12.88.010 Definitions.

The following definitions shall apply in the interpretation of this article:

"Aircraft and engine repair shop operator" means any person who rents or leases from the city a building or space in a building that has been specifically designated as an aircraft and engine repair shop.

"Airman" means any person certified by the federal aviation agency to engage in commercial flying, student instruction, aircraft and engine servicing and repairing, and parachute rigging.

"Airport" means the Sacramento Executive Airport.

"Airport concessionaire" means any person who engages in retail sales and serving of meals, soft drinks, liquors, candy, tobacco, vending machines, etc.

"Airport manager" means the manager of the Sacramento Executive Airport or his or her duly authorized representative.

"City" means the city of Sacramento.

"City manager" means the manager of the city.

"Control tower" means the Federal Aviation Agency air traffic control tower located in the terminal building at the Sacramento Executive Airport.

"Council" means the city council of the city.

Federal Aviation Agency. For the purpose of these regulations, the abbreviation FAA may be used instead of Federal Aviation Agency.

"Fixed base operator" means any person who rents or leases facilities, such as office space, classrooms or storage space for aircraft from the city, and who engages in the operation of aircraft for hire or reward using this airport as an operating base. (Prior code § 4.02.020)

12.88.020 Purpose of operating airport.

The Sacramento Executive Airport shall be operated as a terminal facility for the promotion and accommodation of commerce and navigation, and shall be operated as a public air terminal. (Prior code § 4.02.021)

12.88.030 Hours of operation.

The airport shall be open for public use at all hours of the day, subject to such restrictions as inclement weather, the condition of the landing area, the presentation of special events, and like causes, as may be determined by the airport management. (Prior code § 4.02.022)

12.88.040 Special services and facilities-Permit or license required for certain activities.

Special services may be rendered, or special facilities may be provided on such terms as the city may prescribe from time to time. No person shall use the airport as a base for the carrying on of commercial activities, for the carrying for hire of passengers, freight express or mail, for instruction in aviation in any of its branches, for the sale of fuels, refreshments or any commodity, or for any other commercial purpose, unless written permission or license to do so has been granted by the city. 12.88.050 Application for permission to conduct certain businesses-Payment of fees and charges.

Any person wishing to use the airport as a base for conducting a business or engaging in any form of commercial activity shall first make application in writing and secure permission from the airport manager, and shall pay such fees and charges established by resolution of the city council for the use of the airport or any of its facilities thereon, or for services rendered. 12.88.060 Application for permission to use airport for purpose of utilizing…

Any person wishing to use the airport for the purpose of utilizing the professional skill of himself or herself or his or her employees, for remuneration or reward, shall first make application in writing, and secure permission from the airport manager, and shall pay such fees and charges therefor as established by resolution of the city council for the use of the airport, its facilities, or for services rendered. 12.88.070 Limitation on number of fixed base operators.

Fixed base operators may be limited in number consistent with space availability, or other limiting factors which may be dictated by good business practices in airport operations. Such limitations or restrictions are subject to approval by the city manager.

Fixed base operators or other business firms shall not engage in any commercial activity on the airport other than that for which he or she has received official approval from the airport manager. (Prior code § 4.02.026)

12.88.080 Area for aircraft and engine repair-Limitation in number of shops.

Aircraft and engine repair shall be conducted in such areas and buildings as are specifically provided for such purposes at the airport. Any exceptions to this rule will require special permission from the airport manager or his or her authorized representative. Aircraft and engine repair shops and radio shops may be limited in number at the discretion of the airport manager subject to the approval of the city manager.

All repairs to aircraft and engines shall be made in the space designated for this purpose, and not on the area reserved for landing and taking off, or in any other area not approved or designated by the airport manager. (Prior code § 4.02.027)

12.88.090 Service and repair work by private aircraft owners-Mechanics to be employed by approved shops.

It is not the intent of this regulation to restrict private aircraft owners from doing service and repair work on their own aircraft at the airport. However, aircraft and engine mechanics not employed by the approved shops on the airport will be prohibited from doing any repair work on aircraft or engines. (Prior code § 4.02.028)

12.88.100 Approval of shop operators required-Exception to factory-dealer service.

No operator, firm or individual not approved as a shop operator will be permitted to engage in the repair, service, overhaul or maintenance of aircraft or engines on the municipal airport for remuneration or reward. The only exception to the above shall be in the case of aircraft dealers who are required by the factory they represent to provide certain limited service for a prescribed length of time on new aircraft sold by them. In this case, factory-dealer service only will be permitted. Authorization for such factory-dealer service shall be submitted to the airport manager for approval. (Prior code § 4.02.029)

12.88.110 Application to engage in commercial or sales operations.

An operator on the airport who desires and proposes to engage in any commercial or sales operation other than those for which he or she has approval will be required to make written application to the airport manager. The application shall clearly state in detail the nature of the business proposed and the space to be utilized for the purpose. (Prior code § 4.02.030)

12.88.120 Containers for garbage, rubbish, waste, etc., and removal thereof.

Airport tenants shall provide suitable metal receptacles, with covers, for the storage of all garbage, waste, rubbish or refuse, which shall be removed at the tenants' expense weekly, or more frequently if deemed necessary by the airport manager. (Prior code § 4.02.031)

12.88.130 Compliance with rules and regulations required-Enforcement of…

It is further ordered by the council that all fixed base operators, aircraft and engine repair shop operators, concessionaires and airmen at the airport shall abide by the rules and regulations as herein announced and also all other persons having business at the airport shall be guided accordingly, and it shall be the duty of the airport manager to enforce the same and to terminate the rights and privileges of any person on the airport premises failing to abide by them.

No person shall navigate any aircraft over, land upon or take off from, or service, repair or maintain any aircraft on the airport, or conduct any operation on or from the airport, otherwise than in conformity with these rules and regulations and those of the FAA. (Prior code § 4.02.032)

12.88.140 Payment for storage, etc., prior to granting clearance.

Payment for storage, repairs, supplies and other services rendered by the airport shall be made before clearance will be granted, unless other satisfactory arrangements have been made. (Prior code § 4.02.033)

12.88.150 Payment in advance of charges for ground rental, hangar storage, etc.

All charges for ground rental, hangar storage, commercial fees, etc., shall be paid in advance, unless an otherwise satisfactory arrangement has been made with the airport manager. (Prior code § 4.02.034)

12.88.160 Obligation of user of airport to obey regulations.

The use of the airport or any of its facilities, in any manner, shall create an obligation on the part of the user thereof to obey all the regulations herein provided. (Prior code § 4.02.035)

12.88.170 Responsibilities and risks of user of airport-Maintenance of airport by city…

The privilege of using the airport and its facilities shall be conditioned upon the assumption of full responsibility and risk by the user thereof, and he or she shall release, hold harmless and indemnify the city, its officials and employees, from any liability or loss resulting from such use, as well as against claims of third persons, as against those of the person so using the airport. The exercise of the privilege of use shall constitute an acknowledgment that the city maintains such airport in a governmental capacity. (Prior code § 4.02.036)

12.88.180 Adoption of FAA and air traffic rules.

The FAA and air traffic rules promulgated by the FAA of the United States government presently in effect or hereafter amended are referred to, adopted and made a part of the regulations, as fully in all respects as if particularly set forth herein. (Prior code § 4.02.037)

12.88.190 Certification of persons and aircraft by FAA.

No person, not properly certified by the FAA, and no aircraft not similarly certified, shall operate on or within the control zone of the Sacramento Executive Airport. (Prior code § 4.02.038)

12.88.200 "Violation" and "irregularity" reports against pilots.

Pilots are subject to "violation" and "irregularity" reports being filed against them for failure to comply with FAA rules and regulations while on the airport or within a five-mile radius thereof. (Prior code § 4.02.039)

12.88.210 Records to be kept by companies, etc., operating at airport.

Every company or organization operating at the airport shall maintain an up-to-date file, containing the name, address, telephone number and occupation of all employees, pilots and owners of aircraft based on its premises. This information shall be available to the airport manager upon request. (Prior code § 4.02.040)

12.88.220 Written permission required to use aircraft, parts, instruments, etc., of another.

No person shall take or use any aircraft, aircraft parts, instruments or tools thereof owned, controlled or operated by any other person while such aircraft parts, instruments or tools are stored, housed or otherwise left on the airport or within its hangars without the written consent of the owner or operator thereof, or satisfactory evidence of the right to do so duly presented to the airport manager. 12.88.230 Authority of airport manager in handling, etc., public at airport.

The airport manager shall have authority to take such steps as may be necessary for the handling, policing and protection of the public while present at the airport, subject to the review of the city manager. (Prior code § 4.02.042)

12.88.240 Payment for damages to facilities.

Damages to field lighting or other airport facilities shall be paid by the operator, pilot or other person responsible therefor. (Prior code § 4.02.043)

12.88.250 Responsibility of pilots for guests.

Pilots and aircraft owners will be held responsible for the observance of all airport rules by individuals accompanying them to aircraft area or the airport as their guests. (Prior code § 4.02.044)

12.88.260 Soliciting or canvassing at airport.

No soliciting or canvassing, by any individual or agency, will be permitted within the confines of the airport or buildings thereon without prior approval of the airport manager. (Prior code § 4.02.045)

12.88.270 Sale of gasoline, oil, etc.

Aviation gasoline, lubricating oil or grease shall not be sold to pilots of itinerant aircraft, or aircraft based on this airport, except by the company holding valid agreements with the city for such purposes. (Prior code § 4.02.046)

12.88.280 Advertisements, signs, etc.

No advertisements, signs or placards shall be erected, painted or placed on the airport premises without permission of the airport manager. (Prior code § 4.02.047)

12.88.290 Disposal of wrecked aircraft.

The aircraft owner, his or her pilot or agent shall be responsible for the prompt disposal of wrecked aircraft and the parts thereof, to avoid all interference with field operations, unless directed to delay such action pending investigation of the accident. (Prior code § 4.02.048)

12.88.300 Reports of accidents.

Witnesses of and participants in accidents on or near the airport shall be required to report to the administration office as soon after the accident as possible, leaving their names and addresses, and rendering such reports as may be required. (Prior code § 4.02.049)

12.88.310 Establishing and posting charges by fixed base operators.

Fixed base operators, engaged in student training, charter flights, aircraft rental, etc., shall be required to establish uniform charges, rates and rentals, and to post same in a conspicuous place designated by the airport manager. (Prior code § 4.02.050)

12.88.320 Radios required on aircraft.

All aircraft based at or operating from the Sacramento Executive Airport shall be equipped with an approved-type radio receiver in good condition and capable of reading the control tower when operating within the airport traffic control zone. (Prior code § 4.02.051)

12.88.330 Tail and nose wheels on aircraft.

All aircraft operating on, from or within the boundary of the airport shall be equipped with an approved type tail or nose wheel. The operation of aircraft equipped with tail skid is prohibited. (Prior code § 4.02.052)

12.88.340 Loading and unloading of common carrier vehicles or vehicles for hire.

No common carrier vehicle or vehicle for hire shall load or unload passengers or stand at the airport at any place other than in the area designated by the airport manager. (Prior code § 4.02.053)

12.88.350 Parking of automobiles, trucks, etc.

The parking of automobiles, trucks and other surface vehicles at the airport shall be in accordance with established procedures as indicated by standard parking signs, curb colors and other recognized designations. Violations are subject to the same procedures in effect on city streets and other public areas. (Prior code § 4.02.054)

12.88.360 Operation of vehicles and mobile equipment on terminal building apron or aircraft parking apron.

No person shall operate any motor vehicle or mobile equipment on the apron of the terminal building, or aircraft parking apron, or in the hangar area, except:

A. Persons assigned to duty thereon, which duty requires such person to operate a motor vehicle or other mobile equipment.

B. Persons authorized by the airport manager. (Prior code § 4.02.055)

12.88.370 Duty of drivers of equipment on landing area.

Drivers of automotive equipment, operating on any part of the landing area, will drive cautiously, with due regard for the safety of aircraft, other vehicles and persons using the airport. (Prior code § 4.02.056)

12.88.380 Speed limit of vehicles and mobile equipment.

All motor vehicles and mobile equipment shall be operated at the airport in strict compliance with posted traffic signs and in no case at a speed in excess of twenty-five (25) miles per hour. (Prior code § 4.02.057)

12.88.390 Prohibited acts at airport.

No person shall commit any disorderly, obscene, indecent or unlawful act or commit any nuisance on the airport. (Prior code § 4.02.058)

12.88.400 Gambling prohibited.

No person shall conduct gambling in any form or operate gambling devices anywhere on the airport. (Prior code § 4.02.059)

12.88.410 Placing garbage, etc., in containers-Use of lavatories.

Garbage, papers and refuse or other material at the airport shall be placed in receptacles provided for that purpose. No person shall use a lavatory other than in a clean and sanitary manner. (Prior code § 4.02.060)

12.88.420 Damaging, etc., buildings, equipment, etc.-Trespassing prohibited.

No person shall destroy, injure, deface or disturb in any way any building, sign, equipment, marker or other structure, tree, flower, lawn or other public property on the airport. No person shall trespass on lawns and seeded areas on the airport. (Prior code § 4.02.061)

12.88.430 City not responsible for certain damages, etc.

The city, its agents or employees operating the airport assumes no responsibility for damage to property stored thereon or property thereon of persons using the airport facilities, by reason of fire, theft, vandalism, windstorm, flood, earthquake or collision, nor does it assume any liability by reason of injury to persons while on the airport or while using the facilities of same. 12.88.440 Abandonment of personal property prohibited.

No person shall abandon any personal property on the airport. (Prior code § 4.02.063)

12.88.450 Carrying or possessing firearms, explosives, etc., at airport restricted.

No persons, except duly authorized peace officers, post office, airport and air-carrier employees or members of the armed forces of the United States on official duty, shall carry any firearms, explosives or inflammable materials on the airport without the written permission of the airport manager. All persons other than the excepted classes shall surrender all such objects in their possession to the first officer or guard on the airport. (Prior code § 4.02.064)

12.88.460 Restriction on presence of dogs.

No person shall enter the terminal building or landing area of the airport with a dog or other animal except a seeing-eye dog. Dogs and other animals may be permitted in other areas of the airport if restrained by leash or confined in such manner as to be under control. (Prior code § 4.02.065)

12.88.470 Issuance of special rules and regulations by manager.

The airport manager may, at his or her discretion, and as necessity demands, issue special rules or regulations. Such rules will be subject to the approval of the city manager. A disregard or violation of such special rules or regulations will make the violator subject to the following penalties. (Prior code § 4.02.066)

12.88.480 Violations-Penalty.

It is unlawful for any person to violate or refuse to obey any of the foregoing rules and regulations:

Any person operating or handling any aircraft or motor vehicle in violation of these rules, or refusing to comply with same, may be removed or ejected from the airport, or may be temporarily grounded by, or under the authority of, the airport manager, and may be deprived of the further use of the airport and its facilities, for such length of time as may be deemed necessary to insure the safeguarding of the same and the public and its interest therein. 12.88.490 Change of name of municipal airport.

The Sacramento Municipal Airport is renamed the Sacramento Executive Airport. As used in this chapter, the term Sacramento Executive Airport shall be synonymous with the term Sacramento Municipal Airport. (Prior code § 4.02.068)
