16.44.010 - Commission—Statutory advisory agency.

The planning commission is designated as the advisory agency as the term is used in the Subdivision Map Act.

16.44.020 - Commission—Powers and duties.

For purposes of this title the commission shall have the following powers and duties:

A. To review each tentative map and, based upon such review:

  1. Approve, conditionally approve, or disapprove any tentative parcel map,

  2. Disapprove any tentative subdivision map,

  3. Recommend to the council approval, or conditional approval, of any tentative subdivision map;

B. To approve modifications for any tentative parcel map and to recommend modifications for any tentative subdivision map in accordance with Chapter 16.36;

C. To review and make recommendations concerning proposed subdivisions in the unincorporated territory of the county in accordance with Section 66453 of the Subdivision Map Act;

D. Such other duties as may be prescribed by law or by the council.

16.44.030 - Development review committee—Created—Composition.

There is created a development review committee, to consist of a member of the planning department appointed by the city manager, the city engineer, the city manager and such other staff as may be designated by the city manager.

16.44.040 - Development review committee—Powers and duties.

The development review committee shall review each tentative map for the purpose of identifying any major problems concerning the proposed use of the land, the proposed design and improvements, and conflicts with the general plan or Title 17, and to indicate to the subdivider and/or his surveyor and engineer the existence of any problems or conflicts and any additional information which may be required prior to consideration of the map by the commission. The committee shall exercise such other duties as may be assigned by the commission.

16.44.050 - Disapproval of maps—Restrictions.

Neither the council nor the commission shall approve a map if it fails to meet any of the requirements of the Subdivision Map Act or this title or conditions imposed pursuant thereto. A final map shall be disapproved only for failure to meet or perform requirements or conditions which were applicable to the subdivision at the time of approval of the tentative map. The commission or council, when disapproving a map, shall make a finding identifying the requirements or conditions which have not been met or performed.

16.44.060 - Disapproval of maps—Waiver for minor error.

The provisions of Section 16.44.050 may be waived when the failure of the map is the result of a technical and inadvertent error, which does not materially affect the validity of the map. The subdivider may request such a determination by written request filed with the planning director. Such request shall be acted upon by the commission or the council as may be appropriate.
