5.80.180 Places of business.¶
No pawnbroker or secondhand dealer shall transact business except upon the premises indicated on his or her license. (Prior code § 28.03.030)
5.80.190 Pawnbroker hours.¶
No pawnbroker shall transact any loan on Sunday, nor on any other day between the hours of seven p.m. and seven a.m. Retail sales shall not be limited by this section. (Prior code § 28.03.031)
5.80.200 Holding period.¶
No secondhand property purchased by any pawnbroker or secondhand dealer shall be resold for a period of ten (10) days from receipt of the property. No secondhand property purchased by any junk dealer shall be removed from his principal place of business for a period of forty-eight (48) hours from receipt of the property. (Prior code § 28.03.032)
5.80.210 Transaction with minors.¶
No pawnbroker, secondhand dealer or junk dealer or person in the employ of such dealer shall receive or purchase any property from or make any loan to anyone under eighteen (18) years of age. (Prior code § 28.03.033)
5.80.220 Records.¶
A. All pawnbrokers who receive in pawn, trade, purchase or on consignment, or any secondhand dealer or junk dealer shall, at the time of receiving, purchasing or taking in trade, or receiving on consignment any article, place the description of the article upon a form which he or she shall provide and which shall be approved by the chief of police. The form shall provide for the description of the article as well as the person selling, trading, pawning or consigning the article or merchandise. The pawnbroker, secondhand dealer or junk dealer shall fill in the blanks on the form provided for such information at the time each transaction is made. Each form shall be consecutively numbered. All information shall be legible and in English.
B. Such forms shall be retained for a period of three years. Copies of all loans and purchases made by any pawnbroker, secondhand dealer or junk dealer shall be retained for a period of three years. (Prior code § 28.03.034)
5.80.230 Tagging property.¶
Any pawnbroker or secondhand dealer receiving any article or merchandise in pawn, by purchase, taking in trade or on consignment shall affix to the article a tag which shall contain a number that shall correspond to the transaction number on the reporting form. (Prior code § 28.03.035)
5.80.240 Reporting.¶
Every pawnbroker and secondhand dealer shall deliver to the chief of police every business day before noon all forms which were used by him or her on the preceding business day. All forms shall be completely filled out as provided in this chapter. (Prior code § 28.03.036)
5.80.250 Employees.¶
No pawnbroker, secondhand dealer or junk dealer shall employ anyone under the age of eighteen (18) to make purchases or loans, or accept property in trade or on consignment. (Prior code § 28.03.037)
5.80.260 Other persons dealing in secondhand personal property.¶
Any person who receives secondhand personal property for resale (other than as a trade-in on new personal property) shall comply with the provisions of Sections 5.80.200, 5.80.220, 5.80.230 and 5.80.240 of this code. (Prior code § 28.03.038)
