3.28.010 - Findings.¶
Since its incorporation, the city has paid substantial sums for capital improvements in the form of buildings, parks, recreation facilities, streets, safety devices and other assets. Any real property hereafter annexed to the city derives special benefit from this prior capital investment and the value thereof is accordingly enhanced. Such annexed real property should bear its fair share of the cost of capital improvements in existence at the time of annexation. Based upon the existing acreage of the city and the present estimated value of capital improvements, it is found and determined that real property annexed hereafter to the city would be benefited in the amount of one thousand five hundred dollars per acre.

3.28.020 - Imposed.¶
There is imposed upon each parcel of real property hereafter annexed to the city a capital improvements annexation fee in the amount of one thousand five hundred dollars per acre. Any annexation of less than one acre shall pay a minimum one thousand five hundred dollar fee. No fee will be payable for:
A. Any annexation aggregating less than one thousand square feet primarily designed as a boundary adjustment or property line correction;
B. With respect to any property owned by any public agency;
C. Any annexation which the city council finds provides offsetting benefits to the city and waives payment of the fee.

3.28.030 - Payment—Use of funds.¶
The fee shall be payable upon completion of the annexation. All sums collected pursuant to this chapter shall be deposited in the capital outlay fund and used solely for capital expenditures as needed.
