§ 23.11.001 GENERAL.¶
The form, contents, submittal, approval and recording of parcel maps shall conform to the provisions of the Subdivision Map Act and this chapter. (1966 Code, § 17-38) (Ord. 617, § 2(part))
§ 23.11.002 SURVEY REQUIRED.¶
An accurate and complete survey of the land to be subdivided or information based upon compiled data from recorded or filed data when sufficient survey information exists on filed maps to locate and retrace the exterior boundary lines of the parcel map if the location of at least one of the boundary lines can be established from an existing monumented line shall be made by a registered civil engineer or licensed land surveyor in accordance with Cal. § 23.11.003 FORM AND CONTENTS.¶
The form and contents of the parcel map shall conform to the requirements regarding the form and contents of final maps set forth in §§ 23.09.004 and 23.09.005. (1966 Code, § 17-40) (Ord. 617, § 2(part))
§ 23.11.004 SUBMITTAL FOR COUNTY APPROVAL.¶
The subdivider shall submit prints of the parcel map to the County Engineer for review. The prints shall be accompanied by copies of the data, plans, reports and documents as required for final maps by § 23.09.006. The County Engineer may waive any of the informational requirements of § 23.09.006 if the location and nature of the proposed subdivision does not justify compliance with the requirements of that section. § 23.11.005 REVIEW AND APPROVAL BY COUNTY ENGINEER.¶
(A) The County Engineer shall review the parcel map and any other required information and the subdivider shall make corrections and/or additions until acceptable to the County Engineer. (B) The subdivider shall submit to the County Engineer the original tracing of the map and any duplicates per county requirements, corrected to its final form and signed by all parties required to execute the certificates on the map. (C) The County Engineer shall approve the parcel map if the county has previously approved a tentative map for the proposed subdivision and if the County Engineer finds that the parcel map is in compliance with the requirements of the Subdivision Map Act, this title, the previously approved tentative map and all conditions thereof. The County Engineer may accept or rejects offers of dedication made by a statement on the map and may execute improvement agreements and/or deferred agreements. § 23.11.006 RECORDING WITH THE COUNTY RECORDER.¶
Upon approval of the parcel map by the County Engineer, the map shall be transmitted to the County Recorder and recorded. (1966 Code, § 17-43) (Ord. 617, § 2(part))
§ 23.11.007 CORRECTION AND AMENDMENT.¶
A parcel map that has been recorded in the office of the County Recorder may be corrected or amended in accordance with the provisions of § 23.09.011. (1966 Code, § 17-44) (Ord. 617, § 2(part))
§ 23.11.008 WAIVER OF PARCEL MAP.¶
(A) The Planning Commission may, in its discretion, waive the requirements for a parcel map for any of the following reasons: (1) Division of real property resulting from the conveyance of land or any interest therein to or from the county, public entity or public utility for a public purpose, such as school sites, public building sites or rights-of-way or easements for streets, sewers, utilities, drainage and the like; (2) Division of real property which has been merged pursuant to this title, the Subdivision Map Act or any prior ordinance of the county; (3) Construction of a condominium project on a single parcel; and (4) Any other subdivision of real property which would otherwise require a parcel map. (B) The Planning Commission shall make a finding that the proposed subdivision of land complies with requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other requirements of the Subdivision Map Act, this title, this code and the general plan. (C) Upon waiver of the parcel map requirements and submittal of the required information, the County Engineer shall prepare a certificate of compliance for the land to be subdivided, in accordance with § 23.23.003, and a plat map showing the division prepared by the applicant’s engineer. The certificate shall include a certificate by the county’s Tax Collector in accordance with § 23.09.006. (D) A waiver by the Planning Commission may be conditioned to provide for, among other things, payment by the subdivider of parkland dedication, drainage and other fees that are permitted by law by a method approved by the Planning Commission.
