§ 16.06

The planning commission is designated as the advisory agency regarding major subdivisions under the Subdivision Map Act. It has the powers and duties provided in the Subdivision Map Act and this title including:

A.

Making investigations and reports on the design and improvement of proposed subdivisions and either imposing requirements and conditions on the subdivisions approved by the planning commission or recommending requirements and conditions on the subdivisions to be considered by the city council;

B.

For major subdivisions making recommendations to the city council for approval, conditional approval, or denial of applications for tentative maps;

C.

For minor subdivisions , acting as the appeal board for decisions of the subdivision committee;

D.

Acting as the appeal board for decisions of the city engineer or department; and

E.

Approving or denying an application for extensions of any approved tentative subdivision map.

The city council has the powers and duties provided by law and this title, including:

A.

Approving final subdivision maps and improvement agreements;

B.

Accepting land or improvements which are proposed for dedication;

C.

Acting as the appeal board for hearing appeals of planning commission actions, including actions on tentative maps;

D.

For major subdivisions, approving, conditionally approving or denying applications for tentative maps; and

E.

Establishing of any processing fees necessary to implement the provisions of this title.

16.06.030 - Subdivision committee.

The responsibilities of the committee include:

A.

Approving tentative parcel maps;

B.

Making investigations and reports on the design and improvement of any proposed minor subdivision.

16.06.040 - Department.

The responsibilities of the department include:

A.

Processing of tentative maps;

B.

Determining whether a proposed subdivision conforms to the general plan, any applicable specific plans, and the zoning ordinance;

C.

Making recommendations to the planning commission for recommendation of approval, conditional approval, or denial of a tentative subdivision map application (including recommendations of other departments and agencies) for a major subdivision;

D.

Sending proper notice of proceedings under this title;

E.

Preparing staff report and recommendations and certifying, as secretary of the subdivision committee, that the subdivision committee has approved, conditionally approved, or denied the tentative map for a minor subdivision;

F.

Scheduling, as secretary of the planning commission, any appeal to a decision on a parcel map, reversion to acreage, merger or lot line adjustment;

G.

Processing and approval, in consultation with the city engineer, of waiver of tentative parcel map, lot line adjustment, merger and certificate of compliance;

H.

Collection of all required application fees and deposits; and

I.

Determining violations of the Subdivision Map Act or this title.

16.06.050 - City engineer.

A.

The responsibilities of the city engineer include:

1.

Establishing design and construction details, standards and specifications for approval by the city council;

2.

Determining if proposed subdivision improvements comply with the Subdivision Map Act and this title;

3.

Examining and certifying that final and parcel maps are in substantial compliance with the approved tentative map; and the processing and certification of final and parcel maps, reversion to acreage maps and amended maps, and the processing and approval of subdivision improvement plans;

4.

Inspection and approval of subdivision improvements;

5.

Review and approval of grant deeds for subdivision dedications which are outside a subdivision boundary; and

6.

Collection of plan check, inspection and development fees.

B.

When necessary to carry out these responsibilities, the city engineer may designate and authorize a representative to act on his or her behalf.

The city attorney's responsibilities include reviewing and approving as to form all subdivision improvement agreements and security.

16.06.070 - Conflict of interest.

When the Subdivision Map Act or this title requires the execution of certificate or affidavit or the performance of an act by a person in his official capacity who is also the owner, subdivider or an agent or employee of a subdivider, the certificate or affidavit shall be executed or such act performed by some other qualified person authorized to act by the city council.
