12.44.130 Permit for use of mall-Required.

The city manager may, in accordance with the provisions of this article, grant permits for special events for the use of a mall during specified hours. The term "special events" as used in this chapter shall include organized community activity of either a commercial or noncommercial nature proposed to be conducted upon a mall, which in the opinion of the city manager, could be conducted upon a mall and not interfere with the health, safety or welfare of the community, or the owners' properties fronting a mall, and which would promote education, community spirit, bring interest to the districts of the city surrounding a mall, or stimulate any other worthwhile community enterprise. 12.44.140 Permit-Application.

Any person, group, or organization may submit an application to the city manager for a permit to use a mall for a special event. All such applications shall be submitted to the city manager at least twenty-one (21) days prior to the date on which the special event is to be held or to commence. (Prior code § 51.03.302)

12.44.150 Permit-Form.

Such applications shall contain the following information and statements:

A. Name of the applicant;

B. Nature of the event;

C. The date or dates and hours when the proposed special event is to take place and location of the event;

D. A brief statement describing how the special event is to be conducted and in what manner it will be beneficial to the mall and the community;

E. A statement that the applicant agrees to abide by all regulations governing the use of such mall and all conditions which may be imposed upon such use by the city manager in granting of the permit;

F. Such other information which the city manager may reasonably require. (Prior code § 51.03.303)

12.44.160 Permit-Processing.

All applications for special event permits shall be acted upon by the city manager within five days of the date when they are received by his or her office, and shall be either approved or denied. In approving an application for a special event, the city manager may impose such conditions upon the use of the mall in connection with such event as he or she shall deem to be reasonably necessary under the circumstances. 12.44.170 Appeal to council.

Any person aggrieved by the action of the city manager may appeal such action at the next meeting or any subsequent meeting of the city council, following such action. (Prior code § 51.03.305)

12.44.180 Revocation of permit.

All permits issued under this article shall be revocable at any time by the city manager for any violation of the regulations of the chapter or the conditions contained within the permits. (Prior code § 51.03.306)
