5.108.280 Violation-Penalty.

A. In addition to any other remedy allowed by law, any person who violates a provision of this chapter is subject to criminal sanctions, civil actions, and administrative penalties pursuant to chapter 1.28.

B. Violations of this chapter are hereby declared to be a public nuisance.

C. Any person who violates a provision of this chapter is liable for civil penalties of not less than $250 or more than $25,000 for each day the violation continues.

D. Any person violating any provision of this chapter, other than sections 5.108.070, 5.108.080, 5.108.110 and 5.108.120, is guilty of a misdemeanor.

E. Notwithstanding subsection A, above, any person violating sections 5.108.070, 5.108.080, 5.108.110, or 5.108.120 is not subject to criminal sanctions. (Ord. 2025-0006 § 1; Ord. 2010-021 § 4; Ord. 2003-056 § 1)

5.108.290 Cumulative remedies, procedures and penalties.

All remedies prescribed under this chapter are cumulative and the election of one or more remedies does not bar the city from the pursuit of any other remedy to enforce this chapter. (Ord. 2025-0006 § 1; Ord. 2003-056 § 1)
