10.08.010 Authority of police and fire officers.

The police department: shall enforce the street traffic regulations of the city and all of the state vehicle laws applicable to street traffic in the city; shall make arrests for traffic violations; shall investigate traffic accidents; shall co-operate in the administration of the traffic laws and in developing ways and means to improve traffic conditions; and shall carry out those duties especially imposed upon the department by this chapter and other ordinances of the city. A suitable system of filing traffic accident reports shall be maintained and a copy of each report shall be made available to the city traffic engineer.

Officers of the police department, or such persons as are assigned by the chief of police, are authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws. In the event of a fire or other emergency, or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic as conditions may require, notwithstanding the provisions of the traffic laws.

Officers and members of the fire department, when at the firehouse or at the scene of a fire, may direct, or assist the police in directing, traffic thereat or in the immediate vicinity.

Civilian employees of the city, when designated by the chief of police, shall enforce those provisions of this chapter and the Vehicle Code relating to the standing or parking of vehicles.

To the extent authorized by a memorandum of understanding executed by the chief of police in accordance with Penal Code Section 830.7, civilian employees of the Sacramento regional transit district shall enforce those provisions of this chapter and the Vehicle Code relating to the standing or parking of vehicles. 10.08.020 Traffic reports by police department to city manager.

The police department shall monthly and annually prepare a traffic report which shall be filed with the city manager. Such report shall contain information on traffic matters in the city as follows:

A. The number of traffic accidents, the number of persons killed, the number of persons injured and other pertinent traffic accident data as required on the National Safety Council Traffic Accident Summary.

B. The number of traffic accidents investigated, arrests made and other pertinent data on the activities of the traffic division. (Prior code § 25.01.003)

10.08.030 City traffic engineer-Office established.

The office of the city traffic engineer is established. The city traffic engineer shall be appointed by the city manager and shall exercise the powers and duties as provided in this title. (Prior code § 25.01.004)

10.08.040 City traffic engineer and parking manager-Powers and duties.

The city traffic engineer shall: determine the installation and proper timing and maintenance of traffic-control devices and signals; conduct engineering analyses of traffic accidents and devise remedial measures; conduct engineering investigation of traffic conditions and co-operate with other city officials in the development of ways and means to improve traffic conditions; and carry out the additional powers and duties imposed by this title and other ordinances of the city.

The parking manager shall manage and operate the public off-street parking facilities, direct parking studies of off-street and on-street parking needs, plans and facilities, and perform related duties. (Prior code § 25.01.005)

10.08.050 Obedience to orders given by officers.

No person shall wilfully fail or refuse to comply with any lawful order of a police officer or fire department official when such officer or official is directing traffic. (Prior code § 25.01.006)

10.08.060 School crossing guards.

The city traffic engineer shall determine and designate all locations where school crossing guards should be assigned or removed. All such determinations shall be based upon traffic engineering principles, studies and investigations. (Prior code § 25.01.007)

10.08.070 Unauthorized persons shall not direct traffic.

No person other than an officer of the police department or members of the fire department or a person authorized by Chapter 10.28 of this title or other law shall direct or attempt to direct traffic by voice, hand or other signal, except that persons may operate, when and as herein provided, any mechanical pushbutton signal erected by order of the city traffic engineer. 10.08.080 Vehicles to stop at crosswalk controlled by a signal device, school crossing…

It is unlawful for any person driving or operating, propelling, or causing to be propelled, any vehicle, to fail to stop at the nearest side of the crosswalk where any signal device, school crossing guard, or school safety patrol officer is stationed, giving warning that persons are about to or are crossing the street, and it is further declared unlawful to proceed until the signal device, school crossing guard, or school safety patrol officer indicates that it is proper to proceed. 10.08.090 Detours and construction.

No street shall be closed or detours established without approval of the city traffic engineer.

Barriers and signs shall be erected as directed by the city traffic engineer and shall be a type approved by the city traffic engineer.

The driver of any vehicle shall obey the instructions of any barricades or devices placed under the provisions of this section.

When responding to an emergency, public utility vehicles and city vehicles shall be exempt from the provisions of this section. (Prior code § 25.01.011)

10.08.100 One-way streets.

Whenever a city council resolution designates any street or alley as being limited to travel in one direction only, the city traffic engineer shall place and maintain signs giving notice thereof. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited.

When signs are erected on any one-way street or alley giving notice thereof, no person shall drive any vehicle in a direction contrary thereto. (Prior code § 25.04.063)

10.08.110 Disclosure by tow truck operators to vehicle operators.

Any person who is an operator of a tow truck within the city shall, upon request, disclose the operator's name, business address, and telephone number of his or her tow truck firm to any person who is the owner of, or who is legally entitled to drive, a vehicle which is about to be towed or is in the process of being towed by the tow truck operator. The tow truck operator shall also disclose, upon request, the location of the property to which the vehicle will be towed and the telephone number which can be called by the vehicle owner or operator to recover the vehicle. 10.08.120 Vehicle release fee.

Pursuant to authority provided in Vehicle Code Section 22850.5, the city adopts and imposes a vehicle release fee, in an amount to be set by resolution of the city council, for recovery of administrative costs incurred for vehicles towed and/or stored pursuant to the following Vehicle Code sections:

10.08.130 Violation-Penalty.

Except where otherwise specifically indicated in this title, violation of any provision of this title shall be an infraction punishable by fine in the sum set by the Judicial Council of the Municipal Court of the Sacramento Judicial District. (Prior code § 25.01.029)
