45.0402 Supplementary to State Law.

§ 45.0401 Permit Revocation: Appeal Rights.

Any decision or action of the issuing authority made pursuant to Division 5 of this Code may be appealed in writing by letter addressed to the Clerk of the Board of Supervisors, within ten days of the decision or action from which such appeal is taken. Within ten days of such appeal the Board of Supervisors shall hear and determine such appeal; the matter may be continued for reasonable cause. The burden shall be on the permittee or person, to prove that the decision or action in question was arbitrary or capricious or an abuse of discretion. The hearing before the Board of Supervisors shall be noticed in writing to the permittee and the issuing authority five days in advance of such hearing. That Board may reverse the decision or action of the issuing authority or may affirm it. (Ord. 1604, passed - -1970)

§ 45.0402 Supplementary to State Law.

The provisions of Division 5 of this Code are intended to apply in addition to, and to be supplementary to, the provisions of Health and Safety Code §§ 12000 et seq., Vehicle Code §§ 31600 et seq., and the Administrative Code §§ 1500 et seq. The Board of Supervisors finds that the provisions of Division 5 of this Code are not in conflict with the aforementioned State law, and each of the provisions of the laws mentioned in this Section shall be operative in such a manner that is consistent and reasonable with each and every other provision of law hereof. (Ord. 1604, passed - -1970) Editor’s note: Administrative Code §§ 1500 has been partially repealed. Code users should now refer to Administrative Code Title 19, Chapter 10, Subchapter 2 (commencing with § 1550).
