§ 9.01.001 ALCOHOLIC BEVERAGES; DEFINED.

As used in this chapter, an ALCOHOLIC BEVERAGE means and includes alcohol, spirits, liquor, wine, beer and every liquid or solid containing alcohol, spirits, wine or beer, and which contains 0.5% or more of alcohol by volume, and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.

§ 9.01.002 SAME; CONSUMING IN CERTAIN PUBLIC PLACES; GENERALLY.

Except as provided in § 9.01.003, no person shall consume an alcoholic beverage in the following particularly described public areas of the county:

(A) The Veterans’ Memorial Park area located east of Memorial Drive, more particularly described as follows.

(1) Parcel one. Beginning at a point in the centerline of the Hillcrest Road distant thereon south 87 degrees 00' east 18.115 chains from the corner common to Homestead Lots 26, 27, 34 and 35; thence from such point of beginning south 2 degrees 21' west 19.627 chains to an iron pipe; thence north 87 degrees 04' west 10.193 chains to an iron pipe; thence north 2 degrees 21' east 19.64 chains to a point in the centerline of the Hillcrest Road; thence along such centerline south 87 degrees 00' east 10.193 chains to the point of beginning, containing 20.00 acres more or less.

(2) Parcel two. Beginning at a point in the line common to land of Catherina Renz and Lima, distant along such line north 2 degrees 55' east 835.80 feet from the common corner to such lands in the centerline of the Sunnyslope Road, being distant along such centerline south 87 degrees 00' east 1187.00 feet from the most southwesterly corner of said Homestead Lot 35; thence from such point of beginning along the line common to lands of Renz and Lima north 2 degrees 55' east 965.10 feet to the most northeasterly corner of land of Catherina Renz; thence along the northerly line of land of Catherina Renz north 86 degrees 32' west 610.60 feet to the most northwesterly corner thereof; thence along the westerly line thereof south 2 degrees 55' west 965.10 feet; thence south 86 degrees 32' east 610.60 feet to the point of beginning.

(B) The portion of Veterans’ Memorial Park located west of Memorial Drive, more particularly described as follows: The portion of Parcel 2 described in division (A) above, consisting of the children’s play equipment area (tot lot) and the portion of Parcel 2 consisting of a parking lot located immediately adjacent to, and north of, the tot lot (up to the cyclone fence bordering the picnic area).

§ 9.01.003 SAME; SAME; PUBLIC EVENTS.

The Board of Supervisors of the county may waive the provisions of § 9.01.002 when the portions of Veterans’ Memorial Park are to be used for public events conducted or sponsored by the county, the City of Hollister, a veterans organization of the county or a non-profit organization located within the county. The waiver may be granted only at a regular meeting of the Board of Supervisors and shall apply only to the dates expressed in the waiver.

§ 9.01.004 ASSEMBLIES AND THE LIKE; NEAR FIRES, EARTHQUAKES, DISASTERS AND THE LIKE.

No persons shall gather, collect, assemble or congregate within 1,000 feet of the scene of any fire, bombing, act of sabotage, accident, explosion, flood, riot, earthquake or any emergency when any authorized emergency vehicle is actively engaged thereat.

§ 9.01.005 LOITERING; IN ENTRANCES TO PUBLIC PLACES.

No person shall loiter, stand or sit in or at the entrance of, or approach to, any church, hall, theater, park or place of public assemblage so as to in any manner obstruct the entrance or approach.

§ 9.01.006 SEDITIOUS LANGUAGE.

No person shall utter, publish or use any seditious language, words, remarks or epithets, or address to another any such language, words, epithets, which create or provoke, or tend to create or provoke, a breach of the peace.

§ 9.01.007 SOLICITING BY FIRMS RENDERING ASSISTANCE TO MOTOR VEHICLES ON PUBLIC HIGHWAYS.

It is unlawful for any person, firm or corporation to solicit patronage for or on behalf of any person, firm or corporation engaged in the business of rendering assistance to motor vehicles upon or along any public highway within the county.

§ 9.01.011 PROTECTION OF SHERIFF’S OFFICE CANINE UNITS.

It is unlawful for any person to wilfully or maliciously torture, tease, torment, beat, kick, strike, mutilate, injure, disable or kill any dog used by the San Benito County Sheriff’s Office, or in the custody of the department or its designated handlers while any such dog is in the performance of the functions or duties of the Sheriff’s Office or to wilfully interfere with any such dog while it is being used in the performance of any of the functions or duties of the Department. Any person violating the provisions of this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not exceeding $500 or by imprisonment in the county jail not to exceed six months, or by both the fine and imprisonment.
