6.04.010 - Definitions.

Unless the text otherwise requires, the following terms and words shall have the meanings set out in this chapter.

6.04.020 - Animal.

"Animal" means any dog, cat, swine, livestock, wild animal or fowl subject to regulation pursuant to this title.

6.04.030 - Animal control center.

"Animal control center" means the facilities provided by the county for the impounding and care of animals.

6.04.040 - Animal control officer.

"Animal control officer" means that person and his or her duly authorized assistants and deputies employed by the city who are authorized and directed to enforce the provisions of this title and carry out the intent hereof.

6.04.050 - At large.

"At large" means the presence of any animal when it is off the premises of its owner and not restrained by a leash or tether under the control of a person physically capable of retaining control of the animal, or when the animal is on the premises of its owner and not restrained by a leash, tether, fence or other adequate enclosure sufficient to prevent ingress and egress of the animal or not under the control and in the immediate presence of its owner.

6.04.060 - City.

"City" means the city of Rocklin.

6.04.065 - City animal shelter.

"City animal shelter" means the facilities provided by, or contracted with, the city for the impounding and care of animals.

6.04.070 - City manager.

"City manager" means the manager of the city of Rocklin.

6.04.080 - County.

"County" means the county of Placer.

6.04.085 - Domestic.

"Domestic," when used to describe an animal, means adapted to life in intimate association with people and able to live and breed in a tame condition.

6.04.090 - Domestic fowl.

"Domestic fowl" means any common farm fowl including, but not limited to, turkeys, geese, ducks, chickens and pigeons.

6.04.100 - Health officer.

"Health officer" means the health officer of the county or any of his duly authorized representatives.

6.04.110 - Impoundment.

"Impoundment" means the taking up and confining of an animal by the animal control officer in a manner consistent with recognized standards of humane treatment. Animals impounded pursuant to this title shall be impounded at the animal control center or at such other place as may be approved by the animal control officer for the impoundment of animals.

6.04.120 - Keep.

"Keep" means keep, harbor, maintain or permit to keep, harbor or maintain.

6.04.130 - Kennel.

"Kennel" means for the purposes of this title shall have the same meaning as is set forth in Section 17.04.290 of the Rocklin Municipal Code.

6.04.140 - Livestock.

"Livestock" means any common farm animal, including, but not limited to, cows, horses, sheep and goats, but excluding fowl and domestic swine.

6.04.150 - Owner.

"Owner" means a person, firm, partnership, corporation, association, trust or organization of any kind, having an interest in, harboring or having control, custody or possession of, an animal.

6.04.160 - Person.

"Person" means one or more individual human beings or any fictitious entity or entities.

6.04.165 - Potentially dangerous animal.

"Potentially dangerous animal" shall be defined as set forth in California Food and Agricultural Code § 31602, as amended from time to time.

6.04.170 - Premises.

"Premises" means any parcel(s) of property owned, leased, occupied or under the control of a person.

6.04.180 - Vaccination.

"Vaccination" means the inoculation with an antirabies vaccine approved by, and administered in the manner prescribed by, the State Department of Public Health.

6.04.190 - Vicious animal.

Vicious animal shall be defined as set forth in California Food and Agricultural Code § 31603, as may be amended from time to time.

6.04.200 - Wild animal.

"Wild animal" means any of the following:

A. Following members of the class Reptilia:

  1. Order Ophidia (such as, but not limited to, racers, boas, water snakes and pythons) over eight feet in length; and

  2. Order Loricata (such as, but not limited to, alligators, caymans and crocodiles) over four feet in length.

B. Following members of the class Aves:

  1. Order Falconiformes (such as, but not limited to, hawks, eagles and vultures which are not kept pursuant to federal or state permit); and

  2. Subdivision Ratitae (such as, but not limited to, ostriches, rheas, cassowaries, and emus).

C. Following members of the class Mammalia: 1. Order Carnivora, expressly excepting the domestic dog (Canis familiaris) and the domestic cat (Felis catus), but including, but not limited to, the family Felidae (such as ocelots, margays, tigers, jaguars, leopards and cougars), the family Canidae (such as wolves, dingos, coyotes and jackals); and

  1. Order Marsupialia (such as kangaroos and opossums); and

  2. Order Chiroptera (bats); and

  3. Order Edentata (such as sloths, anteaters and armadillos); and

  4. Order Proboscidea (elephants); and

  5. Order Primata (including, but not limited to, monkeys, chimpanzees and gorillas); and

  6. Order Ungulata (expressly excluding domestic swine and any animal which is included within the definition of "livestock" in Section 6.04.140 of this chapter and including, but not limited to, nondomestic swine, antelope, deer, bison, and camels).

D. Any nondomestic species when kept, maintained or harbored in such numbers or in such a manner as to constitute the likelihood of danger to the animals themselves, to human beings or to the property of human beings.

E. Any species of animal which is venomous to human beings, whether its venom is transmitted by bite, sting, touch or other means, except honey producing bees.
