16.08.010 - Applicability of definitions.

Except as otherwise set forth in this chapter, words and phrases used in this title shall be deemed to have the same meaning attributed to them in the Subdivision Map Act, and definitions contained in the Subdivision Map Act are incorporated in this chapter and shall be deemed to apply as though set forth in this title.

16.08.020 - Plural and singular—Shall and may—Includes.

A. All words used in the singular include the plural, and the plural the singular; each gender includes the other; and any tense includes the other tenses unless the context requires otherwise.

B. The word "shall" is mandatory and the word "may" is permissive.

C. The word "includes" shall not limit a term to the specific examples, but is intended to extend its meaning to all other instances or circumstances of like kind or character.

16.08.030 - Undefined words or phrases.

When a word or phrase used in this title is not defined in this chapter, such word or phrase shall be defined as follows:

A. If the word or phrase has a dictionary definition, then such definition shall be used, unless the use of such definition would lead to an unreasonable result.

B. If no dictionary definition exists, then the word or phrase shall be defined as set forth in any generally recognized treatise or authority on zoning or planning.

C. If there is neither a dictionary definition, nor a definition in a generally recognized treatise or authority, then the word or phrase shall be defined according to its general usage and understanding in the community.

16.08.040 - Advisory agency.

The planning commission of the city shall be the advisory agency

16.08.050 - Approved access.

"Approved access" means right of vehicular travel to a public street, as shown on a final subdivision map or final parcel map or as approved by the commission or council.

16.08.060 - City.

"City" shall mean the city of Rocklin.

16.08.070 - City planner, planner, planning director.

"City planner," "planner," "planning director" means the planning director of the city or his authorized representative.

16.08.080 - Commission.

"Commission" means the planning commission of the city.

16.08.090 - Council.

"Council" means the city council of the city.

"County" means the county of Placer.

16.08.110 - Design and improvement standards.

"Design and improvement standards" means standards and specifications for the design of subdivisions and public improvements therein adopted by resolution of the council.

16.08.120 - Final map or final subdivision map.

"Final map" or "final subdivision map" means a map prepared by a registered civil engineer or licensed land surveyor and presented for recording, which conforms to an approved tentative subdivision map, the Subdivision Map Act, and the provisions of this title.

16.08.130 - Flood hazard.

"Flood hazard" means a hazard to land or improvements due to seasonal inundation or to overflow water having sufficient velocity to transport or deposit debris, scour the surface soil, dislodge or damage buildings, or erode the banks of water courses.

16.08.140 - Floodplain.

"Floodplain" means the one-hundred-year floodplain as defined by applicable criteria and surveys of the Army Corps of Engineers for the city or, where no data is available from the Corps of Engineers, then as determined by the city engineer.

16.08.150 - Front lot line.

In the case of an interior lot, "front lot line" means a line separating the lot from the street, and in the case of a corner lot, "front lot line" means a line separating the narrowest street frontage of the lot from the street.

16.08.160 - General plan.

"General plan" means the general plan of the city.

16.08.170 - Geological hazard.

"Geological hazard" means any hazard inherent in the crust of the earth, or artificially created, which is dangerous or potentially dangerous to life, property or improvements due to the movement, failure or shifting of earth.

16.08.180 - Lot.

"Lot" means a parcel of land which is identified with a separate and distinct number or letter on a final map or parcel map recorded in the office of the county recorder.

16.08.185 - Lot, corner.

"Corner lot" means a lot that is located at the intersection of two streets and has frontage on each street, see Figure 16.08.281.

16.08.186 - Lot, interior.

"Interior lot" means a lot which is not located at the intersection of two streets, see Figure 16.08.281.

16.08.187 - Lot, reverse corner.

"Reverse corner lot" means a lot located at the corner of two intersecting streets where the two adjoining lots each front on the respective adjacent streets such that the rear yard and street side yard of the home on the corner lot abuts the front yard of the home on the adjoining lot behind it, see Figure 16.08.281.

16.08.190 - Lot area, lot size.

"Lot area" or "lot size" means the amount of land in a lot measured in square feet or acres.

16.08.200 - Lot depth.

"Lot depth" means the horizontal distance between the front and rear lot lines measured along the median between the two side lot lines.

16.08.210 - Lot lines.

"Lot lines" means the lines bounding a lot.

16.08.220 - Lot width.

"Lot width" means the horizontal distance between the side lot lines, measured at right angles to the lot depth at a point midway between front and rear lot lines.

16.08.230 - Parcel.

"Parcel" means a piece of real property. It may be synonymous with "Lot," but may also include property which, though appearing as separate entities on a map filed for record, or on the maps of the county assessor, has never been legally divided or has merged.

16.08.240 - Parcel map, final parcel map.

"Parcel map" or "final parcel map" means a map prepared by a registered civil engineer or licensed land surveyor and presented for recording which conforms to an approved parcel map, with the Subdivision Map Act, and the provisions of this title.

16.08.250 - Private road easement.

"Private road easement" means a parcel of land not dedicated as a public street, over which a private easement for road purposes is proposed to be or has been granted to the owners of property contiguous or adjacent thereto, which intersects or connects with a public street or a private street; in each instance, the instrument creating such easement shall be or shall have been duly recorded or filed in the office of the county recorder.

16.08.260 - Public way.

"Public way" means any street, highway, alley, pedestrian way, equestrian or hiking trail, biking path, channel, viaduct, subway, tunnel, bridge, easement, right-of-way, or other way which the public has a right of use.

16.08.270 - Rear lot line.

"Rear lot line" means a line which is opposite and most distant from the front lot line or, in case of an irregular or triangular lot, a line ten feet within the lot, parallel to and at the maximum distance from the front lot line.

16.08.280 - Side lot line, interior.

"Interior side lot line" means any lot boundary line not a front lot line or a rear lot line that directly abuts another lot, see Figure 16.08.281.

16.08.285 - Side lot line, street.

"Street side lot line" means any lot boundary line not a front lot line or a rear lot line that directly abuts a street, see Figure 16.08.281.

16.08.290 - Subdivision Map Act.

"Subdivision Map Act" means the Subdivision Map Act of the state (Government Code, Title 7, Division 2, Subdivisions, commencing with Section 66410) and all amendments or additions thereto.

16.08.300 - Tentative map, tentative subdivision map, tentative parcel map.

"Tentative map," "tentative subdivision map" or "tentative parcel map" means a map presented to the design review committee or commission for approval of land divisions which require a final map, or parcel map, when a tentative map is required by this title.

16.08.305 - Vesting tentative map.

"Vesting tentative map" means a tentative subdivision map or tentative parcel map that has printed conspicuously on its face the words "Vesting Tentative Map" at the time it is filed under Section 16.18.060 of this chapter.

16.08.310 - Zoning code.

"Zoning code" means Title 17 and all amendments thereto.
