§ 15.04.010. Purpose.¶
This title is enacted for the purpose of adopting rules and regulations pursuant to the State Housing Law and the Health and Safety Code, for the protection of the public health, safety and general welfare of the occupant and the public and shall govern creation, construction, enlargement, conversation, alteration, repair, moving, removal, demolition, occupancy, use, height, court area, sanitation, ventilation and maintenance of any building used for human habitation; provided, however, that nothing in the codes hereinafter adopted shall be construed to prevent any person from constructing his or her own building, mechanical, plumbing or electrical work when performed with the permits in compliance with this title.

§ 15.04.020. Definitions.¶
Whenever any of the following names or terms is used herein or in any of the codes adopted by references by this title, unless the context directs otherwise, such names or terms so used shall have the meaning attached thereto as is set forth in this section.
"Board of appeals," "housing advisory and appeals board,"
and any other reference to the appellate body in any of the Uniform Codes adopted by reference by this title means the board of appeals provided for in Section 1.8.8 of California Code of Regulations, Title 24, Part 2, Volume 1, adopted herein.
"Building department," "electrical department," "plumbing department," "office of administrative authority," or "housing department"
means the building department of the city.
"Building official," "plumbing official," "chief electrical inspector," "administrative authority"
and similar references to a chief administrative position means the building official of the city.
"City clerk"
means the ex-officio clerk of the city council.
"City council" or "mayor"
means the governing elected officials of the city.

§ 15.04.030. International codes adopted.¶
A. Subject to the modifications, amendments, additions, and deletions described in this title, the following primary and secondary codes are adopted and incorporated into the codes of the city of Rio Vista by reference, having the same legal effect as if their respective comments were set forth herein:

The California Building Standards Code, 2025 Edition, known as the California Code of Regulations, Title 24 (CCR T-24), as adopted by the State of California Legislature, is adopted by reference as the building code of the city of Rio Vista, incorporating Parts 1, 2, 2.5, 3, 4, 5, 6, 8, 10, 11, and 12, known collectively as the California Building Standards Code, and respectively as the California Building Standards Administrative Code, the California Building Code, the California Electrical Code, the California Mechanical Code, the California Plumbing Code, the California Existing Building Code, and the California Reference Standards Code, and adopting by reference Title 25, Division 1, Chapter 1, Subchapter 1 of the California Code of Regulations, known as the State Housing Law Regulations, and adopting by reference the Uniform Code for the Abatement of Dangerous Buildings, incorporating:
The California Building Standards Administrative Code, 2025 Edition, together with the appendices and the non-building and administrative regulations incorporating the 2024 Edition of the International Building Code; published by the International Code Council, 50 New Jersey Avenue, NW, 6th Floor, Washington, DC 20001, is adopted by reference as the administrative code for the city of Rio Vista.
The Uniform Housing Code, 1997 Edition, as published by the International Code Council as referenced by the California Department of Housing and Community Development, pursuant to provisions of the California Health and Safety Code is adopted by reference as the housing code of the city of Rio Vista.
The California Building Code, 2025 Edition, together with the appendices and the non-building and administrative regulations incorporating the 2024 Edition of the International Building Code; published by the International Code Council, 50 New Jersey Avenue, NW, 6th Floor, Washington, DC 20001, is adopted by reference as the building code for the city of Rio Vista.
The California Residential Building Code, 2025 Edition, together with the appendices and the non-building and administrative regulations incorporating the 2024 Edition of the International Building Code; published by the International Code Council, 50 New Jersey Avenue, NW, 6th Floor, Washington, DC 20001, is adopted by reference as the residential code for the city of Rio Vista.
The California Plumbing Code, 2025 Edition, with all appendices, and the non-building administrative regulations incorporating the 2024 Uniform Plumbing Code of the International Association of Plumbing and Mechanical Officials (IAPMO), is adopted by reference as the plumbing code for the city of Rio Vista.
The California Electrical Code, 2025 Edition, incorporating the 2024 Edition of the National Electrical Code of the National Fire Protection Association (NFPA), is adopted by reference as the electrical code of the City of Rio Vista.
The California Mechanical Code, 2025 Edition, incorporating the 2024 Edition of the Uniform Mechanical Code, with all appendices, and the non-building administrative regulations as published by the International Association of Plumbing and Mechanical Officials, is adopted by reference as the mechanical code of the city of Rio Vista.
The California Historical Building Code, 2025 Edition, with all appendices, incorporating the 2024 International Building Code of the International Code Council, is adopted by reference as the historical building code of the city of Rio Vista.
The California Existing Building Code, 2025 Edition, with all appendices, incorporating the 2024 International Building Code of the International Code Council, is adopted by reference as the existing building code of the city of Rio Vista.
The California Green Building Standards Code, 2025 Edition, with all appendices, is adopted by reference as the green building standards code of the city of Rio Vista.
The California Referenced Standards Code, 2025 Edition, with all appendices, is adopted by reference as the referenced standards code of the city of Rio Vista.
C. The city of Rio Vista adopts the administrative and non-building regulations contained in the above-referenced model codes, and further adopts by reference:
The Uniform Swimming Pool Spa and Hot Tub Code, 1997 Edition, as published by the IAPMO;
The Uniform Sign Code, 1997 Edition, as published by the International Conference of Building Officials.

§ 15.04.040. Filing of copies of codes.¶
The building department shall maintain on file copies of the codes referred to in this chapter. Copies of such codes may be obtained through the building department at cost.

§ 15.04.050. Building permits.¶
A. Any contractor or subcontractor who applies for permits to do work within the city limits shall be denied permits if they do not possess a current, valid city business license, valid California State contractor's license, and current, valid worker's compensation.
B. Any permits issued in error to anyone not being licensed by the city or not possessing valid worker's compensation shall be revoked, until such time as all fees are paid and licenses valid.

§ 15.04.060. Occupancy.¶
A certificate of occupancy shall not be issued until all applicable city ordinances, resolutions, regulations and the conditional use permit conditions have been complied with.

§ 15.04.070. Permit fees.¶
A. All building permit related fees are set by resolution of the city council.
B. Valuation of building construction shall be assessed by the building official based on the most current data published by the International Code Council adjusted for the San Francisco Bay Area.
C. Plan review fees calculated pursuant to the building permit fee schedule shall be paid at the time of submittal for plan review. All other fees shall be paid prior to the issuance of the building permit. The fees charged shall be those fees in effect at the time of issuance.
D. Earthquake Fee. As prescribed by Section 2705, Public Resources Code, state of California, an earthquake (strong motion) fee as set forth by the building official shall be paid with the issuance of each building permit.
E. Payment—Schedules on File. All of these fees shall be paid to the city prior to the issuance of a permit. A copy of these fee schedules shall be kept in the office of the city building official and shall be available for public inspection where permits are issued. The fees charged shall be those in effect at the time the permit is issued.

§ 15.04.080. Modifications, amendments, additions and deletions.¶
A. The California Building Code, 2025 Edition, Section 3303.6, is amended by the addition of the following at the end of the existing text:
Permits for removal and demolition of existing buildings shall not be granted until the applicant presents verification from the city of Rio Vista, Department of Public Works, and from authorized representatives of the utility companies, that water, sewer, gas, electricity, telephone, and television lines have been either removed, secured, or disconnected in a manner satisfactory to those agencies or organizations.
B. California Building Code, 2025 Edition, Section 1907A.2, is added to read as follows:
Group R, with concrete floors bearing on ground shall have provided, below the concrete floor, a minimum of four inches of rock or sand;
All driveways and interior slabs shall be reinforced with a minimum reinforcement of #3 rebar at two feet on center, both ways, except when otherwise specifically approved by the Building Official.
C. California Building Code, 2025 Edition, Section 2306.3(3), is amended by adding the following at the end of the existing text:
Gypsum wallboard is not permitted to provide shear resistance in the city of Rio Vista.
D. California Building Code, 2025 Edition, Section 1505.1, first paragraph, is amended to read as follows:
All materials applied as roof covering on any structure regulated by this code shall have a fire-retardant rating of Class A or B as specified in Section 1505 as amended herein, treated in accordance with IBC Standard 1505.
E. California Building Code, 2025 Edition, Subsection 3403.1, is amended by adding the following sentence to the end of the first paragraph to read as follows:
However, when the addition, alterations or repairs within any 12-month period exceeds 50% of the current replacement value of an existing building or structure, as determined by the building official, such building or structure shall be made in its entirety to conform with the requirements for new buildings or structures.
F. California Plumbing Code, 2025 Edition, add Section 507.27, Mandatory Water Conservation Regulations:
Section 507.27 Mandatory Water Conservation Regulations
507.27.1. Definitions.
507.27.1.1 "Water Recirculating System" means a system approved by the City of Rio Vista that recirculates water between hot water and cold water lines, so that substantially all the cold water standing in the pipes will be returned to the water heater and reheated before the faucet is turned on. The system may be turned on and off by a manually operated switch, by a timer-operated switch, or a combination of manually and timer-operated device, or may be left on permanently.
507.27.1.2 "New Construction" means a completely new residential structure, a new addition to a previously existing structure or the portion of a previously existing structure that is newly remodeled or renovated.
507.27.2. Mandatory Water Use Restrictions.
In all New Construction, all hot water faucets that have more than 10 feet of pipe between the faucet and the water heater serving such faucet shall be equipped with a Water Recirculating System.

§ 15.04.090. Violations—Penalties.¶
It is unlawful for any person, firm or corporation, to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building, structure or building service equipment, or cause or permit the same to be done, in violation of this code.

§ 15.04.100. Administrative citation.¶
Any person, firm, or corporation, violating any of the provisions of this title shall be issued an administrative citation, and each such person, firm or corporation shall be deemed guilty of a separate violation for each and every day or portion thereof during which any violations of the provisions of this title is committed, continued or permitted, and upon conviction of any violation, such person or persons shall be fined not more than $500, for each separate offense.

§ 15.04.110. Enforcement official.¶
The building official shall be the administrative and enforcement officer for the making of all inspections and the issuance of all permits, and the collection of all fees provided for by this title, and shall enforce the provisions thereof, with such qualified assistants or deputies as he or she shall appoint, with the approval of the city manager.

§ 15.04.120. Appeals.¶
A. In order to determine the suitability of materials and fixtures, types of construction and equipment, and to provide for reasonable interpretations of the provisions of this title and of all codes adopted thereby the city council shall serve as the board of appeals. Any person aggrieved by a ruling or order of the building official may appeal to the city council, whose decision shall be final.
B. Any appeals filed under this section shall be accompanied by a nonrefundable appeals fee of $510 that shall be paid at the time the appeal is filed with the building official.
