§ 53.1001 Purpose.

This Chapter is intended to support the South Coast Air Quality Management District’s (SCAQMD) imposition of the vehicle registration fee and to bring the County into compliance with the requirements set forth in Health and Safety Code § 44243 in order to receive fee revenues for the purpose of implementing programs to reduce air pollution from motor vehicles.

§ 53.1002 Definitions.

As applied in this Chapter, the following words and terms shall be defined as follows:

FEE ADMINISTRATOR. The County Auditor/Controller.

MOBILE SOURCE AIR POLLUTION REDUCTION PROGRAMS. Any program or project implemented by the County to reduce air pollution from motor vehicles pursuant to the California Clean Air Act of 1988 or the plan proposed pursuant to Health and Safety Code § 40460.

§ 53.1003 Receipt of Fees; Establishment of Trust Fund.

(a) Vehicle registration fees due pursuant to this ordinance disbursed by the SCAQMD and remitted to the County shall be accepted by the Fee Administrator.

(b) Upon receipt of vehicle registration fees, the Fee Administrator shall be responsible for placement of such funds into a separate account as hereinafter specified.

(c) The County will establish a separate interest-bearing Air Quality Improvement Trust Fund where the Fee Administrator will place the funds. Interest earned by the Trust Fund shall be credited to that fund and shall be used to finance mobile source air pollution reduction programs.

§ 53.1004 Use of Air Quality Improvement Trust Fund.

All funds disbursed by SCAQMD and deposited in the Air Quality Improvement Trust Fund shall be used exclusively for mobile source air pollution reduction programs.

§ 53.1005 Audits.

The County consents to audits of all programs and projects funded by the Air Quality Improvement Trust Fund, at least once every two years.
