§ 5.16.020. Declaration of graffiti as public nuisance.

Pursuant to California Government Code Section 38771, the city council hereby declares the following conditions to constitute a public nuisance:

A. Graffiti or other inscribed material on a building, structure, tree, shrub, sidewalk, curb or vehicle in the city that is visible from any real property (whether privately or publicly owned), public street, sidewalk, alley, or other public right-of-way or other area open to the public;

B. The existence of any surface of a building, structure, tree, shrub, curb or vehicle in the city which has been defaced with graffiti or other inscribed material after removal more than three times in any twelve-month period ("graffiti prone structure or surface").
