee of $483 shall be charged when EMS responders provide an assessment and treatment, but no patient transport. If more than one transport is provided to a patient (for example, due to a transfer at a rendezvous location), each transport provider may charge the patient the applicable fee and charges. If more than one patient is transported in the same vehicle, the transport provider may charge each patient the applicable fee and charges. There is a fee of $229 per hour for requested special event and/or standby coverage for contracted services. The fees in this section shall increase 5% on July 1, 2027, and each new fiscal year through June 30, 2029, as shown in the table below. The Fire Chief or designee may waive any applicable fee and charges for individuals financially unable to pay.

SEC. 372. RAMONA MUNICIPAL WATER DISTRICT EQUIVALENT DWELLING UNIT TAX.

Section 5.20.040 Service Charges Designated.

There is levied to each premises within the district a non ad valorem special property tax as an excise tax for fire protection services, including ambulance/paramedic services, and such charge is based on equivalent dwelling units (EDUs) as set forth in this section. The fire/paramedic tax is established at the rate of one hundred eighty-eight dollars and fifty-two cents per EDU per year.

Group A Occupancies Defined

Division 1. Any assembly building or portion of a building with a legitimate stage and an occupant load of 1000 or more.

Division 2. Any building or portion of a building having an assembly room with an occupant load of less than 1000 and a stage.

Division 2.1. Any building or portion of a building having an assembly room and an occupant load of 300 or more without a stage, including such buildings used for educational purposes and not classed as a Group E or Group B, Division 2 Occupancy.

Division 3. Any building having an assembly room with an occupant load of less than 300 without a stage including such buildings used for educational purposes and not classed as a Group E or Group B, Division 2 Occupancy.

Division 4. Stadiums, reviewing stands and amusement park structures not included within other Group A Occupancies.

Group B Occupancies Defined

Division 1. Repair garages where work is limited to exchange of parts and maintenance requiring no open flame, welding, or use of Class I, II or II-A liquids.

Division 2. Drinking and dining establishments having an occupant load of less than 50, wholesale and retail stores, office buildings, printing plants, police and fire stations, factories and workshops using material not highly flammable or combustible, storage and sales rooms for combustible goods, paint stores without bulk handling, building used for educational purposes beyond the 12th grade with less than 50 occupants in any room.

Division 3. Aircraft hangars where no repair work is done except exchange of parts and maintenance requiring no open flame, welding or the use of Class I or II liquids, and open parking garages, (for requirements, see Section 709) helispots.

Division 4. Ice plants, power plants, pumping plants, cold storage and creameries, factories and workshops using non-combustible and non-explosive materials, storage and sales rooms of non-combustible and non-explosive materials that are not packaged or crated in or supported by combustible material.

Group E Occupancies Defined

Division 1. Any building used for educational purposes through the 12th grade by 50 or more persons for more than 12 hours per week or four hours in any one day.

Division 2. Any building used for educational purposes through the 12th grade by less than 50 persons for more than 12 hours per week or four hours in any one day.

Division 3. Any building or portion thereof used for day-care purposes for more than six persons.

The number of pupils shall be based on the average daily attendance of pupils at the school during the preceding fiscal year computed in accordance with Education Code of the State of California; provided, however, where the school has had no attendance during the preceding fiscal year, the average daily attendance for the year for which the fee is to be paid shall be based upon our estimated attendance provided by the school.

Group H Occupancies Defined

Division 1.1 Explosives, blasting agents, fireworks and black powder.

Division 1.2 Unclassified detonatable organic peroxides.

Division 1.3 Class 4 oxidizers.

Division 1.4 Class 4 or Class 3 detonatable unstable (reactive) materials.

Division 2.1 Class I organic peroxides.

Division 2.2 Class 3 nondetonatable unstable (reactive) materials.

Division 2.3 Pyrophoric gases.

Division 2.4 Flammable or oxidizing gases.

Division 2.5 Class I, II or III-A flammable or combustible liquids which are used in normally open containers or systems or in closed containers pressurized at more than 15 pounds per square inch gauge.

Division 2.6 Combustible dusts in suspension or capable of being put into suspension in the atmosphere of the room or area.

Division 2.7 Class 3 oxidizers.

Division 3.1 Class II, III or IV organic peroxides.

Division 3.2 Class 1 or 2 oxidizers.

Division 3.3 Class I, II or III-A flammable liquids or combustible liquids which are utilized or stored in normally closed containers or systems and containers pressurized at 15 pounds per square inch gauge or less and aerosols.

Division 3.4 Class Ill-B combustible liquids.

Division 3.5 Pyrophoric liquids or solids.

Division 3.6 Water reactives.

Division 3.7 Flammable solids, including combustible fibers or dusts, except for dusts included in Division 2 occupancies.

Division 3.8 Flammable or oxidizing cryogenic fluids (other than inert).

Division 3.9 Class I unstable (reactive) gas or Class 2 unstable (reactive) materials.

Division 4 Repair garages not classified as Group B, Division 1 Occupancies.

Division 5 Aircraft repair hangars and heliports not classified as Group B, Division 3 Occupancies.

Division 6 Semiconductor fabrication facilities and comparable research and development areas when the facilities in which hazardous production materials (HPM) are used and the aggregate quantity of materials are in excess of those listed in Table No. 9-A or 9-B. Said facilities and areas shall be designed and constructed in accordance with Section 911.

Division 7.1 Corrosives.

Division 7.2 Toxic and highly toxic materials.

Division 7.3 Irritants.

Division 7.4 Sensitizers.

Division 7.5 Other health hazards.

Group I Occupancies Defined

Division 1.1 Nurseries for the full-time care of children under the age of six (each accommodating more than five persons). Hospitals, sanitariums, nursing homes with non-ambulatory patients and similar buildings (each accommodating more than five persons).

Division 1.2 Health care centers for ambulatory patients receiving outpatient medical care which may render the patient incapable of unassisted self-preservation (each tenant space accommodating more than five such patients).

Division 2 Nursing homes for ambulatory patients, homes for children six years of age or over (each accommodating more than five persons).

Division 3 Mental hospitals, mental sanitariums, jails, prisons, reformatories and buildings where personal liberties of inmates are similarly restrained.

Section 5.20.050 Service Charges Other: Occupancies.

Those occupancies not classified in 5.20.040 shall be evaluated by the general manager using comparable occupancy standards to determine the appropriate number of EDUs. Provided, however, that in no case shall EDUs assigned by the general manager be less than 1.0.
