6.12.010 - Department includes other agencies.

The Department of Animal Control shall include the County of Los Angeles Department of Animal Control or any other agency, body or individual with whom the City shall have entered into a contract, or shall hereafter enter into a contract, for doing all things necessary and proper under this title.

6.12.020 - Director—Animal capture duties.

The Director shall capture and take into custody all of the following:

A. Unlicensed dogs;

B. Any other animal, wild or domestic, which by this title requires a permit or license, and which is unlicensed or does not have a permit;

C. Any animal being kept or maintained contrary to the provisions of this title or any other ordinance or State statute;

D. Dogs and other animals running at large contrary to the provisions of the Agricultural Code or any other State statute or of this title;

E. Sick, injured, stray, unwanted or abandoned animals;

F. Dogs which are unvaccinated in violation of this title;

G. Animals delivered by the owners to the Director, all title and interest in which is abandoned by such owners; and

H. Animals for which the owner or custodian is unable to care because of imprisonment, illness, bankruptcy, litigation, or other contingency, or in cases in which the owner or custodian cannot be found.

6.12.030 - Director—Animal pickup for County Health Officer.

The Director shall pick up or accept any animal to be held for observation by the County Health Officer.

6.12.040 - Director—Animal placement.

The Director shall place all animals which he takes into custody in the County Animal Shelters, or any other shelters designated by the City.

6.12.050 - Director—Dead animal disposal duty.

The Director shall pick up and dispose of all dead animals on streets and community facilities within the City where the owner is unknown, and also all dead animals at the request of the owner thereof, conditioned upon the payment of the fee set forth in Chapter 6.56.

6.12.060 - Director—Right of entry.

The Director, or any other officer or employee thereof, and any peace officer, shall have the right to enter upon any public or private property in the City, except a building designated for and used for residential purposes, for the purpose of examining or capturing any animal thereon or therein. Every person who denies or prevents, obstructs or attempts to deny, prevent or obstruct such access is guilty of a misdemeanor.

6.12.070 - Director—License and permit issuance.

The Director shall issue all licenses and permits required by this title and shall maintain those records required by this title and handle fees set forth in Chapter 6.56 in such a manner as prescribed by this title or the Los Angeles County Auditor-Controller.

6.12.080 - Director and employees designated Deputy Collectors.

For the purpose of issuing all licenses and permits required by this title and for no other purpose, the Director and each employee designated by the Director shall be appointed as Deputy Collectors, to serve as such without additional pay.

6.12.090 - Director—Penal Code enforcement duties.

It shall be the duty of the Director to enforce those sections of the Penal Code of the State of California pertaining to the inhumane treatment of animals and to take possession of animals so abandoned or neglected and care for or dispose of the same as provided for in the Penal Code of the State of California or this title.

6.12.100 - Director—Dog vaccination inspection powers.

For the purpose of discharging the duties imposed upon him by this title, the Director, in order to enforce the provisions thereof to take up and impound any unlicensed or unvaccinated dog, shall enter upon any premises upon which any dog is kept or harbored or upon which he has reason to believe any dog is kept or harbored and demand the exhibition by the person owning or having charge or control of any such dog, of the dog, of the required rabies vaccination certificate and the license or license tag for such dog for the current year provided for by this title. This section does not permit any person to enter any private dwelling except where necessary to rescue an animal.

6.12.110 - Failure to exhibit dog or certificate—Penalty.

Any person upon whom any demand is made under authority of this title for the exhibition of any dog, rabies vaccination certificate, any dog license or tag, or permit, who fails or refuses to exhibit the same, is guilty of a violation of this title and shall be punishable therefor as provided in this title.

6.12.120 - Authority to accept negotiable paper.

The Director, the County Clerk, and the Tax Collector, in their discretion, may accept negotiable paper as provided in Ordinance No. 409, entitled "The Administrative Code of the County of Los Angeles," adopted May 9, 1947, and subject to all of the provisions of Sections 25303.1, 25303.2, 25303.3, 25303.4, 25303.5 and 25303.6 of the Government Code.

6.12.130 - Interference with Department prohibited.

A person shall not interfere with, oppose or resist the Director or employee of the Department while such person is engaged in the performance of any act authorized by this title.

6.12.140 - Unauthorized removal of animal from custody prohibited.

A person shall not remove any animal from the custody of the Director, nor shall any person remove any animal from the County Animal Shelter, without first paying the necessary fees, as set forth in Chapter 6.56 or without receiving permission from the Director to do so.

6.12.150 - Appointment of Supervisory Animal Control Officers.

The Director, in conjunction with the County Veterinarian, may designate Supervisory Animal Control Officers who will be authorized to transport and operate tranquilizer gun equipment for use in the capture and seizure of animals in circumstances where there is imminent danger to life or public safety, or extreme property damage.

6.12.160 - Acts by deputies authorized when.

Whenever a power is granted to or a duty is imposed upon a public officer mentioned in this chapter, the power may be exercised or the duty may be performed by a deputy of the officer or by a person authorized pursuant to law by the officer, unless this title expressly provides otherwise.
