Editor's note— Ord. No. 743, § 3(Exh. A), adopted August 23, 2022, repealed the former Chapter 5.40, §§ 5.40.010—5.40.150, and enacted a new Chapter 5.40 as set out herein. The former Chapter 5.40 pertained to horse trainers and derived from Prior code §§ 769.23, 769.24, 769.25 (a)—(h), 769.26; Ord. No. 687, § 2, 5-22-2012.

5.40.010 - Definitions.

As used in this chapter:

"For compensation" means for a fee, reward, donation, loan or receipt of anything of value.

"Horse training" means and includes teaching or training horses to obey commands for the purpose of competition, show or sale, providing riding lessons, or teaching care and maintenance of horses.

"Trail riding" means providing horseback riding on public trails or bridle paths in the city.

5.40.020 - Permit—Required.

No person may conduct, engage in, carry on, practice, or operate any horse training or trail riding or cause the same to be done for compensation at any facility owned or operated by the city or on any public trail or bridle path without having first obtained a permit under this chapter.

5.40.030 - Permit—Application—Contents.

A. Form. Every person who, for compensation, conducts, engages in, carries on or operates any horse training or trailing riding at a city owned or operated facility or on any public trails or bridle paths in the city must file an application for a horse training/trail riding permit with the city manager. The application must be on the form provided by the city.

B. Hold Harmless. The applicant must sign and file with the city manager as part of the application a statement agreeing to hold the city, its officers and employees, free and harmless from any loss, damage or injury sustained, arising out of, or by virtue of the issuance of such horse training/trail riding permit or the use and operation thereunder. In addition, the applicant's statement must indicate the applicant's agreement that if any damage is done to any city property or equipment, the applicant, upon receipt of a city invoice, must reimburse the city for such damages and that should litigation be necessary to enforce such a claim in favor of the city, the applicant must pay to the city reasonable attorneys' fees as determined by the court if the city prevails in the litigation.

C. Insurance. The applicant must take out and maintain liability insurance, in the minimum amount of one million dollars issued by a carrier and in form satisfactory to the city, naming the city as am additional insured. Evidence of such insurance must be attached to the application.

5.40.040 - Permit—Approval—Findings.

Upon receipt of a complete application, the city manager will approve or conditionally approve the permit if the manager is able to make all the following findings:

A. All the information contained in the application and supporting data is true;

B. The applicant has paid the required business license tax; and

C. The applicant agrees to abide by and comply with all conditions of the permit and applicable laws.

5.40.050 - Permit—Denial—Reasons.

The city manager will provide written notice in person or by certified mail of the denial of any horse training/trail riding permit if any of the requirements set forth in Section 5.40.030 are not met, or if any of the finding in Section 5.40.040 cannot be made.

5.40.060 - Permit—Term.

The term of the permit will be for no more than the term of the business license. A renewal application must be filed no later than thirty days prior to the expiration of the permit and will be processed in the same manner as a new application.

5.40.070 - Compliance with public riding ring and public trail rules.

Every person who has a horse training/trail riding permit granted pursuant to this chapter must comply with the city's public riding ring rules and public trail riding rules, as applicable, that have been adopted by city council resolution.

5.40.080 - Permit—Carrying required.

Any person who has obtained a horse training/trail riding permit must keep a copy of the permit upon them at all times while engaging in horse training/trail riding at a city owned or operated facility or public trail or bridle path.

5.40.090 - Suspension.

A. The city manager may suspend any permit granted pursuant to this chapter for up to ninety days upon a finding that the permittee:

  1. Has violated any condition imposed upon the permit;

  2. Has violated any provision of this code; or

  3. Is, by the actual conduct of the activity, threatening the preservation of the public peace, safety or general welfare.

B. The city manager must provide the permittee with written notice of such permit suspension and the length of such suspension by personal delivery or by certified mail. The suspension notice must set forth all applicable grounds for the permit suspension. The suspension is effective on the date that the notice is personally delivered or mailed to the permittee.

5.40.100 - Revocation.

A. Permits issued pursuant to this chapter may be revoked upon the grounds set forth in Section 5.04.210 of this Code.

B. The procedure for the revocation and appeal of a decision of revocation of a permit issued under this chapter will be as set forth in Sections 5.04.220 of this code.

C. If a permit is revoked pursuant to this chapter, a new permit may not be issued to the permittee for a period of six months from the date the revocation goes into effect consistent with Section 5.04.230.

5.40.110 - Appeals.

Any person dissatisfied with the decision of the city manager with respect to the issuance, denial, suspension or revocation of a horse training/trail riding permit may appeal such decision in accordance with the procedures set forth in Chapter 1.16 (Appeals) of this Code.
